Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

permission for us to rebuild the community dock at Broad Creek in Craven
County.
I would appreciate your sending the permit to me at the above address so we
can make arrangements to start working on rebuilding the dock as soon as
the weather gets warmer.

Dear Mr. Jowdy,
This letter is in reference to our 13 November 2003 onsite meeting at your property located at
115 Broad Creels Rd. near New Bern, Craven County, North Carolina. The purpose of this
meeting was to issue a CA ,M and Dredge and Fill General Permit to replace the pier on your
property that was damaged in Hurricane Isabel.
While onsite the aforementioned property, I noticed a second storm dat7naged pier located on
your property. As we discussed, our current rules allow a maximum of four square feet of
platform per linear foot of shoreline on your property. Specifically, both 15A NCAC
07H.0208(b)(6)(D) and 1 SA NCAC 07H.1205(g) state in part, that the combined area of
all Vs, finger piers platforms, and decks must not exceed a total areas of four square feet
per linear foot of shoreline. You stated to me that your shoreline totals 100 feet in length.
The permit allowing you to rebuild one pier allows a total of 348 square feet of platform. Any
repair or replacement of the second storm damaged pier would result in a violation of the four
square foot regularion. Therefore, as we discussed, the second storm damaged pier may not be
repaired or replaced at this time.
I appreciate your concern and effort to comply with the permit requirements of this Division and
encourage you to continue to consult representatives of this Division for future questions
