Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

This letter is in response to your January 5, 2004 facsimile regarding your concerns about the proposal
by Mr. David Greer to construct a pier on his lot, adjacent to your property, at Lot 7, Sloop Point Plantation,
near Hampstead, in Pender County. The proposed project has been determined to comply with the Rules of the
Coastal Resources Commission (15A NCAC 7H.1200). As such, the Division has issued a CAMA General
Permit for the proposed development. I have enclosed a copy of the General Permit and the applicable rules that
govern the construction of piers, docks and boat houses in estuarine waters and public trust areas. The enclosed
rules require that the pier not cause an unreasonable interference with navigation. The permit required that the
proposed floating dock not be located within the channel. The rules also require that the pier shall have a
minimum setback of 15 feet from the adjacent property owner's area of riparian access (unless this 15 foot
setback is waved by the written agreement of the adjacent riparian property owner. In a telephone conversation
today with the applicant's contractor (Mark Clements), Mr. Clements indicated that the proposed pier would be
located between 30 and 40 feet from your common property line.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party Hearing.
The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The
hearing request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days after the disputed permit decision is made. I have enclosed the applicable
forms and instructions that must be filed prior to that deadline. Please contact me at (910) 395-3900, if you have
