Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .

In 1974, the North Carolina General Assembly passed
the Coastal Area Management Act and set the stage for
guiding development in the fragile and productive areas
which border the state's sounds and oceanfront. Along
with requiring special care by those who build and
develop, the General Assembly directed the Coastal
Resources Commission (CRC) to implement clear regula-
tions which minimize the burden on the applicant.
This application for a minor development permit under
CAMA is part of the Commission's effort to meet the
spirit and intent of the General Assembly. It has been
designed to be straightforward and require no more
time or effort necessary from the applicant. Please go
over this folder with the Local Permit Officer (LPO) for
the locality in which you plan to build to be certain that
you understand what information he or she needs.
Under CAMA regulations, the minor permit is to be
issued within 25 days once a complete application is in
hand. Often less time is needed if the project is simple.
The process generally takes about 18 days. You can
speed the approval process by making certain that your
application is complete and signed, that your drawing
meets the specifications given inside and that your
application fee is attached.
Other permits are sometimes required for development
in the coastal area. While these are not CAMA-related,
we urge you to check with the Local Permit Officer to
determine which of these you may need. A listing is
included on page 2 of this folder.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.

Dear Mr. Youngblood:
On November 30, 2005, personnel of this office inspected a project located on East Ivybridge Drive
in Onslow County, North Carolina. This inspection was performed to determine compliance with
the North Carolina Sedimentation Pollution Control Act (Act) of 1973. The inspection revealed a
land -disturbing activity exceeding one acre being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, G.S.
113A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4. If you feel that
you are not responsible for the following violations, please notify this office immediately.
The violations that were found are:
a. Failure to file an erosion and sedimentation control plan with this office at least 30 days prior
to beginning a land -disturbing activity on a tract comprising more than one acre, when more
than one acre is to be uncovered, failure to secure this office's prior approval of the plan for
any land -disturbing activity prior to beginning the land -disturbing activity. G.S. 113A-
54(d)(4), G.S. 113A-57(4) and 15A NCAC 4B.0107(c). Grading of the subdivision lots
has occurred with no plan on file addressing the lot disturbance.

e. Failure on a tract of more than one acre, when more than one acre is uncovered, to install
sedimentation and erosion control devices sufficient to retain the sediment generated by the
land -disturbing activity within the boundaries of the tract during construction upon and
development of the tract. G.S. 113A-57(3). No erosion control measures have been
installed.
f. Failure to take all reasonable measures to protect all public and private property from damage
by such land -disturbing activities. 15A NCAC 4B .0105. No measures have been installed
for erosion control. Federally protected wetlands and waters of the state are being
impacted.
g. Failure to retain along a lake or natural watercourse a buffer zone of sufficient width to
confine visible siltation by natural or artificial means within the 25 percent of that portion of
the buffer zone nearest the land -disturbing activity. G.S. 113A-57(1). Visible siltation is
entering wetlands and waters with no retention measures in place to prevent sediment
migration.
i. Failure within 21 calendar days of completion of any phase of grading to plant or otherwise
provide exposed, graded slopes or fills with ground cover, devices, or structures sufficient to
restrain erosion. G.S. 113A-57(2). Exposed slopes and sloping areas are bare and
eroding.
To correct these violations, you must:
1. Immediately install erosion control measures sufficient to keep the sediment from the lot
disturbance on each lot, out of the roadside ditches, out of the wetlands, and out of Queens
Creek.
2. Bare sloping areas must be provided groundcover sufficient to restrain erosion. Please note
that simple seeding, with no lime, fertilizer, or mulch and tack, is not considered adequate.
3. Submit a Sedimentation Erosion Control Plan covering any and all existing or proposed lot
disturbance.
Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or
of "ground cover sufficient to restrain erosion." These requirements are not satisfied until an
adequate cover of grass or other ground cover (such as properly applied and secured, mulched
seeding or appropriate rip -rap) is established which is, in fact, sufficient to restrain accelerated or
man-made erosion.

The penalty for an initial violation could be an assessment of up to $5,000.00. A time period for
compliance is not required for enforcement of this violation pursuant to NCGS 113A-61.1(c) and
NCGS 113A-64(a)(1). Therefore, the initial violation may be referred to the Director, Division of
Land Resources, for appropriate action.
Please be advised that if these violations are not corrected within 7 days of receipt of this notice (for
installation of erosion control measures) and 30 day from receipt (for groundcover and plan
submittal) the Director, Division of Land Resources, will be requested to take appropriate legal
action against you pursuant to NCGS 113A-64. That action could be the assessment of a civil
penalty, and the amount maybe up to $5000 per day for each day of the violation. The penalty may
be assessed from the date of the violation, NCGS 113A-64(a)(1). If the violations are corrected
within the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project should not begin
until the area presently disturbed is brought into compliance with the Act. When corrective actions
are complete, you should notify this office so that work can be inspected. You should not assume
that the property complies with the Act until we have notified you. After installation, all erosion
control measures must be maintained in proper working order until the site is completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of
the relevant statute and administrative rules may be examined at this office or will be sent to you
upon request.
