Issued to Joseph & Ginny Mabry authorizing development in the Estuarine Shoreline (AEC) at 171 Rogers Road, Manteo, as
requested in the permittee's application, dated 03-03-2025 and received on 03-03-2025. This permit, issued on 03-03-2025 is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject perrnittee to a fine, imprisonment or civil
action, or may cause the permit to be null and void.
This permit authorizes: the construction of a single-family dwelling and associated site work, including a pool, vegetation
removal, the planting of trees and grass seeding within the 30' & 75' AEC's. .
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings
dated received 03-03-2025. [GS 113A-120]
(2) All construction must Conform to the all other State and Federal regulations, applicable local ordinances, and FEMA Flood
Regulations. [GS 113A-120]
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit. [GS 113A-120]
(4) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed
of to a third -party. [GS 113A-120]

This permit action may be appealed by the pennittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit require further written permit approval. All work must cease when
this permit expires on:
December 31, 2028
In issuing this permit it is agreed that this project is consistent with the local
Land Use Plan and all applicable ordinances. This permit may not be
transferred to another party without the written approval of the Division of
Coastal Management

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of NORMAL WATER
LEVEL Estuarine Shoreline Area of Environmental Concern. 107H .0209(d)(2)]
(6) Unless specifically allowed in 15A NCAC 07H.0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of NORMAL WATER LEVEL. No
portion of the roof overhang shall encroach into the 30 ft. buffer. [15A NCAC 07H.0209(d)(10)]
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line
of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas,
until such time as the area has been properly stabilized with a vegetative cover. [07H .0209(d)(3)]
(8) Any proposed for grading within the 30' buffer from the NORMAL WATER LEVEL must be contoured to
prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively
stabilized, and must remain in a vegetated state. [07H .0209(d)(3)]
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of
construction completion. [GS 113A-120]

Good morning Ginny,
The referenced lot was evaluated yesterday. This lot is suitable for wastewater system
construction. Permits can be issued once you have your house plans prepared along
with the over site plan showing all the proposed improvements.
You will need to speak with the neighbors and have their existing well points located;
there is a 50' setback to those.
For a six bedroom dwelling you will need a 1500 gallon tank with 300' of drain field on
9' centers along with an equivalent 100% repair area.
The following setbacks apply:

Dwelling and all appurtenance- 5'
