Dear Ms. Dickerson:
On Thursday, October 10, 2024, 1 spoke with your contractor, Bo Owens of Northeastern
Marine, and confirmed that due to the delays during the construction of the replacement
bulkhead on Queen Elizabeth Street, the repair and replacement of the Town's boardwalk was
further delayed. I confirmed that Exemption 032624-AY for the boardwalk had expired, and that
I would send out a reissuance based on the original documentation submitted by Albemarle &
Associates dated 03/19/2024. The activities proposed are exempt from needing a development
permit as long as they remain consistent with those plans received via email on 03/19/2024, and
meet the conditions specified below. If your plans should change and your project will no longer
meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR:
[G.S. 113-103(5)(B)(5) and 15A NCAC 7K.0103(a)] - Maintenance and repairs (excluding
replacement) necessary to repair damage to structures caused by the elements are specifically
excluded from the definition of development under the conditions and in the circumstances set
out in G.S. 113A 103(5)(b)(5). 15A NCAC 07J .0210 REPLACEMENT OF EXISTING
STRUCTURES: Replacement of structures damaged or destroyed by natural elements, fire or
normal deterioration is considered development and requires CAMA permits. Replacement of
structures shall be permitted if the replacement is consistent with current CRC rules. Repair of
structures damaged by natural elements, fire or normal deterioration is not considered
development and shall not require CAMA permits. The CRC uses specific criteria to determine
whether proposed work is considered repair or replacement.

It was determined that the repairs to the boardwalk (over land and water) was less than 50% of
the total structure. The repairs are limited to the following conditions:
Repair/replacement of ±150'x12' boardwalk (outboard piles, girders, joists, and
decking).
No expansions of footprint are permissible.
The proposed repairs shall be consistent with all other applicable local ordinances
and North Carolina Building Code standards.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining
any other State, Federal or Local authorization and NC Building Permits. This exemption
expires 120 days from the date of this letter.

Dear Ms. Dickerson:
I have reviewed the information submitted on behalf of the Town of Manteo by John DeLucia of
Albemarle & Associates regarding the necessary filing of an application for a general permit
under the Coastal Area Management Act. Based on my site visit conducted on March 26, 2024,
and the documentation submitted, it has been determined that the activities proposed are
exempt from needing a development permit as long as they remain consistent with the
documentation dated received via email on March 19, 2024, and meet the conditions specified
below. If your plans should change and your project will no longer meet these conditions,
please contact me before proceeding.
MAINTENANCE AND REPAIR:
[G.S. 113-103(5)(B)(5) and 15A NCAC 7K.0103(a)] - Maintenance and repairs (excluding
replacement) necessary to repair damage to structures caused by the elements are specifically
excluded from the definition of development under the conditions and in the circumstances set
out in G.S. 113A 103(5)(b)(5).
15A NCAC 07J .0210(2)(a) WATER DEPENDENT STRUCTURES. The proposed work is
considered replacement if it enlarges the existing structure. The proposed work is also
considered replacement if: (a) in the case of fixed docks, piers, platforms, boathouses, boatlifts,
and free standing moorings, more than 50 percent of the framing and structural components
(beams, girders, joists, stringers, or pilings) must be rebuilt in order to restore the structure to its
pre -damage condition. (c) in the case of bulkheads, seawalls, groins, breakwaters, and
revetments, more than 50 percent of the linear footage of the structure must be rebuilt in order
to restore the structure to its pre -damage condition.

Narrative
The Town of Manteo, NC intends to renovate a portion of their existing waterfront
boardwalk. This section is illustrated on the attached plan. The outboard piles, girders,
joists and decking are degrading and need to be replaced. This project will include
removal of the outboard piles, girders, joists and decking. The existing vinyl bulkhead will
have new tie -backs installed prior to reconstructing the boardwalk. The boardwalk will be
replaced in kind with new treated materials of the same size. The boardwalk width will
remain unchanged and will tie into the existing boardwalk on the north and south as it
currently does.
This is shown on the attached plan.
