RE: EXEMPTED PROJECT —REDISTRIBUTION OF SAND CONSISTENT WITH CURRENT RULES

Dear property owner:
I have reviewed the information submitted to this office concerning the filing of an application for a minor development
permit under the Coastal Area Management Act. After making a site inspection on October 9, 2024,1 have determined
that the activity you propose is exempt from needing a minor development permit as long as it meets the conditions
specified below. If your plans should change and your project will no longer meet these conditions, please contact me
before proceeding.
MAINTENANCE AND REPAIR — [15A NCAC 7K .0103(c)]: Redistribution of sand that results from storm over wash or
aeolian transport around buildings, pools, roads, parking areas and associated structures is considered maintenance so
long as the sand remains within the Ocean Hazard AEC.
1. The project consists of removing sand from on top of septic tank and distribution box for point of sale
inspection to be recovered after inspection;
2. Dune is west side of house and not frontal dune remove vegetation and take clean sand around east side
of house but not to cross dune;
3. This exemption allows for relocated sand to be used in the repair of storm damaged dunes;
4. No movement shall be permitted to cross static line or crest of dune;
5. For clearing driveway/parking of wind blow sand;
6. Existing primary and frontal dunes shall not be broadened or extended in an oceanward direction beyond
pre -storm dimensions;
7. Redistribution of sand shall be accomplished in such a manner that damage to existing vegetation is
minimized;
8. Accumulated sand containing storm debris shall be sifted or have all debris removed prior to redistribution
within an Area of Environmental Concern;
9. The activity shall not exceed the lateral bounds of applicant's property unless permission is obtained from
adjoining owners; [07h.0308(a)(4)(B)]
10. In order to minimize adverse impacts to nesting sea turtles, any work occurring within the period of May 1
through November 15 shall require review from the US Fish & Wildlife Service and North Carolina Wildlife
Resource Commission 919-515-5019;[GS 113A-1201

If your plans should change and your project will no longer meet these conditions, please contact me before
proceeding. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other
State, Federal or Local authorization. This exemption expires 90 days from the date of the letter.
