consistent with the permit),all applicable regulations,special conditions and notes set forth below.Any violation
of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.

I) Except as specifically altered herein,this Minor Modification authorizes the conditional expansion of
the dredge corridor in accordance with the U.S. Army Corps of Engineers' approved corridor and
inclusion of an overdredge allowance, all as expressly and specifically set forth in the attached
modification request and approved workplan drawing. [07J .0202(c)] t

2) Excavation shall not exceed-14' MLLW(with a 2' overdredge allowance) in Oregon Inlet and the
ocean bar channel and-12' MLLW(with a 2' overdredge allowance) in the channels labeled Oregon
Inlet to Hells Gate Channel and Old House Channel Range 1. [07H .0208(b)(1)]

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

ADDITIONAL CONDITIONS
3) Prior to the initiation of any new dredging activities in previously undredged areas located outside of the }
Area of Potential Effects(APE) identified in the Oregon Inlet Subtnergerl Cultural Resources Survey
Dare County, North Carolina,prepared by Panamerican Consultants, Inc. in August 2023, the permittee
shall, in coordination with the N.C. Department of Natural and Cultural Resources(DNCR),develop
and implement an archeological survey of the area to be dredged within the expanded corridor area.
Initiation of new dredging activities in these previously undredged areas shall not begin until written
approval is obtained from the Division of Coastal Management. [07H .0209(d)(7);07H .0208(a)(2)(C);

4) All conditions and stipulations of the active permit remain in force under this Minor Modification
unless specifically altered herein. [07J .0209(a)]
NOTE: This Minor Modification shall be attached to the original of Permit No. 49-19, which was issued
on 6/24/19, as well as all subsequent modifications and renewals,and copies of all documents
shall be readily available on site when a Division representative inspects the project for
compliance.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers has authorized the proposed project by way of a permit
modification with an Action ID No.2019-00175.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual
Water Quality Certification No. WQC006282 and assigned the project DWR Project No. 2019-
0264v8.
NOTE: An application processing fee of$100 was received by DCM for this project.
