I have the permit for 7508 Sound Dr, Emerald Isle ready up front. The permit fee is $800 by check or money order only. I wanted to remind you that with general permits that have objections, once the permit is issued, we also notify the objecting parties. The objecting parties will have 20 days from the date of permit issuance to appeal the permit. You are able to start work at your own risk once you have the correct permits needed, but if the appeal is granted, what is granted will have to be removed. I will notify you if we do receive an appeal and keep you updated with the process along the way. Please mark the location of the pier and bulkhead prior to construction and I will meet you on site to confirm. If you have any questions, please let me know! This is the second notification we have received from the applicants regarding development of a proposed pier, boat lift, and bulkhead. Except for the proposed bulkhead, there does not appear to be any changes from the original proposal submitted to us for review and comment regardingthe pier and boatlift and its location relative to the riparian access lines,which both proposed plans are not consistent with the CRC rules. Our objections as the adjacent riparian are grounded in valid concerns and are in accordance with the laws,rules and regulations outlined bythe Coastal Area Management Act(CAMA)under NCGS 113A-113 and the rules of the NC Coastal Resources Commission (CRC), as detailed below: 15A NCAC 07H.1204 GENERAL CONDITIONS (c)There shall be no interference with navigation or use of the waters by the public by the existence of piers and docking facilities. Response: The proposed pier, as described by the provided site plan, would encroach across the 15' riparian setback and into our duly allocated area of riparian access which would restrict and interfere with our ability to navigate and enjoy our area of riparian access.This encroachment into and across riparian lines would also interfere with any other use of the Public Trust Area and Estuarine Waters by narrowing our area of riparian access. By following the CRC's rules for allocating areas of riparian access(see Exhibit 1),the applicants can still enjoy the full width of their allocated riparian area without needing the 15'waivers from either property owner or having to deviate from the CRC's rules. 15A NCAC 07H.1205 SPECIFIC CONDITIONS (b)Piers and docking facilities shall not extend beyond the established pier length alongthe same shoreline for similar use. This restriction shall not apply to piers and docking facilities 100 feet or less in length unless necessary to avoid interference with navigation or other uses of the waters by the public such as blocking established navigation routes or interfering with access to adjoining properties as determined by the Division I of Coastal Management.The length of piers and docking facilities shall be measured from the waterward edge of any wetlands that border the water body. Response: The Division of Coastal Management regulatory staff would need to determine if the proposed structure as planned would extend beyond the established pier "length" as measured along the same shoreline. In this case, our interpretation of the"same shoreline"would be the shoreline of the existing docks and wharf ing areas along the 7500 block of Sound Drive in Emerald Isle. In addition,the omission of important dimensions, such as but not limited to, showing the accurate length of the dock or the location of the established navigation channel as per the CRC rules for determining the length of piers and docks. (c) Piers and docking facilities longer than 200 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least one foot at each 100-foot increment of pier length longer than 200 feet, or if the additional length is necessary to span some obstruction to navigation. Measurements to determine pier and docking facility lengths shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. Response: One site plan proposal for 7508 Sound Drive is for a dock 225' in length to the landward side of the proposed platform measured from the wall (the contractor's site plan). The map(s) should include the pier head platform in the overall length. However, a site plan prepared by Prestige Land Surveying, dated 07/26/2024, indicates 208' to the wall and 173(?).75' from "Tee to NHW:' What is not clear, other than the indiscernible numeral, is which side of the Tee, or pier head, did they use to measure—the landward side or the waterward side? Also not clear is which site plan measurement do the applicants intend to use, the contractor's site map or the Prestige map? The survey map also omits the CAMA Area of Environmental Concern and its location, or notation of such, on the map.Another omission in the Prestige survey would be the existing pier head alignment which CAMA officials would use to determine the pier length. Another question aboutthe information provided bythe Prestige survey is how did they calculate total lot area? This number is significant as that affects the amount of impervious coverage and the area to remain naturalfor the Emerald Isle zoning ordinance. The map provides information that Prestige computed the area by coordinates. However, the coordinates for this property extend into State owned Public Trust and Estuarine waters and State-owned bottom, or the lands under the Estuarine Waters in this case(NCGS 113A-113(b)(2)& (5)). Therefore, the land submerged by state owned Public Trust Waters should not be used to calculate the impervious cover, total lot area, or the percentage of the natural area based on total lot area because it is considered Public Trust Area. If that is the fact in this case,then those computations are also not accurate for CAMA and town zoning permitting. (q) Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback of 15 feet between any part of the pier and docking facility and the adjacent property Lines extended into the water at the points that they intersect the shoreline. GIS imagery, aerial imagery of boats navigatingthe deep water,the established navigation route,and bathymetric soundings clearly show the edge of deep water, or the channel line in front of the property does not run in a line where the line of division, when drawn perpendicular, or 90 degrees, to the line along the edge of deep water or channel, would appear as a"property line extension,"or extend in a straight line from the shore into the water as depicted. When applying the correct lines of division for the areas of riparian access, the dock proposed at 7508 Sound Drive,would encroach over the 15'riparian setback and the line of riparian division into the riparian access area of 7506 Sound Drive.The proposal would be the cause of an encroachment into our area of riparian access which would interfere with our rights of riparian access, our ability to navigate and enjoy our duly appropriated area of riparian access, and would be inconsistent with the management objectives and specific conditions of the NC Coastal Resources Commission's rules for piers and docks.As drawn,the plans place the proposed dock closer to our riparian area rather than being centered in their area of riparian access. Please see the attached exhibits which substantiates this information and lists the omission of necessary information. Furthermore, the neighboring docks along the same shoreline, except for the dock constructed at 7510 (constructed 2022-2023), are in compliance with the riparian access lines when drawn perpendicular from the edge of deep water,or the line of the channel,as perthe CRC rules.As such,the applicants would also have their full width of riparian access,without needing setback waivers from either neighbors,or deviating from the CRC's rules, byfollowingthe rules for riparian access, and we would not have our riparian access rights debased bythe applicant's plan as proposed. i Bulkhead,Shoreline Alteration,and Lot Clearing Proposal The applicant's proposed site plan(Prestige Land Surveying),dated 07/26/2024,for the proposed wall[bulkhead], shoreline alteration, and lot clearing indicate a proposal that would be directly on the shared property line between 7506 and 7508 Sound Drive.With the proposed wall being on the property line,we object to any portion of the wall, including waters or any other components or parts of the wall that may trespass or cantilever on or over our property.We also object to the location which could directly or indirectly cause hydraulic trespass onto our property. In addition,we object to any trespass onto our property for the construction of any portion of the bulkhead. In addition, because of the proximity of the bulkhead or retaining wall to our property, we are concerned for the jwell-being of our trees, plants, and vegetation that could be impacted by intrusive damage to the roots and rhizomes, including the wetland ecosystem that would be encroached upon by the backfilling. Also pertainingto the proposed bulkhead,the wall is planned to be located within an area that could permanently impact noncoastal wetlands.This area is under the federal jurisdiction of the U.S.Army Corps of Engineers.The existing silt fencing installed along the shoreline,which was installed by the applicants after the land disturbing activity occurred, has substantial sediment fill against it which could fail at any time and cause the filling of wetlands. Page 3 of 12 We are also unable ascertain how Prestige obtained information regarding our existing wall without trespassing onto our property, so we are not sure of the accuracy of the"Existing Pier Alignment as shown or described.The survey by Prestige is also inaccurate,not true,or correct as it depicts three(3)"Lifts"on our dock which is false. Please refer to the exhibits enclosed with this correspondence.The owners of 7508 Sound Drive would still have their full riparian area by complying with the CRC rules for allocating the area of riparian access. Please consider our objections carefully and thoughtfully as they are grounded bythe letter of the Coastal Resource Commission's rules,which are, in part,to protect riparian rights. This property,which both our names are on the deed, represents our life investment, and this is our only home. We respectfully request that the NC Division of Coastal Management staff,the NC Department of Environmental Quality,and the NC Coastal Resources Commission adhere to their rules. Please answer these questions on a separate piece of paper and attach it to this form. 15A NCAC 07H.1205 SPECIFIC CONDITIONS (a) Piers and docking facilities may extend or be located up to a maximum of 400 feet waterward from the normal high water line or the normal water level,whichever is applicable. (b) Piers and docking facilities shall not extend beyond the established pier length along the same shoreline for similar use.This restriction shall not apply to piers and docking facilities 100 feet or less in length unless necessary to avoid interference with navigation or other uses of the waters by the public such as blocking established navigation routes or interfering with access to adjoining properties as determined by the Division of Coastal Management.The length of piers and docking facilities shall be measured from the waterward edge of any wetlands that border the water body. (c) Piers and docking facilities longer than 200 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least one foot at each 100 foot increment of pier length longer than 200 feet, or if the additional length is necessary to span some obstruction to navigation.Measurements to determine pier and docking facility lengths shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. (d) Piers shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. (e) The total square footage of shaded impact for docks and mooring facilities(excluding the pier)allowed shall be 8 square feet per linear foot of shoreline with a maximum of 800 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. (f) The maximum size of any individual component of the docking facility authorized by this general permit shall not exceed 400 square feet. (g) Docking facilities shall not be constructed in a designated Primary Nursery Area with less than two feet of water at normal low water level or normal water level under the general permit set forth in this Section without prior approval from the Division of Marine Fisheries or the Wildlife Resources Commission. (h) Piers and docking facilities located over shellfish beds or submerged aquatic vegetation as defined by the Marine Fisheries Commission may be constructed without prior consultation from the Division of Marine Fisheries or the Wildlife Resources Commission if the following two conditions are met: (1) Water depth at the docking facility location is equal to or greater than two feet of water at normal low water level or normal water level;and (2) The pier and docking facility is located to minimize the area of submerged aquatic vegetation or shellfish beds under the structure as determined by the Division of Coastal Management. (i) Floating piers and floating docking facilities located in Primary Nursery Areas, over shellfish beds, or over submerged aquatic vegetation shall be allowed if the water depth between the bottom of the proposed structure and the substrate is at least 18 inches at normal low water level or normal water level. 0) Docking facilities shall have no more than six feet of any horizontal dimension extending over coastal wetlands and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. (k) The width requirements established in Paragraph(d)of this Rule shall not apply to pier structures in existence on or before July 1,2001 when structural modifications are needed to prevent or minimize storm damage. In these cases,pilings and cross bracing may be used to provide structural support as long as they do not extend more than two feet on either side of the principal structure. These modifications shall not be used to expand the floor decking of platforms and piers. (1) Boathouses shall not exceed a combined total of 400 square feet and shall have sides extending no further than one-half the height of the walls as measured in a downward direction from the top wall plate or header to the Normal Water Level or Normal High Water and only covering the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Structural boat covers, utilizing frame-supported fabric covering, can be permitted on properties with less than 75 linear feet of shoreline when using screened fabric for side walls. (m) The area enclosed by a boat lift shall not exceed 400 square feet. (n) Piers and docking facilities shall be single story.They may be roofed but shall not allow second story use. (o) Pier and docking facility alignments along federally maintained channels shall also meet Corps of Engineers regulations for construction pursuant to Section 10 of the Rivers and Harbors Act of 1899(33 U.S.C.403). (p) Piers and docking facilities shall in no case extend more than 1/4 the width of a natural water body, human- made canal,or basin.Measurements to determine widths of the water body, human-made canals,or basins shall be made from the waterward edge of any coastal wetland vegetation which borders the water body. December 20, 2001; SECTION.1100-GENERAL PERMIT FOR CONSTRUCTION OF BULKHEADS AND RIPRAP REVETMENTS FOR SHORELINE PROTECTION IN ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN HAZARD AREAS 15A NCAC 07H.1101 PURPOSE A permit for construction of bulkheads and riprap revetments under this Section shall allow the construction of bulkheads and riprap revetments for shoreline protection in the public trust waters and estuarine waters AECs subject to the procedures outlined in Subchapter 07J,Section.1100 and according to the Rules in this Section.This permit shall not apply to shoreline protection along the oceanfront or to waters and shorelines adjacent to the Ocean Hazard AEC with the exception of those shorelines that feature characteristics of the Estuarine Shoreline AEC. Such features include the presence of wetland vegetation,lower wave energy,and lower erosion rates than the adjoining Ocean Erodible Area. (b) The applicant shall provide: (1) provide site location, dimensions of the project area, and the applicant's name and address, confirmation that the applicant has obtained a written statement, signed by the adjacent riparian property owners indicating that they have no objections to the proposed work;or (2) confirmation that the applicant has notified adjacent riparian property owners by certified mail of the proposed work.The notice shall instruct adjacent property owners to provide written comments on the proposed development to DCM within 10 days of receipt of the notice and indicate that no response shall be interpreted as no objection. DCM shall review all comments and determine, based on their relevance to the potential impacts of the proposed project,if the proposed project can be approved by a General Permit. If DCM determines that the project exceeds the guidelines established by the General Permit process provided in 15A NCAC 07J A 100, DCM shall notify the applicant that an application for a major development permit shall be required. (c) No work shall begin until an on-site meeting is held with the applicant and a DCM representative so that the proposed alignment may be marked. A General Permit to proceed with the proposed development shall be issued if the DCM representative finds that the application meets all the requirements of this Rule. Construction of the bulkhead or riprap revetment shall be completed within 120 days of the issuance of the general permit or the authorization shall expire and it shall be necessary to re-examine the structure alignment to determine if the general permit may be reissued. (d) This permit shall not be applicable to proposed construction where the Division of Coastal Management has determined,based on an initial review of the application,that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolved questions concerning the proposed activity's impact on adjoining properties or on water quality,air quality,coastal wetlands,cultural or historic sites,wildlife,fisheries resources,or public trust rights. (e) This permit shall not eliminate the need to obtain any other required State,local,or federal authorization. (f) Development carried out under permit set forth in this Section shall be consistent with all State, federal, local requirements,and local land use plans current at the time of authorization. The bulkhead position shall not exceed a distance of five feet waterward of normal high water or normal water level at any point along its alignment. (2) New bulkheads or riprap revetments on shorelines within manmade upland basins,canals,and ditches, shall be positioned so as not to exceed an average distance of two feet and maximum distance of five feet waterward of normal high water or normal water level. (3) When replacing an existing bulkhead, the new alignment shall be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment.To tie into a like structure on the adjacent property,replacement bulkhead position shall not exceed a maximum distance of five feet waterward of the current bulkhead alignment.When replacing a bulkhead where lands landward of the bulkhead were lost in the last year, bulkheads shall be positioned a maximum of two feet waterward of the original or existing alignment. (4) Riprap revetments shall be positioned so as not to exceed a maximum distance of 10 feet waterward of the normal high water or normal water level at any point along its alignment. (b) Along shorelines with wetland vegetation, bulkheads and riprap revetments shall be positioned so that all construction is to be accomplished landward of such vegetation. (c) Bulkheads shall be constructed of vinyl, steel sheet pile,concrete, stone, timber,or other materials approved by the Division of Coastal Management. (d) Riprap revetments shall be constructed of granite,marl,concrete without exposed rebar,or other materials approved by the Division of Coastal Management. (e) Revetment material shall be free from loose dirt or other materials not approved by the Division of Coastal Management. (f) Revetment material shall be of size approved by the Division of Coastal Management to prevent movement of the material from the site by wave action or currents. (g) Construction design for riprap revetments shall take into consideration the height of the area to be protected i.e., bulkhead height, escarpment height, water depth, and the alignment shall allow for a slope no flatter than three feet horizontal per one foot vertical and no steeper than 11/z feet horizontal per one foot vertical. (h) All backfill material shall be obtained from an upland source pursuant to 15A NCAC 07H .0208. The bulkhead or riprap revetment shall be constructed prior to any backfilling activities and shall be structurally tight so as to prevent seepage of backfill materials through the structure. (i) No excavation, grading or fill shall be permitted except for that which may be required for the construction of the bulkhead or riprap revetment.This permit shall not authorize any excavation waterward of the approved alignment. 0) Runoff from construction shall not increase the amount of suspended sediments in adjacent waters. Sedimentation and erosion control devices, measures, or structures shall be implemented to ensure that eroded materials do no enter adjacent wetlands,watercourses and property,e.g.silt fence,diversion swales or berms,sand fence,etc. (k) If one contiguous acre or more of property is to be excavated or filled, an erosion and sedimentation control plan shall be filed with and approved by the Division of Energy,Mineral, and Land Resources, or local government having and a delegated program prior to commencing the land-disturbing activity. (1) For the purposes of these Rules,the Atlantic Intracoastal Waterway(AIWW)is considered a natural shoreline. (m) Construction authorized by this general permit shall be limited to a maximum shoreline length of 500 feet. 48 Amended Eff.August 1,2014;July 1, 2009;April 1, 2003; Readopted Eff. (q) Piers and docking facilities shall not interfere with the access to any riparian property, and shall have a minimum setback of 15 feet between any part of the pier and docking facility and the adjacent property lines extended into the water at the points that they intersect the shoreline. The minimum setbacks provided in this Paragraph may be waived by the written agreement of the adjacent riparian owner(s),or when two adjoining riparian owners are co-applicants. Should the adjacent property be sold before construction of the pier commences, the applicant shall obtain a written agreement with the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to initiating any development of the pier or docking facility. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the property,then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. Application of this Rule may be aided by reference to the diagram in Paragraph(t)of this Rule illustrating the Rule as applied to various shoreline configurations.Copies of the diagram may be obtained from the Division of Coastal Management website at http://www.nccoastalmanagement.net.When shoreline configuration is such that a perpendicular alignment cannot be achieved, the pier or docking facility shall be aligned to meet the intent of this Rule to the maximum extent practicable. (r) Piers and docking facilities shall provide docking space for no more than two boats, as defined in 15A NCAC 07M .0602(a), except when stored on a platform that has already been accounted for within the shading impacts condition of this general permit.Boats stored on floating or fixed platforms shall not count as docking spaces. (s) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed pier or docking facility would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. (t) The diagram shown below illustrates various shoreline configurations: The Commission notes that there are some opinions of the State Bar which indicate that non-attorneys may not represent others at quasi-judicial proceedings such as this Third Party Hearing Request before the Commission. These opinions note that the practice of non-lawyer professionals, such as engineers, surveyors or contractors, representing others in quasi-judicial proceedings through written argument may be considered the practice of law.
