With reference to my 1:07 text on Tues, June 18, and my later text that evening at 9:57, my V
explanation for approaching an attorney overthe waiver request had nothingto do with our being
neighbors. Like you, I certainly hope we continue to remain good neighbors and ones who can and
will help each other whenever possible.
This morning, however, I learned my concern about NC's required notification/waiver
requested from adjacent riparian property owners prior to the construction of bulkheads, lifts,
docks, etc, etc, was not unfounded. Therefore, to protect me and my property, I cannot waive the

because I must protect the value of my property as explained below.
If our roles were reversed, I'd probably be asking the same thing. Like you, I'd know 458
Harbor View, other than trees growing on it, is an empty tot, one of two empty Lots between 456 and
cottage at 462.
I'd know the owner of the cottage at 462 also owns both empty lots, 460 and 458.
With these facts known, me, you, and anyone else getting ready to put in a new bulkhead
and boat dock/lift next door to 458s empty tot would assume that anything built into 456's 15'
setback would not be a problem for owner of that empty tot.
That assumption would be correct if it were not known that both empty tots at 460 and 458
wilt be marketed at some point by this aging senior or her estate. Considering my age, that sale
could come any time, and that is why protecting my property must take precedence
Everyone is different, but the majority like a view of some significance. Therefore, it was
pointed out having anything constructed within the property's 15'setback has the potential to
decrease significantly the value of any SO'lot adjacent to that property, particularly if what built
within the adjacent property's 15'setback is offensive or mars the viewshed of anyone interested in
purchasing the lot.
It also was pointed out that even though the owner requesting the 15'setback promises
never to put more than a dock, pier, and/or lift within the 15'setback, once the waiver is given, there
is absolutely nothing to stop him, or the next owner, from reneging on that promise and putting
more into that lot's 15'setback than anyone might imagine.
As a C.H. canal -front property owner yourself, thank you for understanding why it is
important I also protect the value of my C.H. canal -front property.
