This permit, issued on Mal 22,2023 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject civil or criminal penalties; or may cause the permit to be null and void.
Riverwalk and Kayak Launch Reconfiguration
1) This permit authorizes only the docks, piers, kayak launch and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes a maximum of three (3) formalized temporary boat slips.
This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered tlBraxton C. Davis, Director
hereunder requires further Division approval. Division of Coastal Management
All work must cease when the permit expires on This permit and its conditions are hereby accepted.

ADDITIONAL CONDITIONS
Upland Development -Access Sidewalk
3) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the concrete access
sidewalk, all as expressly and specifically set forth in the attached permit application and workplan
drawings.
Stormwater Management
4) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project may
require a Stormwater Management permit. The permittee shall receive a Stormwater Management
permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of
Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405. Any violation of the permit approved by DEMLR shall be considered a
violation of this CAMA permit.
Sedimentation and Erosion Control
5) An Erosion and Sedimentation Control Plan modification may be required for this project. If required,
this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity.
Submit this plan.to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
6) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This Minor Modification shall be attached to the original Permit No. 72-19, which was issued to the
permittee 9/3/19, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents must be readily available on site when Division personnel inspect the project for compliance.
10) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2016-01798.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 20190848.
NOTE: A minor modification application and renewal processing fee of$200 was received by DCM for
this project.

Davey Resource Group, on behalf of Town of Shallotte is requesting a minor modification to State Permit # 72-19.
State Permit#72-19 was originally issued to the Town of Shallotte on September 3,2019 for a seven(7)temporary-
slip docking facility,kayak launch,gazebos,riverwalk,and urban waterfront development including mix-use buildings,
a hotel, parking lot, and other associated infrastructure along the Shallotte River in Shallotte. State Permit# 72-19
expired on December 31, 2022; however,a permit renewal is included in this minor modification request.
The applicant is requesting a minor modification to State Permit#72-19 to make the community riverwalk more ADA
compliant. As proposed,the applicant would like to relocate the authorized kayak launch and associated floating dock,
install a sidewalk to provide ADA access to the relocated kayak launch, extend the southeast end of the riverwalk for
an ADA compliant gangway,and reduce the footprint of an authorized floating dock on the south end of the riverwalk.
According to the modification request, the applicant proposes to relocate and redesign the authorized kayak launch,
gangway, and associated floating dock. The authorized 15' x 5' kayak launch, 14' x 6' floating dock, and 96' x 5'
gangway has not been built(see plat 7 of 12 dated 5/3/19). The applicant has proposed to modify the design to include
a 20' x 6' kayak launch, 24'x 12' floating dock, and 34'x 5'ADA compliant gangway and relocate it landward of the
existing riverwalk to fit completely within the existing drop basin (see plat 3 of 4 dated 2/20/23).As proposed, a 135'
concrete sidewalk, varying in width from 8' to 13'would provide access from the existing parking lot to the drop-basin
kayak launch. The active Stormwater Permit SW8-191201 was issued on 12/1819.The applicant has also proposed a
6'x 4'extension onto the southeast end of the existing riverwalk to install a 20'x 5'ADA compliant gangway providing
access to a proposed 12'x 12'landing and an additional 48'x 8'section of floating dock. The previously authorized 50'
x 7'access pier,(2)35'x 5'gangways,70'x 6'floating dock,30'x 8'floating dock,and 72'x 6'floating dock would not
be built (see plat 7 of 12 dated 5/3/19). The proposed minor modification would reduce the shading impact of the
docking facility by 643 sq. ft.and reduce the total number of temporary slips from 7 to 3(see plat 4 of 4 dated 2/20/23).
According to the work plats submitted with the modification request, dated February 20, 2023, the proposed floating
docks would remain landward of the waterbody width and would not encroach into either riparian setback,

The agent has submitted a check (check No. 9500) in the amount of $200 for both this modification request and a
permit renewal request.As proposed,this office has no objection to the proposed project modification as long as there
are no objections from other the agencies to this proposal. It appears that the project continues to be CONSISTENT
with the use standards set forth in NCAC 07H .0208(b)(6),
By copy of this memo, DCM is requesting that USACE,NC DMF, and NC DWR provide any comment that your
agency may have on the proposed project to Cameron Luck of DCM's Morehead City office within 14 days of
receipt of this memo.

On behalf of the Town of Shallotte, I would like to request a CAMA Minor Modification and Permit
Renewal for CAMA permit no. 72-19, GP 291 associated with SAW-2016-01798 and the Water Quality
Certification associated with DWR Project No. DWR-2019-0848.
The Minor Modification requests the addition of a kayak launch and reconfiguration of permitted
platforms,gangways, access sidewalks, and a floating dock.The applicant proposes a kayak launch facility
located centrally on the lot in the historic travel lift basin. The kayak launch is proposed to measure 20 by
6 feet with a platform measuring 24 feet by 12 feet that is accessible by a gangway.An additional sidewalk
is proposed to connect to the existing sidewalk at the top of the basin which will measure 135 feet in
length with varying widths from 8 to 13 feet. On the southeast side of the site, a 6 by 4 foot extension of
the existing pier is proposed to provide access to a floating dock that measures 60 feet in length and 8
and 10 feet in width at various locations on the dock.There is no additional upland work proposed on the
property.
Original permitted figures, proposed modification figures, the signed agent authorization form, a $200
Minor Modification and Renewal Request fee check, and deed are enclosed. Adjacent Riparian
Notifications have been sent, and the certified mail receipts are included.
The entirety of the work permitted under the CAMA Major Permit was unable to be completed before the
expiration date. The permitted riverwalk, access walkways, parking, access roads, one pier, and two
gazebos were completed. The majority of the upland work remains to be completed. There has been no
change of plans since the issuance of the original permit, and the project is in compliance with all
conditions of the current permit.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shalt be applied and enforced throughout
the entire existence of the permitted structure
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard,through regulation or otherwise, on the authorized facilities. At a minimum,permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of seven (7) formalized temporary boat slips.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) Any portion of the permitted access pier, boardwalk,and docking facilities built over Coastal Wetlands
shall not exceed six(6) feet in width and shall be elevated a minimum of three(3) feet over the wetland
substrate as measured from the bottom of the decking.
9) The authorized gazebos shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
10) The roof of the gazebos shall not be designed for second story use.
11) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with
T15A:07N.0208 of the Rules of the Coastal Resources Commission,no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
12) In order to further protect the endangered West Indian Manatee,THchechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines,and strictly adhere to all requirements therein.

Urban Waterfront Development
13) Unless specifically altered herein,this permit authorizes the grading and other land disturbing activities

Stormwater Manasement
14) Prior to the initiation of any upland development activities the permittee shall apply for and obtain a
stormwater management plan permit The permittee shall receive a Stormwater Management Permit, and
provide a copy of this permit to DCM,prior to the initiation of any development activities authorized by
this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this
CAMA permit.

17) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
Easement
18) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management,prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
General
19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
20) This permit shall not be assigned, transferred,sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
21) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the UniitVRie public
interest.

22) No excavation or filling of any vegetated wetlands or open water is authorized by this permit.
NOTE: Installation of new water mains will require engineered plans and specifications to be submitted
to the Public Water Supply Section for review and approval before installation, and any existing
Public Water Supply Well on site will need to be abandoned. Please contact Public Water Supply
at 910-796-721 S.
NOTE: This permit does not convey any rights,either in real estate or material.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at(910)796-7215 prior to the commencement of any
such activity for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic
General Permit 291, Action ID No. SAW-2016-001798,which was issued on 08/26/19.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2019-0848.
NOTE: An application processing fee of$400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water

In accordance with the attached General Certification#4501 (GC 4501),the impacts described in your CAMA minor
modification and renewal request to the existing CAMA major permit do not require written authorization to utilize GC
4501. However,you are required to follow the conditions listed in the attached certification.
If the conditions of the attached general water quality certification cannot be met or the project scope changes so that
the thresholds listed are exceeded, additional review will be required by the Division of Water Resources and an
Individual Water Certification may be required. The approval does not alleviate the need to comply with any other
federal, state and local requirements before proceed with your project.
The Division of Water resources has assigned the project#20190848. Any future DWR correspondence should reference
this project number.

Dear Ms. Gaither:
Reference your application to renew and modify an RGP-291 Department of the Army
permit for the Shallotte Urban Waterfront facilities. The modification proposes to make the
community riverwalk more Americans With Disabilities Act(ADA)compliant. The proposal is
to relocate the authorized kayak launch and associated floating dock, install a sidewalk to
provide ADA access to the relocated kayak launch, extend the southeast end of the riverwalk for
an ADA compliant gangway, and reduce the footprint of an authorized floating dock on the south
end of the riverwalk. These facilities are and will be located along the Shallotte River at the end
of Cheers Street, Shallotte, Brunswick County,North Carolina.
The authorized 15 feet by 5 feet kayak launch, 14 feet by 6 feet floating dock, and 96 feet
by 5 feet gangway has not been built. The proposal is to modify the design to include a 20 feet
by 6 feet kayak launch, a 24 feet by 12 feet floating dock, and a 34 feet by 5 feet ADA compliant
gangway and relocate it landward of the existing riverwalk to fit completely within the existing
drop basin. The applicant has also proposed a 6 feet by 4 feet extension onto the southeast end of
the existing riverwalk to install a 20 feet by 5 feet ADA compliant gangway providing access to
a 12 feet by 12 feet landing and an additional 48 feet by 8 feet section of floating dock. The
previously authorized 50 feet by 7 feet access pier, (2)35 feet by 5 feet gangways, 70 feet by 6
feet floating dock, 30 feet by 8 feet floating dock, and 72 feet by 6 feet floating dock will not be
built. This modification will reduce the shading impact of the docking facility by 643 square feet
and reduce the total number of temporary slips from seven(7)to three (3).
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process,via Regional General Permit 291
(copy attached), for construction activities that receive authorization from the State of North
Carolina. Therefore,you may commence construction activity in strict accordance with the
applicable State authorization, attached Federal special conditions, RGP-291 conditions and the
approved plan. Failure to comply with the State authorization or conditions of the Federal permit
could result in civil and/or administrative penalties. This authorization expires December 31,
2026.

If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

1. All work authorized by this permit must be performed in strict compliance with the attached
plans,dated May 3,2019 and revised July 25,2019 and February 20,2023 and revised March 8,
2023,which are a part of this permit. Any modification to these plans must be approved by the
U.S. Army Corps of Engineers, Wilmington District(USACE) prior to implementation.
2. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, fill or mechanized land-clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
3.All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083,
Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
4. If the permittee discovers any previously unknown historic or archeological remains while
accomplishing the authorized work, he will immediately notify USACE who will initiate the
required coordination procedures.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project,and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will,without expense to the United States and in such time and
manner as the Secretary of the Army or his authorized representative may direct, restore the
water or wetland to its pre-project condition.
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section
10 of the Rivers and Harbors Act must be reported in writing to USACE within 24 hours of the
permittee's discovery of the violation.
8. In order to further protect the endangered West Indian Manatee, Trichechus manatus,the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly

On behalf of the Town of Shallotte, I would like to request a CAMA Minor Modification and Permit
Renewal for CAMA permit no. 72-19, GP 291 associated with SAW-2016-01798 and the Water Quality
Certification associated with DWR Project No. DWR-2019-0848.
The Minor Modification requests the addition of a kayak launch and reconfiguration of permitted
platforms,gangways,access sidewalks,and a floating dock.The applicant proposes a kayak launch facility
located centrally on the lot in the historic travel lift basin.The kayak launch is proposed to measure 20 by
6 feet with a platform measuring 24 feet by 12 feet that is accessible by a gangway.An additional sidewalk
is proposed to connect to the existing sidewalk at the top of the basin which will measure 135 feet in
length with varying widths from 8 to 13 feet. On the southeast side of the site, a 6 by 4 foot extension of
the existing pier is proposed to provide access to a floating dock that measures 60 feet in length and 8
and 10 feet in width at various locations on the dock.There is no additional upland work proposed on the
property.
Original permitted figures, proposed modification figures, the signed agent authorization form, a $200
Minor Modification and Renewal Request fee check, and deed are enclosed. Adjacent Riparian
Notifications have been sent,and the certified mail receipts are included.
The entirety of the work permitted under the CAMA Major Permit was unable to be completed before the
expiration date. The permitted riverwalk, access walkways, parking, access roads, one pier, and two
gazebos were completed. The majority of the upland work remains to be completed. There has been no
change of plans since the issuance of the original permit, and the project is in compliance with all
conditions of the current permit.
