This permit, issued on Mal 22,2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject civil or criminal penalties; or may cause the permit to be null and void. Riverwalk and Kayak Launch Reconfiguration 1) This permit authorizes only the docks, piers, kayak launch and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of three (3) formalized temporary boat slips. This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. Signature of Permittee f Town of Shallotte Permit No. 72-19 Page 2 of 2 ADDITIONAL CONDITIONS Upland Development -Access Sidewalk 3) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the concrete access sidewalk, all as expressly and specifically set forth in the attached permit application and workplan drawings. Stormwater Management 4) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project may require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 5) An Erosion and Sedimentation Control Plan modification may be required for this project. If required, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan.to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 6) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters 7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This Minor Modification shall be attached to the original Permit No. 72-19, which was issued to the permittee 9/3/19, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 10) All conditions and stipulations of the active permit remain in force unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2016-01798. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 20190848. State Permit#72-19 was originally issued to the Town of Shallotte on September 3,2019 for a seven(7)temporary- slip docking facility,kayak launch,gazebos,riverwalk,and urban waterfront development including mix-use buildings, a hotel, parking lot, and other associated infrastructure along the Shallotte River in Shallotte. State Permit# 72-19 expired on December 31, 2022; however,a permit renewal is included in this minor modification request. The applicant is requesting a minor modification to State Permit#72-19 to make the community riverwalk more ADA compliant. As proposed,the applicant would like to relocate the authorized kayak launch and associated floating dock, install a sidewalk to provide ADA access to the relocated kayak launch, extend the southeast end of the riverwalk for an ADA compliant gangway,and reduce the footprint of an authorized floating dock on the south end of the riverwalk. According to the modification request, the applicant proposes to relocate and redesign the authorized kayak launch, gangway, and associated floating dock. The authorized 15' x 5' kayak launch, 14' x 6' floating dock, and 96' x 5' gangway has not been built(see plat 7 of 12 dated 5/3/19). The applicant has proposed to modify the design to include a 20' x 6' kayak launch, 24'x 12' floating dock, and 34'x 5'ADA compliant gangway and relocate it landward of the existing riverwalk to fit completely within the existing drop basin (see plat 3 of 4 dated 2/20/23).As proposed, a 135' concrete sidewalk, varying in width from 8' to 13'would provide access from the existing parking lot to the drop-basin kayak launch. The active Stormwater Permit SW8-191201 was issued on 12/1819.The applicant has also proposed a 6'x 4'extension onto the southeast end of the existing riverwalk to install a 20'x 5'ADA compliant gangway providing access to a proposed 12'x 12'landing and an additional 48'x 8'section of floating dock. The previously authorized 50' x 7'access pier,(2)35'x 5'gangways,70'x 6'floating dock,30'x 8'floating dock,and 72'x 6'floating dock would not be built (see plat 7 of 12 dated 5/3/19). The proposed minor modification would reduce the shading impact of the docking facility by 643 sq. ft.and reduce the total number of temporary slips from 7 to 3(see plat 4 of 4 dated 2/20/23). The Minor Modification requests the addition of a kayak launch and reconfiguration of permitted platforms,gangways, access sidewalks, and a floating dock.The applicant proposes a kayak launch facility located centrally on the lot in the historic travel lift basin. The kayak launch is proposed to measure 20 by 6 feet with a platform measuring 24 feet by 12 feet that is accessible by a gangway.An additional sidewalk is proposed to connect to the existing sidewalk at the top of the basin which will measure 135 feet in length with varying widths from 8 to 13 feet. On the southeast side of the site, a 6 by 4 foot extension of the existing pier is proposed to provide access to a floating dock that measures 60 feet in length and 8 and 10 feet in width at various locations on the dock.There is no additional upland work proposed on the property. Original permitted figures, proposed modification figures, the signed agent authorization form, a $200 Minor Modification and Renewal Request fee check, and deed are enclosed. Adjacent Riparian Notifications have been sent, and the certified mail receipts are included. The entirety of the work permitted under the CAMA Major Permit was unable to be completed before the expiration date. The permitted riverwalk, access walkways, parking, access roads, one pier, and two gazebos were completed. The majority of the upland work remains to be completed. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shalt be applied and enforced throughout the entire existence of the permitted structure 4) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard,through regulation or otherwise, on the authorized facilities. At a minimum,permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of seven (7) formalized temporary boat slips. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) Any portion of the permitted access pier, boardwalk,and docking facilities built over Coastal Wetlands shall not exceed six(6) feet in width and shall be elevated a minimum of three(3) feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized gazebos shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 10) The roof of the gazebos shall not be designed for second story use. 11) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with T15A:07N.0208 of the Rules of the Coastal Resources Commission,no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 12) In order to further protect the endangered West Indian Manatee,THchechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines,and strictly adhere to all requirements therein. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Easement 18) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management,prior to the construction of any new boat slips or other docking facilities authorized under this permit. General 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 20) This permit shall not be assigned, transferred,sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the UniitVRie public interest. The applicant has also proposed a 6 feet by 4 feet extension onto the southeast end of the existing riverwalk to install a 20 feet by 5 feet ADA compliant gangway providing access to a 12 feet by 12 feet landing and an additional 48 feet by 8 feet section of floating dock. The previously authorized 50 feet by 7 feet access pier, (2)35 feet by 5 feet gangways, 70 feet by 6 feet floating dock, 30 feet by 8 feet floating dock, and 72 feet by 6 feet floating dock will not be built. This modification will reduce the shading impact of the docking facility by 643 square feet and reduce the total number of temporary slips from seven(7)to three (3).
