My clients at DCM had asked that I advise them in their determination of whether the applicant has submitted"a deed or other instrument under which they claim title"to be part of a complete permit application. In this case, the deed showing the Riehl ownership of 7719 8th Avenue is recorded at 5845/562 and describes this property as Lot 5, Seahaven Beach as shown on"Lot Recombination Section 8, Seahaven Beach"a map recorded at 43/237 (attached). That map shows lots with shaded areas labeled as being a private access easement. On Lot 5 specifically,there is a 10'access easement along the common line with Lot 319 along the south side of Lot 5. There is an un-shaded and un-labeled but delineated 10'strip along the southern 2/3 of the common line with Lot 4 along the west side (and a shaded 10'wide easement on Lot 4's side of that line)and beginning at a dashed line labeled "building line"there is a wider shaded are which extends to a line labeled"approximate mean high-water line". This area appears to be approximately 30'wide on Lot 5. Within this box there is a pier drawn and labeled 70'wood pier. I see there was a pier as shown on Google earth in 1993- 2003, but was just the walkway since 2006 (Bertha, Fran likely),with the remnants of the walkway disappearing over time. The shaded area does not encompass the portion of the old pier below the MHW line and based on just this plat map and without a possible document better describing the access easement, it appears not to be a riparian easement, and is just access TO the water and not a riparian easement with rights out INTO the riparian area (See Kings Harbor HOA v Goldman, 253 NC App 726, 2017). While I was unable to locate a document describing the easement in this current configuration other than 43/237, 1 did find that on an old map at 3/28,the streets(8th and 9th)extended to the waterline before Section 8 was platted or developed. I also found a document at 4696/351 which indicated that at least for 3rd 4th and 5th streets,the"road ends"in Section 8 were never constructed and were un-dedicated as being public streets (this document does NOT cover 8th or 9th). I suspect there may be a document memorializing the access easements as they are now shown on 43/237 and how those came to be instead of the earlier road-end configuration, and which may better describe the extent of the access easement more than the map at 43/237.You may wish to hire your own legal counsel to do a full title investigation and opinion and see if they find more information about how the easements changed from the road ends to what's shown on 43/237 or if there is a document which describes the easement more than 43/237. Mr. Riggs the surveyor may also have helpful information since he did both the 2002 plat as well as a 2006 plat of Lot 4. Based on this information, I'm advising my clients that the Riehls can proceed with a CAMA permit application based on their deed and Map 43/237, but need to submit a survey instead of the hand-drawn site plan in order to better show and understand Lot 5's shoreline and where the easement on Lot 5 is located relative to the proposed new dock. If the new dock is in the same footprint as the one shown on 43/237(or smaller)or is sited outside of the easement area, I think easement holders would have a difficult time arguing that the new pier interferes with their easement rights. Once they have a survey as part of their site plan, they can send that as part of the required notice to the adjacent riparian property owners. I've included Mr.Thomason on this email due to his objection and concerns about these easement rights. Me, DCM, the CRC and OAH lack jurisdiction to make determinations about property ownership and easement rights. This is my advice on whether they have shown enough ownership of the"site"to proceed with a CAMA permit application. Please let me know if you have any futher questions- Thanks!
