Dear Matthew Storey:
I have reviewed the information submitted to this office in your inquiry concerning the
necessary filing of an application for a minor development permit under the Coastal
Area Management Act. After making a site inspection on 5-3-2024, 1 have determined
that the activity you propose is exempt from needing a minor development permit as
long as it remains consistent with your site drawing and materials list submitted on 6-27-
2024, and meets the conditions specified below. If your plans should change and your
project will no longer meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR — [G.S. 113-103(5)(B)(5) and 15A NCAC 7K.0103(a)] -
Maintenance and repairs (excluding replacement) necessary to repair damage to
structures caused by the elements are specifically excluded from the definition of
development under the conditions and in the circumstances set out in G.S.
113A-103(5)(b)(5). Individuals required to take such measures within an AEC shall
contact the local CAMA representative for consultation and advice before beginning
work.
Structures may be repaired in a similar manner, size and location as the original
structure. No expansions or additions are permissible. The repairs are limited to 50%
of the market value of the existing structure and the following specific conditions.
1) The project consists of the pumping existing septic tank with new Drain field as
needed, as shown on the attached drawing and materials list at cost of $6,558
Which is only 2% of current tax value which is at $383,400 which is under the
50%.
2) The proposed repairs shall be consistent with all other applicable local
ordinances and North Carolina Building Code standards.

3) In order to minimize adverse impacts to nesting sea turtles, the following

4) Sea turtle sightings: If any nesting turtles are sighted on the beach during
construction, construction activities must cease immediately until the turtle has returned
to the water, and the sea turtle permit holder has marked for avoidance any nest(s) that
may have been laid.
5) No Relief from Take Provisions of Endangered Species Act Section 9 (ESA):
This permit does not provide relief from liability under provisions of the ESA.
Pursuant to Section 9 of the ESA, it is unlawful for any person to take any listed
endangered species within the United States or the territorial sea of the United
States. The term "take" means to harass, harm, pursue, hunt, shoot, wound, kill,
trap, capture, or collect, or to attempt to engage in any such conduct.
6) Reporting Requirement: If a sea turtle nest is uncovered or a dead, injured, or
sick individual of an endangered or threatened species is discovered, initial
notification must be made to the Service's Law Enforcement Office below. Additional
notification must be made to the Raleigh Ecological Services Field Office identified
above and to the NCWRC at (252) 241-7367. Care should be taken in handling sick
or injured individuals and in the preservation of specimens in the best possible state
for later analysis of cause of death or injury.

obtaining any other State, Federal or Local authorization and N.C. Building Permits.

from a government entity at anytime, Authorized Owner(s) shall be responsible for acquiring approval
and any/all fees associated,
• If the Authorized Owner(s) does not acquire the applicable permit for the above job project, the
Company shall have the right to retain said deposit and apply towards Company time associated with
scheduling, assisting homeowner(s), phone calls, texts and/or any other time spent on Authorized
Owner(s) project,
• Authorized Owner(s) shall provide any/all information and/or plans to the Company that they may
have or know that relates to hidden underground private utilities (gas lines, septic lines, electrical lines,
sprinkler lines, plumbing lines, propane tanks, etc.) before any/all excavation begins on said property.
In the event the Authorized Owner(s) knew about said underground items and did not disclose to the
Company and/or damage has occurred as of the result of this non -disclosure, Authorized Owner(s)
shall be held liable for any/and all labor, material and/or damage to said Company's machinery and/or
personnel. Authorized Owner(s) shall indemnify the Company against any/all liability that may arise
from non -disclosure of this said action that may occur and/or the Company) shall not be held liable for
future liability that may have resulted from this incident,
• The Company has no control of the weather- or weather -related conditions that may/may not affect
the Job Description completion,
• Authorized Owner(s) understands(s) that working on said property, (parking, unloading, driving or
storing large machinery on the above said property) may/may not do some damage to driveway(s),
sidewalk(s), grass and/or create other property conditions that were not initially present. Authorized
owner(s) agree to not hold the Company liable for any/all damage and/or replacement and/or repair
of damaged property elements, that may have been a result of the Company utilizing any of its
machinery while working on user(s) property in any such capacity. It shall not be the Company's
responsibility to restore the property to initial condition (Unless otherwise specified in writing by all
parties). Authorized Owner(s) shall indemnify and/or relieve the Company of any/all liability in
relation to possible damage from working on said property on Authorized Owner(s) property,
• If the Company comes across unexpected obstacles such as large trees, roots, stones, shale, excess
water/liquid and/or other said matter and/or structures that impedes and/or delays the job
description on the Authorized User(s) project, the Company shall have the right to add labor/materials
and/or other expenses that may apply to this unforeseen delay on top of the initial `Total Company
Fee"
• Once the Company leaves the said premise and/or completes the job on the above said property,
Authorized Owner(s) shall release the Company of any/all liability from any/all changes that weather
or any other unknown circumstance where property conditions may have changed the area(s) of
property in any such way where the Company completed the above job description.
• Authorized Owner(s) agrees to indemnify and or pay for any/all reasonable legal fees that may result
in any/all legal lawsuit against the Company on the above said property by owners.

• Payment in full is required immediately after the job completion. If that action does not take place in
that time, payment shall be made within 24 hrs. of job completion.
If this proposal is acceptable, please signify your acceptance of the terms with your signature below. The terms and
conditions of this proposal shall be binding if executed and returned within 30 days of the above date. It is agreed that
all invoices will be paid within 30 days. Any invoices not paid within 30 days shall be considered past due and subject
to o finance charge of 1.5%per month (18%annum), or the maximum rate permitted by applicable state law,
whichever is lesser. The undersign agrees to compensate Atlantic OBX Inc for all attorney fees incurred in collecting all
amounts due, whether or not a lawsuit is filed.
