Dear Mr. & Mrs. Hewitt:
I have reviewed the information submitted to this office concerning the filing of an application for a minor development permit under
the Coastal Area Management Act. After making a site Inspection on 3115/24, 1 have determined that the activity you propose is
exempt from needing a minor development permlt as long as it meets the conditions specified below. If your plans should change
and your project will no longer meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR - [1 SA NCAC 7K .0103(c)]: Redistribution of sand that results from storm overwash or aeolian
transport around buildings, pools, roads, parking areas and associated structures is considered maintenance so long as the sand
remains within the Ocean Hazard AEC.
1. This exemption allows for relocated sand to be used in the repair of storm damaged dunes;
2. Existing primary and frontal dunes shall not be broadened or extended in an oceanward
direction beyond pre -storm dimensions;
3. Redistribution of sand shall be accomplished in such a manner that damage to existing
vegetation is minimized;
4. Accumulated sand containing storm debris shall be sifted or have all debris removed prior to
redistribution within an Area of Environmental Concern;
5. Construction/mechanical sand movement is limited to Monday through Friday,
between 8:30am and 5:00pm, no work conducted between May 1 through November 15
6. Any disturbance of the dune face is to be minimized to only that which is necessary to
remove sand accumulated immediately adjacent to the house and/or decking.
7. Excavation for sand relocation shall avoid all established dune vegetation except for
that necessary to create a construction access over the dune, and the access path
shall be immediately restored to its pre -project profile and revegetated following sand
relocation activities using similar plant species and density as were present prior to
the disturbance
8. Sand shall not be placed within 30 feet of the normal water line, sand placed on the
beach must be graded/feathered out to blend into existing topography on the beach
9. Sand to be moved seaward of the dune must be sifted or clean and free of any gravel,
debris, or foreign matter.
10. Excavation is limited to 4 feet waterward of the eastern edge of the deck, as discussed
on site visit
If your plans should change and your project will no longer meet these conditions, please contact me
before proceeding. This exemption to CAMA permit requirements does not alleviate the necessity of your
obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date
