Issued to Joseph & Letitia Morabito, authorizing development in the Estuarine Shoreline (AEC) at 3512 Bay Drive, in Kitty Hawk, NC, as requested in the permittee's application, dated July 2, 2024, and received Complete on July 5, 024. This permit, issued on JIII,y 22 2024 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construct retaining wall in AEC as denoted on site plan All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on July 5, 2024. [GS 113A-1201 All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations, [GS 113A-120) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. [GS 113A-1201 A copy of this permit shall be posted or available on site. Contact this office at 252-261-3552 for a final inspection at completion of work. [GS 113A-1201 Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party, [GS 113A-120] (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval, All work must cease when this permit expires on: DECEMBER 31, 2027 In issuing this permit it is agreed that this project is.consistent with the local land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. Check #74745, in the amount of $100, was received on July 5 for the permit fee. [07H ,0209(d)(2)) All development shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: [07H .0209(d)(3)) Any proposed for grading within the 30' buffer from the normal high water must be contoured to prevent additional stormwater runoff to the adjacent Estuarine and Public Trust Waters. This area shall be immediately vegetatively stabilized and must remain in a vegetated state. 107H .0209(d)(3)] All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a bamier line of Otter loth must be installed between the land disturbing activity and the adjacent marsh or water areas, unfit such time as the area has been property stabilized with a vegetative cover. [07H .0209(d)(3)] All development shall provide for a buffer zone along the margin of the Estuarine Water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. [07H .0209(d)(3)(A)] All graded and filled slopes shall be of a sufficient angle to retain a vegetative cover or other erosion control device or structure. 107H .0209(dH3)(8)) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all new development/construction shall be located a distance of 30 feel landward of the normal high water or (MHW). No portion of the roof overhang shall encroach into the 30 ft. buffer. Mr. Zafiris, please find the attached objection response letter, as well as a copy of the CAMA permit, and site plan. Please note that at this property, the CAMA 30' buffer and 75' AEC is not measured from the existing retaining wall on site, as the normal high watermark is further west than the wall. The normal high water mark is what is used for the measurement. As shown on the site plan, the 75' tine intersects the pool and pool deck. The water surface is not counted as coverage, so the only impervious coverage within 75' is that portion of the concrete pool deck, totalling 261 sq. ft., or 8.6% of the AEC. Town zoning standards allow pools to be as close as 5 feet to the side and rear property lines. The permit is a separate permit from that issued for construction of the house. The project authorized by this permit allows construction of retaining wall. The proposed project has been determined to comply with local regulations and the Rules of the Coastal Resources Commission071-1.0209(d)(2). As such, a permit has been issued to authorize the development. I have enclosed a copy of the permit for reference. However, I noted that Mr. Zafiris sent a copy of the application (see attached) when he sent his email on 7/19/24 to you, Marc Murray, and me noting his opposition to the proposal. Please let us know if the attached application is the complete application that you have on file or if there were further documents submitted. We want to make sure we have the complete file in case of a third party appeal. Also, we wanted to make you aware that when measuring the lines for the Area of Environmental Concern for Minor Permits, we use Normal Water Level (NWL), not normal high or MHW. It was noted by staff that you referenced normal high water or (MHW) in Permit #10-24 KH. You also referenced the normal high water mark in your email to Mr. Zafiris. The measurement is from the NWL, which is shown on the site plan. Thank you for confirming to Mr. Zafiris that the water surface of the pre -approved swimming pool through Minor Permit #10-23 KH is not counted toward coverage, as well as the Town zoning standards for setbacks. For your reference, please note that the next time a property owner submits a site plan for additional development after they've received an initial permit, they need to make sure the only thing that is labeled 'proposed' is the new request (i.e. Morabito's site plan should have been updated to show that only the fence was proposed, and the pool, dwelling, concrete [etc.]) should have been relabeled as 'permitted').
