This permit authorizes the installation of a 5'x6'5" exterior elevator shaft on existing impervious surface (driveway). (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) by Sadler Survey, PLLC dated 04/19/24, and revised/received on 07/17/24, by Morgan Flaherty received on 07/17/24, and by Cahoon+Kasten dated 07/02/24 and received on 07/17/24. [GS 113A-120] (2) All construction must conform to the N.C. In the meantime, the property owner has reached out to Mr. Woody so I wanted to respond to you. The side set back for the Town is 8 feet, which according to my math does not work for their 5 foot wide elevator. The ordinance does allow me to authorize certain things to encroach into the setback (see below) but an elevator is not included in the definition. Their proposal is close but doesn't allow 8 feet. Only after that permit decision is made can the applicant(s) petition for a hearing/Variance. However, before the permit decision is made the drawings/application have to be updated (to scale, all data in application has to match the site plans, etc.). Also, if the development did not meet Town zoning, you would have to get a Variance from them first. 1 Relocation of elevator for placement in an existing impervious area: Yes, you would still be required to update the plans/application and obtain a minor permit, as this is an Exception to the rule, not an Exemption. However, in my professional opinion, this is the best option. If you were to choose option 2, locate the elevator shaft to an existing impervious area, and update your application/drawings, we should be able to issue the minor under the Exception under (10) (H) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high water level, with the exception of the following: Development over existing impervious surfaces, provided that the existing impervious surface is not increased; The survey shows a 12.8' measurement from the edge of the single-family residence to the property line. This proposed elevator shaft is within 75' of the wetlands area, you have confirmed that a CAMA minor permit will be required and you have also provided to me the needed minor permit application paperwork. 3 Regarding the land survey to be completed by Mike Sadler, Sadler Surveying are there any other additional CAMA requirements that needs to be identified within this land survey?
