HomeMy WebLinkAbout127-23 St. Regis HOA (2) Town of North Topsail each 127-23 Issued by DCM Permit Number CAMA MINOR DEVELOPMENT i ` PERMIT as authorized by the State of North Carolina, Department of Environmental Quality and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-11B of the General Statutes, "Coastal Area Management" Issued to St. Regis Homeowner's Association c/o Shelby Contracting authorizing development in the Ocean Hazard AEC at 2000 New River Inlet Road, in North Topsail Beach, Onslow County, as requested in the permittee's application, dated November 30, 2023, and received by DCM as complete on January 25, 2024. This permit, issued on January 26, 2024, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Raised pool equipment room outside of the natatorium rotunda. (1) All proposed development and associated construction must be done in accordance with the site plan drawings(s) drafted by Richard Lamber, PE with mapping dated 11/30/2023, Charles F. Riggs&Associates, Inc.dated 11127/2023, and layout by Mosley Design Group dated 10/20/2023 . [GS 113A-120] (2) All development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100-year storm. Any building constructed within the Ocean Hazard Area shall comply with relevant sections of the North Carolina Building Code including the Coastal and Flood Plain Construction Standards and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provision of the building code or a flood damage prevention ordinance is inconsistent with any of the following AEC standards,the more restrictive provision shall control. [07H .0308(d)(1)] (3) All buildings in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or eight inches to a side if square.All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. For those structures so located on or seaward of the primary dune,the pilings shall extend to five feet below mean sea level. [07H .0308(d)(2)and (3)] (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty(20)days of the issuing date. From the date of an appeal,any work conducted under this permit must cease until the appeal is resolved.This permit must be on the project site and accessible to the permit officer when the project is Jonathan Lucas inspected for compliance. Any maintenance work or project modification not NC Division of Coastal Management covered under this permit,require further written permit approval.All work must 400 Commerce Ave cease when this permit expires on: Morehead City, NC 28557 DECEMBER 31, 2027 In issuing this permit it is agreed that this project is consistent with the local Land }+y Use Plan and all applicable ordinances. ?his permit may not be transferred to another party without the written approval of the Division of Coastal Management. PERMITTEE or Authorized Agent (Signature required if conditions above apply to permit) Name: St. Regis Minor Permit#127-23 Date: January 26, 2024 Page 2 (4) The pool equipment room construction shall occur landward of the 60' setback distance from the first line of stable natural vegetation as indicated on the site plan drawing. [07H 0306(a)(1)and (3)] (5) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. [GS 113A-120] (6) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure shall be relocated or dismantled within eight years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within eight years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened,then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed pursuant to 15A NCAC 07H .0308(a)(2). [07H .0306(g)] i (7) Any change or changes in the plans for development,construction,andlor land use activities will require re-evaluation and modification of this permit.[07J .0405] (8) A copy of this permit shall be posted or available on site. Contact this office at 252-515-5420 for a final inspection at completion of work. [GS 113A-1201. (9) This permit may not be assigned,transferred, sold.or otherwise disposed of to a third party. [07J .0406(b)] (10)The Permittee and/or the Permittee's Authorized Agent shall be responsible for obtaining any and all necessary authorizations,approvals, or zoning and building permits from the local government having jurisdiction(Town of North Topsail Beach and/or Onslow County) prior to commencing work.
