Issued to Keith Hardwick and co -applicant, Peter Pinto, authorizing development in the Estuarine Shoreline
(AEC) at 120 Osprey Ridge Road, Lot 10, Osprey Ridge Subdivision in the Town of Duck, Dare County, as
requested in the permittee's application, dated and received complete August 7, 2024. This permit, issued on
August 9, 2024, is subject to compliance with the application and site drawing, all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: installation of two (2) upland retaining walls, to include minor grading between
116 and 120 Osprev Ridge Road to match existing grades and stabilize with river cobble.
1. All proposed development and associated construction must be done in accordance with the proposed
permitted work plat/site plan prepared by Quible & Associates and last revised 6/25/2024. [GS 113A-120]
2. Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit. JIGS 113A-120]
3. A copy of this permit shall be posted or available on site. Contact this office at 252-255-1234 for a final
inspection at completion of work. [GS 113A-120]
4. No additional impervious surface coverage within 75 feet of Normal Water Level, Estuarine Shoreline Area of
Environmental Concern is proposed or authorized by this permit. [07H .0209(d)(2)]

This permit action may be appealed by the permit ee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on: December 31, 2027
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.
Check #8361 in the amount of $100, was received on August 7, 2024 for the
permit fee.

5. Prior to any development, silt fence shall be properly installed between all planned land disturbance and
the adjacent marsh and open water areas; the silt fence shall be properly maintained throughout the
construction period, and until such time as the area has been properly stabilized with a vegetative cover.
Silt fence shall be installed such that it is properly toed -in to the soil. _ (initial). [07H

6. Any proposed grading within the 30' buffer from the Normal Water Level must be contoured to prevent
additional stotmwater runoff to the adjacent marsh. This area shall be immediately vegetatively
stabilized, and must remain in a vegetated state. [07H .0209(d)(3)]
7. All disturbed areas located within the Estuarine Shoreline Area of Environmental Concern shall be
vegetatively stabilized within 14 days of construction completion. [GS 113A-1201
8. This permit does not authorize development within any wetlands or open water areas. [GS 113A-1201
and (07H .0205(d)]
9. Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or
otherwise disposed of to a third -party. [GS 113A-120]
10. This CAMA permit does not alleviate the necessity of obtaining any other State Federal or Local
Authorization prior to the start of development activities associated with this permit. [GS 113A-1201

Please see attached plan for the Hardwick Property that includes an approximately 80 linear ft. retaining
wall for slope stabilization. Up to 3 ft of the retaining wall will extend onto the Peter J. Pinto property, and
therefore, Mr. Pinto is a co -applicant to the Hardwick's, and you are an adjacent property owner to the
work. Mr. Hardwick has already received a CAMA Permit for boat lifts and the in -water shoreline
protection work shown on this plan, and Mr. Pinto was not a co -applicant for that.
Please see attached standard CAMA notification form and plan. If you have no objection, it would help us
expedite the permitting process if you would check the "I have no objection..." line and sign/date at the
