Today I received an ARPO Notification/Waiver Form. Please see
attached.
In short, I do have strong objections to the proposed Kayak
Launch.
This is undoubtedly intended to replace a similar structure that
was destroyed during Hurricane Florence. That structure came
loose from its moorings and made its way down the shoreline
until it collided with my dock destroying it .
After the storm, Town employees toured the Park and acknowledged
that it was their launch that was still fouled in the remains of
my dock.
I rebuilt my dock with out-of-pocket funds without so much as a
"We' re Sorry", from the Town, let alone an offer to assist in
rebuilding costs. Total costs amounted to between $16, 000 . 00
and $20, 000 . 00.
I am objecting to this proposal in the strongest possible way in
hopes to preclude having to pay rebuilding costs out of my own
funds again.

Dear Mr. Batten:
This letter is in response to your adjacent riparian property owners statement received by DCM
on 6/6/2024 regarding your concerns about the proposal by the Town of Emerald Isle c/o EZ
Dock Solutions to construct a kayak launch within Bogue Sound at 9404 Coast Guard Road in
Emerald Isle, Carteret County. The proposed project has been determined to comply with the
Rules of the Coastal Resources Commission (07H .1200), and as such, a permit has been issued
to authorize the development. I have enclosed a copy of the permit, as well as the relevant
statutes.
If you wish to contest our decision to issue this permit,you may file a request for a Third-
Party Hearing.The request for a hearing will be considered by the Chair of the Coastal
Resources Commission. The hearing request must be filed with the Director, Division of
Coastal Management, in writing and must be received within twenty (20) days after the
disputed permit decision is made. I have enclosed the applicable forms and instructions
