Re: Objection to the Issuance of CAMA General Permit No. 89094A for a Development
Project at 3302 Bay Drive, Kill Devil Hills, Dare County
Dear Ms. Wilson:
This letter is in response to your objection as an adjacent riparian property owner to a
permit request from Catherine Radzikowski's platform project proposed at 3302 Bay
Drive in Kill Devil Hills. Yvonne Carver, Field Representative of the Division of Coastal
Management (DCM) staff, conducted an on -site inspection to evaluate the permit
applicant's request.
The permit applicant requested a permit to install a new platform with a lower platform
at the aforementioned property that is adjacent Kitty Hawk Bay. Under the Coastal
Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established a Rule for General Permits for this type of development, which is found in
15A NCAC 07H.1200 (copy attached).
You have notified the Division of Coastal Management of your objections to this
proposed development by written correspondence related to the adjacent riparian
property owner notification form, as well as a letter received by our office on April 18,
2024. In your letter you had concerns about the upper platform being used as a
second story, the structure's size, and a reference to commercial use.
The Division has reviewed your objections, along with all aspects of this development
proposal for consistency with the aforementioned Rules, which describe the CRC's
standards and guidelines for this type of development. Our review of the proposed
development has found it to be consistent with these Rules. The proposed platforms
meet the conditions related to the total square footage of shaded impact per linear foot
of shoreline, the upper platform will be no higher than the connecting pier and
therefore no second story use is proposed, and the property is zoned residential and
therefore the docking facility is for private use.

I am the owner of the adjacent riparian property referenced above. My
property address is 3300 Bay Drive, Kill Devil Hills, NC. I do have
objections to the proposed addition outlined in letter dated March 21, 2024,
from Lorelei Barrett, Emanuelson & Dad, received Monday, April 8, 2024.
The elevated platform will detract from my view and, given the strong winds
off Kitty Hawk Bay, will create potential damage to my property. It is my
understanding that the upper level cannot be used as a second story.
Furthermore the structure is entirely too large and too close to my property
line. The steps attached to their pier recently broke off and washed up on
the access beach next to my property. The homeowner then dragged them
across my yard. Their pier is already extremely long and, in my opinion,
further construction will damage the ecosystem and create a marine hazard.
The Kadzidowskies rent the property through Airbnb so it is used for
commercial purposes. As they are rarely there, they have no control over its
use by others, and the potential for environmental and property destruction
endangers my property.
Pursuant to instructions, I am responding within the ten (10) day notice
period that I object to the proposed construction. I have signed the Form
noting my objections and mailed it to Emanuelson & Dad, together with a
copy of this letter.

Dear Ms, Wilson:
This letter is in response to your objection as an adjacent riparian property owner to a permit request from
Emanuelson & Dad, LLC on behalf of Phillip & Catherine Radzikowski, for the construction of a docking facility
consisting of a 277'x5' pier, 9'x9' platform, and a 12'xi Z wet slip created by the placement of 4 tie piles. This project
is located at 3302 Bay Drive, Kill Devil Hills in Dare County and within Kitty Hawk Bay.
Under the Coastal Area Management Act (LAMA), the Coastal Resources Commission (CRC) has established
Rules for General Permits for this type of development that are found in 15A NCAC 07H.1200.
The Division of Coastal Management has reviewed your objections, along with all aspects of this development
proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for
this type of development. Our review of the proposed development has found it to be consistent with the Rules of
the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore,
the Division of Coastal Management issued General Permit #86400A on June 13, 2022 (copy attached) for the
proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the Director of the
Division of Coastal Management within 20 days of the permit issuance date. If you choose to pursue an appeal,
please contact this office so that we can provide you with the appropriate forms and addresses.

I write regarding a certified letter, received May 21,2022,
from Lorelei Zumbrunnen of Emanuelson & Dad with attached
Adjacent Riparian Property Owner Notification/Waiver Form,
pertaining to the above -referenced project. Attached to the form
is a sketch/photocopy of the proposed pier that is so dark I
cannot read it. As the owner of 3300 Bay Drive, I object to the
proposed pier and would appreciate discussing it with you in
detail. I have called your office and left messages but to date
have not received a call back.
