This permit, issued on Jnnp 30, 2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the construction of the new boatlift located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Merriman, III Permit#86-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes a maximum of 3 boat slips. NOTE: Due to the proximity of the AIWW, boats utilizing the docking facility may be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. William W. PROJECT DESCRIPTION: The project site is located at 5624 Captains Lane, adjacent to the Atlantic Intracoastal Waterway (AA M), between Masonboro Loop Road and Masonboro Sound, in Wilmington, New Hanover County. The lot is approximately five (5) acres with 200 ft. of shoreline frontage. The lot averages 10- 12 feet above mean sea level and the shoreline is stabilized by a bulkhead. The applicant maintains a single-family residence on property and vegetation consists of lawn grasses and landscape shrubs. There is an existing private pier(80' long and 6'wide) on the property which terminates in a L-head platform (16'wide X 20' long). There is an existing floating dock(6' x 16') located on the east side of the L-head, that is in alignment with the pier. The pier and floating dock currently provide docking space for two (2) vessels. The existing pier is within the established Wrightsville Beach Pierhead Line. The Wrightsville Beach Land Use Plan classifies the waters of Masonboro Sound as Conservation, and the adjacent highground in the project area as Resource Protection . The waters in the project area are classified as SA-ORW by the N.C. Division of Water Quality. They are designated as a Primary Nursery Area(PNA) by the N.C. Division of Marine Fisheries, and they are open to the harvest of shellfish. The applicant proposes to construct an addition to his private pier. The addition would consists of a 6' wide by 16' long boatlift located on the south side of the existing platform (L-head). The addition of the boatlift would provide dockage/storage space for up to three (3) vessels. The proposed boatlift will be located approximately seventy-five (75) feet north of the southern riparian corridor abutting Lutheran Church Retirement and will be approximately one hundred-fifty(150) feet south of the northern riparian line adjoining the Sue Mako property. 10. ANTICIPATED IMPACTS The proposed boatlift would create an additional 96 square feet of partially covered open waters. The total incorporation of estuarine waters and public trust area associated with the proposed boatlift would be 96 square feet. Merriman 5/23/03 The proposed boatlift does not exceed the CAMA regulatory allowance for boatlift square footage for a lot this size. Box 36 1700 Salter Path Road Indian Beach, NC 28575 Engineer: Stroud Engineering, P.A. 151-A Hwy 24 Morehead City,NC 28557 (252) 247-7479 The Ocean Club—Soundside- is proposing to provide residential condominiums with amenities including eight side-to boat slips, kayak launching ramp, two pools and tennis courts to accommodate the needs of the community. The tract is 23.04 acres and is owned by The Ocean Club, LLC This project is located north of Highway 58, fronts Bogue Sound and lies between the Salter Path Family Campground and undeveloped tract owned by Lillian Taylor. The proposed upland development consists of 108 condominiums (9 three-story buildings with 4 units per floor), two pool areas (70' x 80' and 60' x 70'), tennis courts (120' x 120'), two spa buildings (130' x 75') and a 24'-wide crowned road system with associated parking. The total impervious coverage for the proposed project is approximately 248,347af or 24.74% of the entire tract. This tract's location is within an ORW classification of Bogue Sound, limiting built-upon area to 25% within 575 feet of mean high water. The area within the 575' AEC is 637,808 square feet with approximately 158,262sf of impervious area or 24.81%. An eight-foot wide main dock will extend approximately 390' from the upland area with a 42' x 8' platform on each side of the dock. A six-foot wide finger pier then extends 112' from then end of each platform accommodating a total of eight, 15'x 30' side-to wet slips. A 40'x 20' covered structure is also proposed, which will be located on the main dock. The last fifty feet of the dock is proposed as a kayak launching ramp. The need for the eight foot dock width is due to the population of the community, travel length and safety in transporting kayaks to the launching ramp. This project was originally proposed as a twenty-nine slip marina, however during the review of the Environmental Assessment, the Division of Water Quality commented that their regulations allow no more than nine slips within the ORW. The site plan has been modified, decreasing the number of slips to eight. This addition will provide dockage for up to three (3) boats. The project site is located at 5624 Captains Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW) between Masonboro Loop Road and Masonboro Sound in the unincorporated portion of New Hanover County. According to the Division's Field Investigation Report, the Public Trust Area and Estuarine Waters Areas of Environmental Concern (AEC) will be impacted. Waters at the site are classified SA-ORW, open to shellfishing, and designated as Primary Nursery Area (PNA). This development proposal has been reviewed for consistency with the Wilmington — New Hanover County CAMA Land Use Plan (LUP) Update and Comprehensive Plan (1997-2010), as amended. The land classifications for this site are Conservation (AECs) and Resource Protection (upland portion of the site). The purpose of the Conservation classification is to provide for effective long-term management and protection of significant, limited or irreplaceable natural resources while also protecting the rights of the property owner. Water-dependent uses, including (but not limited to) docks, are allowed within this classification. The purpose of the Resource Protection classification is to provide for preservation and protection of important natural, historic, scenic, wildlife and recreational resources. This land classification includes lands adjacent to estuarine waters which are classified SA by the NCDENR. LUP Policy 4.9 states, allow uses of estuarine and public trust waters that provide benefits to the public and satisfy the riparian access needs of property owners. In tidal waters, docks shall be limited to the minimum necessary to provide riparian access to waterfront property owners. Merriman, III Boat Lift Dear Mr. Merriman: New Hanover County The Wilmington Regional Office received a copy of the CAMA Major Permit Application to construct a boat lift on March 31, 2003. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction.
