Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee NC Seafood Industrial Park Authority Permit#29-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 4) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes a maximum of five boat slips. NOTE: Any proposal to add six or more additional boat slips to the authorized 5 slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: The boardwalk shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor on the west side of the property, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. General 8) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the State of North Carolina on account of any such removal or alteration. Division of Water Quality has assigned the proposed project DWQ Project No.030063. PROJECT SUMMARY: The applicant proposes to construct a travel lift facility and 3 boat rigging slips. NC Seafood Industrial Park Authority (Bayliss Boatworks) Field Investigation Report Page Two Project Setting The North Carolina Seafood Industrial Park is located on 54 acres adjacent to a manmade basin adjoining Mill (Landing) Creek off Roanoke Sound and at the end of Harbor Road (SR 1140) in Wanchese, Dare County: The Park is proposing further development of Lot 30 which has an area of 59,858 sq. ft. and a basin shoreline of 120 feet that is stabilized by a concrete bulkhead and riprap. The top of the bulkhead is approximately seven feet above normal water level (NWL). Existing development on the tract consists of a 7,465 sq. ft. metal building and parking areas. The majority of the lot area is covered with marl with very little vegetation existing at the site. The lot was once part of the NCDOT ferry repair facility which included a marine railway and a transfer table. The old infrastructure for the repair facility has been removed except for paved areas. Currently a charter boat construction business is the tenant. Lot elevation is approximately eight feet above NWL. The waters of Mill Creek are classified as SC by the Division of Environmental Management and are closed to shellfish taking. The water depth in the basin in this area is approximately -12 ft. Development Proposal In order to provide water access for a marine travel lift so that the tenant can float the boats he constructs and rig and service those boats, the applicant proposes to construct two seven ft. wide and 87 ft. long parallel travel lift piers, to be constructed perpendicular to the shoreline and located on the east end of the lot shoreline. The distance between the piers will be approximately 24 ft. The applicant proposes to construct a 10 ft. wide and approximately 82 ft. long parallel to the shoreline dock. The proposed dock will be approximately three ft. below the existing bulkhead cap and will provide better access to proposed moorings. Six mooring pilings are proposed to create three 20 ft. wide and 70 ft. long mooring slips. A six ft. wide and 68 ft. long floating dock is proposed to be constructed 15 ft. off the western property line. The floating dock will serve as one side of one mooring. Two 20 sq. ft. work platforms are proposed for the other two slips. An i ipated Impacts The proposed project will result in approximately 2,491 sq. ft. of Public Trust Area and Estuarine Waters being shaded. The entire project will be constructed of wood secured by pilings, except for the travel lift slip that will be supported by both wood and concrete pilings. The travel lift slip will extend 87 feet from shore. The wooden dock area will stretch 10 feet from shore. The floating dock will extend a total of 78 feet from shore.
