Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This minor modification authorizes the enlargement of the previously authorized 8' x 20' floating dock. The new floating dock dimensions shall not exceed 8'x 60', as depicted in the attached workplan drawing. 2) This permit authorizes a maximum of 3 boat slips at the authorized floating dock. At no time shall more than 3 vessels be moored or docked at the floating dock. Additionally, in order to ensure that a closure of open shellfish waters does not occur, the combined number of slips originated from the Maritime Place Subdivision shall not exceed 10. These restrictions on the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 3) In order to ensure compliance with Condition No. 2 of this minor modification, no vessels may be moored, even temporarily, on the landward side of the authorized docking facility. — (See attached sheet For Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Permit No. 166-03 was issued to Stuart Cooke on November IS, 2003, through the Express Permit Program. The Permit,authorized maintenance excavation of an existing boat basin and access chancel, and the construction of a community pier, The permit will expire on December 31, 2006. The community dock was authorized as a 6 feet wide by 375 feet long pier extending from between Lot 9 and Lot 14, At the water ward end of the pier, an 8 feet wide by 20 feet Iong floating dock was also authorized to provide docking space for one vessel, The applicant is now proposing to increase the size of the.permitted floating dock from 8 feet by 20 feet to 8 feet by 60 feet, The applicant states that the modified floating dock would provide docking space for up to three vessels. After dredging, the proposed floating dock could potentially provide docking space for up to five vessels if sufficient water depths exist on the landward side of the float. A total of six individual piers have been permitted for the water front lots at Maritime Place Subdivision for a total of seven additional slips. Permit No. 166-03 contained a note advising'the permittee that should the total number of slips originating from the Maritime Place Development exceed ten(10), a closure of shellfish waters may be required, which would violate State Water Quality Standards. If the proposed expanded floating dock is considered three slips, the total number of slips at the subdivision would be ten (ten). If it could provide dockage for five vessels, then the total number would be 12 (twelve). It is recommended that the request for floating dock expansion be reviewed by The Division of Water Quality and Shellfish Sanitation Section of the Division of Environmental Health, Provided that no significant adverse comments are received from those agencies, it is recommended that the permit be modified and conditioned such that the proposed expanded floating dock shall not provide docking space for more than three vessels. The action proposed in your submittal is the modification of your Previously approved Sedimentation and Erosion Control Plan. The change consists of the re-grading/removal of the existing earthen berms as shown on the attached plan drawing. The final contours must maintain positive drainage to the subdivision's stormwater swales and be sloped away from the adjacent waters. Vegetative stabilization of the disturbed area must begin within 15 days. You have included with your submittal, the approval letter from the NC Division of Land Resources authorizing the proposed change in your Sedimentation and Erosion Control Plan (Bums-2004-031). The project is located adjacent to the Atlantic Intracoastal Waterway, on E. Seventh St., in Ocean Isle Beach, in Brunswick County. Upon reviewing the submittal and conferring with Doug Huggett, Major Permits Section Coordinator, I have determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #152-03, as described in your letter and plans dated 6/8/04, and received in our office on 6/8/04. Therefore, in accordance with T15A:07H,0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure: NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at(910) 815,4895, ext. 108 to discuss operations and appropriate lighting, markers, etc. for all dredge equipment. Spoil Dispo sal 6) All excavated materials will be confined, above mean high water and landward of regularly or irregularly flooded marsh, behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 7) The disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. In all cases, no spoil material shall be placed within 30 feet of the normal high water line, 8) The applicant shall contact a representative of the Division and arrange for an inspection of the constructed/prepared spoil disposal area.prior to the initiation of any dredging. This meeting shall i. include the dredging contractor, as well as,the permilee, 9) The disposal area and any associated disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Dewatered spoil materials may be utilized as fill material in areas of the subdivision that are consistent with the authorized Sedimentation and Erosion Control Plan for the Maritime Place subdivision, Community Pier 11) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification, 12) The pier and associated structures shall have a minimum setback distance of 15 feet, between any part(s) of the structure and the adjacent property owner's riparian access corridor. 13) Any portion of the permitted access pier and docking facilities built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 14) The authorized structure and associated activity must not cause an unacceptable interference with navigation, and no attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Maritime Place Permit#16&03 Page 3 of 4 ADDITIONAL, CONDITIONS 15) The permittee will maintain the authorized work in good condition and in conformance with the terms 4 and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. ` 16) This permit does not authorize the interference with any existing or proposed Federal project, and the ?; permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public ` interest. i 17) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 18) This permit does not authorize any boat slips or permanent dockage associated with the community pier. 19) The construction and/or operation of the authorized facilities shall not directly result in any closure of t any waters that are open to the taking of shellfish. Any such closure directly attributable to the authorized development facility, either now or in the future, will require that the permittee undertake remedial actions to remedy the situation, 1 i NOTE: The permittee is advised that should the total number of boat slips originating from the Maritime `i Place development exceed tent (10) slips, a closure of shellfish waters may be required, which would violate State water quality standards. Sediinerntation and Erosion Control 20) Appropriate sedimentation and erosion control devices, measures or structures (e,g, silt fence, diversion swales or berms, sand fence, etc.) must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and/or properties. 21) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 22) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain,erosion within thirty days of project completion. OTE: The existing Erosion and Sedimentation Control Plan for the Maritime Place subdivision project may need to be modified to utilize spoil materials onsite. Box 1890 Wilmington, North Carolina 28402 DEC 0 8 2003 SUBJ: North Carolina Aquarium HIV.0F00AffALmwGERUM Action ID: 200400026 Dear Colonel Alexander: This is in reference to the above project described in the State Field Investigation Report (Report), dated October 3, 2003, to fill 11,586 square feet (0.26 acre) of maritime swamp forest wetlands within the Theodore Roosevelt Natural Area for the expansion of the North Carolina Aquarium at Pine Knoll Shores, Cataret County, North Carolina. The area along Bogue Sound adjacent to the project is designated as Outstanding Resource Waters (ORW). The U.S. Environmental Protection Agency (EPA), Region 4, Wetlands Regulatory Section has reviewed this proposal and is concerned at any loss of such a high quality waters, especially with a "conservation type" project such as the North Carolina Aquarium. The project plans indicate the project will impact seven separate wetland areas with the largest impact occurring with Area 1 (8,012 square feet). We encourage the applicant to reevaluate the project design to reduce and/or eliminate the wetland impacts, especially the large impact from Area 1. Potential ideas for consideration are to place part of the aquarium on a second level and to use a parking deck to accommodate some of the planned parking area expansion. Any wetland impacts remaining should be mitigated to provide in-kind compensatory mitigation at the following ratios: restoration: 2 to 1 enhancement: 4 to 1 creation: 6 tol preservation: 10 to 1. It appears the applicant is proposing to mitigate for wetland impacts by "enhancement" and creation of wetlands by designing them for stormwater treatment. As you know, in general, the Clean Water Act prohibits the use of waters of the U.S. as treatment systems, except in situations where there is no less damaging practicable upland alternative. In these cases, the 2 impact to the "water" would require a 404 permit to become a treatment system and would no longer be considered waters of the U.S. It is EPA's opinion that the use of onsite wetlands for stormwater treatment, if permitted, would actually add to the mitigation requirement for the project rather than providing compensatory mitigation.
