Community Pier 1) This permit authorizes only the community pier, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this community pier facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The community pier shall not be designed to provide permanent dockage of any marine vessels. 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee Bland Shores S/D Permit#21-03 Page 2 of 2 ADDITIONAL CONDITIONS 4) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 5) The pier shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. NOTE: The permittee is advised that the riparian corridor lines shown on the attached sealed survey plat dated 11/5/02 will be applied to any future pier or dock requests originating from lots 1, 2, 3 or 4. General 8) This permit does not authorize the excavation or filling of any vegetated wetland or open water area. 9) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 021916. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. PROJECT SUMMARY: The applicant proposes to construct a community pier for use by the residents of Bland Shores Subdivision. • Lopp Management Company, LLC Page Two 9. PROJECT DESCRIPTION: The project site is located at the existing Bland Shores Subdivision,located on NC Highway 50,within the Town of Surf City. The property is located adjacent to Topsail Sound/Banks Channel and the Atlantic Ocean(property runs from ocean to sound). The tract is located between Bland Drive and Crutchfield Avenue,near the southern town limit of Surf City and the northern town limit of Topsail Beach. A CAMA Major Permit was issued on January 22,2002,to Dr.Fred Lopp authorizing the construction of subdivision streets, water and sewer mains and ocean dune crossovers. Work authorized by CAMA Major Permit 09-02 was completed earlier this year. Some additional road construction has taken place on the property outside of any Area of Environmental Concern. The subdivision has approximately 290 feet of shoreline along Topsail Sound. Along this shoreline is an area of Coastal and mixed Coastal/404 Wetlands averaging approximately 30 feet in width. Starting near the upland border, this area is vegetated with Red Cedar(Juniperus virginiana),Red Bay,Yaupon,Catbrier(Smilax bona-nox),and Salt Meadow Grass(Spartina patens). Moving into the intertidal zone,vegetation becomes primarily Smooth Cord Grass (Spartina alterniflora),intermixed with Glasswort(Salicornia spp), Sea Lavender(Limonium carolinianum),and Salt Meadow Grass,finally becoming pure Smooth Cordgrass along the waterward edge. The developer of the subdivision has provided for a 13 feet wide common area easement extending from the end of Oleander Court,between Lots 2 and 3, to the mean high water line of Topsail Sound. In addition, the developer has established and recorded riparian corridor lines for the four waterfront lots and common area. The applicant has dedicated 20 feet of the shoreline from both Lot 2 and Lot 3 to provide a 40 feet wide area of riparian access for the common area. The waters of Topsail are classified"SA"by the Division of Water Quality. The area is not designated as a Primary Nursery Area by the Division of Marine Fisheries and it is open to the taking of shellfish. The applicant is proposing the construction of a community pier for use by the residents of Bland Shores Subdivision. The structure would begin as a 4 feet wide wooden walkway,from the cul-de-sac end of Oleander Court,and would extend approximately 130 feet along the common area easement to the waters edge. The structure would continue as a 6 feet wide pier and would extend approximately 74 feet waterward of mean high water into Topsail Sound. At the terminal end of the pier,the applicants are proposing a 10 feet wide by 16 feet long platform. The total length of the structure,measured from mean high water would be approximately 90 feet. Water depths at the end of the structure would average approximately 3.9 feet at mean low water. There are no docking facilities or slips proposed with this structure. The pier would not extend beyond the shoreline's established pier length. 10. ANTICIPATED IMPACTS The proposed community pier would result in the incorporation of approximately 160 sq.ft.of public trust area. Minor increases in turbidity can be expected during construction. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on January 22, 2003. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicant proposes to construct a 90 ft. long by 6 ft. wide community pier with a 10 ft. by 16 ft. platform for use by residents of the subject subdivision. No boat docking facilities are proposed and the structure would not exceed the shoreline's established pier length. The pier would cross a margin of high quality coastal wetlands providing habitat for raccoon, opossum, wading birds, waterfowl, diamondback terrapin,juvenile fishes, and estuarine invertebrates. Area waters are classified SA and open to shellfish harvest. The project would shade an undetermined quantity of coastal wetlands and construction is expected to induce some turbidity in open shellfishing waters. Consequently, we recommend that pier decking be installed at least 4 ft. off the marsh floor and that construction avoid the April 1 to September 30 period of peak biological activity. The proposed project site is located at the existing Bland Shores subdivision between Bland Drive and Crutchfield Avenue within the Town of Surf City. The property is located adjacent to Topsail Sound/Banks Channel and the Atlantic Ocean. Bland Shores subdivision is located off of NC Highway 50, and adjacent to Topsail Sound/Banks Channel and the Atlantic Ocean(property runs from ocean to sound). According to the Division's Field Investigation Report the following Areas of Environmental Concern (AECs)will be impacted: Estuarine Waters, Public Trust Area and Coastal Wetlands. Waters at the site are classified SA, and are open to shellfishing. Waters at the site are not designated as Primary Nursery Area(PNA). This development proposal has been reviewed for consistency with the Town of Surf City Land Use Plan Update (1992). The land classifications for this site are Developed-Maritime Forest (upland portion of site) and Conservation(above listed AECs). The purpose of the Developed land classification is to allow for residential development where urban services are provided. Notwithstanding the Maritime Forest sub-classification, the DCM Field Report does not indicate that any maritime forest will be impacted as a result of this proposed project. The purpose of the Conservation classification is to provide for the effective long-term management and protection of significant, limited or irreplacable areas. The following LUP policies are applicable to this project: Coastal Wetlands—Highest priority of use shall be allocated to the conservation of existing coastal wetlands. Second priority shall be given to those uses (i.e. water-dependent uses) that require water access and cannot function elsewhere. Estuarine Waters—Activities shall be restricted to those which do not permanently or significantly affect the function, cleanliness, salinity and circulation of estuarine waters. Highest priority of use shall be allocated to the conservation of estuarine waters and its vital components. Second priority shall be given to those uses (i.e. water-dependent uses) that require water access and cannot function elsewhere. Public Trust Areas—Suitable land or water uses include those which protect public rights for navigation and recreation and those which preserve and manage the public trust areas in order to safeguard and perpetuate their biological, economic, social and aesthetic value. Shellfishinm Waters— The Town recognizes the value and fragility of these resources by providing protection through the enforcement of all applicable regulations to development or land disturbing activities having a possible impact upon these waters.
