Shoreline Stabilization 1) The bulkhead will be positioned to align in a straight line with the corners of the two adjacent bulkheads. 2) No fill material will be placed at any time in the surrounding waters outside the alignment of the fill area indicated on the workplan dated 8/12/03. 3) No excavation of shallow water bottom or any wetlands is authorized by this permit. 4) The bulkhead must be constructed prior to any backfilling activities. Signature of Permittee Kenneth & Charlotte Lightell Permit# 162-03 Page 2 of 3 ADDITIONAL CONDITIONS 5) This permit authorizes no filling of vegetated wetlands. 6) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. 8) The fill material will be clean and free of any pollutants except in trace quantities. 9) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. 10) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. Docking Facility 12) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 13) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 14) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 15) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 16) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. T Kenneth & Charlotte Lightell Permit# 162-03 Page 3 of 3 ADDITIONAL CONDITIONS 18) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 19) This permit authorizes a maximum of four (4) boat slips. At no time shall more than 4 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. General 20) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 031058), which was issued on 10/l/03. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 200310921. PROJECT SUMMARY: The applicants propose to construct a bulkhead and pier with 2 finger piers and a platform on their property located at 612 Small Drive, Newbegun Land Subdivision, Pasquotank County and on the Pasquotank River. Kenneth and Charlotte Lightell Field Investigation Report Page Two PROJECT SETTING The property is a 32,968 sq ft (0.76 acre) lot located at 612 Small Drive (private), Newbegun Land Subdivision, off SR 1131 in Pasquotank County and adjacent the Pasquotank River. The property has an elevation of approximately 6 ft above normal water level and has Elkton silt loam for soils. Vegetation on the property consists of pine, sweet gum and red maple trees and indigenous grasses. The property has been cleared in preparation for the construction of a single-family dwelling. Adjacent property consists of similar size building lots. The lot to the north has a home under construction and the lot to the south is undeveloped. Both adjacent lots are bulkheaded and the applicants' property has experienced considerable erosion along the shoreline. The wing wall for the bulkhead on the north side has been extended to prevent further erosion to that lot but has failed. The property on the south side has had riprap placed along the shoreline at the wing wall without effect. The water depths close to shore range from 1-2 ft. The waters of the Pasquotank River in this area are classified as SB by the Division of Environmental Management and are closed to shellfishing taking. DEVELOPMENT PROPOSAL In order to prevent further erosion, the applicant proposes to construct a 125 ft long bulkhead to connect with the corner of the adjacent lots and have a straight alignment. The proposed bulkhead alignment will have a maximum distance of 40 ft from the shoreline and an average distance of 35 ft. The applicant is requesting this alignment because trash and debris collect in the eroded area. The applicant proposes to construct a 6 ft wide pier with a 14 ft x 30 ft T head platform. The total length of the pier structure will be 200 ft. The applicant proposes to construct two finger piers 3 ft wide and 12 ft long and two pilings in from the T head platform to create four 12' x 20' slips. ANTICIPATED IMPACTS The proposed bulkhead alignment with backfill will result in the filling of approximately 4,375 sq ft of Public Trust Area (PTA) and Estuarine Waters (EW) Areas of Environmental Concern AEC's. Approximately 325 cubic yards of fill material will be placed below NWL for the backfill. The proposed pier will shade 1,116 sq ft of PTA and EW AECs and the T platform and two finger piers will shade 492 sq ft of PTA and EW AECs. Temporary water turbidity will occur during construction. Adjacent properties are bulkheaded and the applicant's lot has suffered severe erosion. The property has a concave shoreline. The proposed bulkhead alignment will have a maximum distance of 40 feet from the shoreline and an average distance of 35 feet. The applicant is requesting this alignment because trash and debris collect in the eroded area. The applicant proposes to construct a six (6) feet wide pier with a 14 feet x 30 feet T-head platform. The total length of the pier structure will be 200 feet. The applicant proposes to construct two (2) finger piers three (3) feet wide and 12 feet long and two (2) pilings in from the T-head platform to create four(4) 12' x 20' slips. The development proposal can be considered consistent with 7H.0208(b)(7)(D), which allows a bulkhead below the NWL. The lot has lost a great deal of area along the shoreline because of erosion. The proposed alignment, although an average of 35 feet waterward of the NWL, will prevent the collection of trash and debris. The proposal also appears consistent with 7H.0208(b)(6) piers and docks. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be re-staked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The bulkhead must be constructed prior to any backfilling activities. 3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 4) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles, or other suitable materials approved by Department personnel. No excavation is permitted, except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 5) The fill material will be clean and free of any pollutants, except in trace quantities. Nevertheless, the following comments regarding impacts of the project on fish and wildlife resources are respectfully offered for your consideration. Comments from the North Carolina Wildlife Resources Commission(Commission)are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through I I3A-128), as amended, and the Fish and Wildlife Coordination Act(48 Stat. 401,as amended; 16 U.S.C. 661 et seq.). The applicant proposes construction of a bulkhead and pier on property along the Pasquotank River south of Elizabeth City. As proposed, the 125' long bulkhead would average 35' waterward of the shoreline and connect to the bulkhead lines on adjoining lots. The total impacts from the project include filling 4,375 square feet of shallow water habitat and shading of approximately 1600 square feet of open water by the 200' long pier and associated t-head platform combined. The Commission would normally recommend using vegetation or rip rap in lieu of a bulkhead to stabilize the shoreline on the subject property because these methods are less detrimental or offset adverse impacts to shallow water fish habitats. Similarly, to minimize the amount of shallow water fish habitat usurped by the project if a bulkhead is built, we would typically recommend that the bulkhead be aligned, to the extent practical, either along the shoreline with a maximum waterward distance of 5' or a reasonable waterward distance to allow recovery of recently eroded property. However, in part since we were unable to visit the site to assess the quality of the shallow water habitat affected and other site conditions, we will defer to any comments that may have been provided by the North Carolina Division of Marine Fisheries regarding this aspect of the project.
