Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. Below is a brief update on our status in providing the requested information. As briefly discussed in our February 14, 2007 telephone conversation, we are pr©posing to use the conservation easement template posted on the Wilmington District.Co website. A copy of this document has been provided to John Carter,Jacksonville Gityr Attorney for his review.Any modification to this document will be provided in a red Tine format for review by the Corps and DWQ, A justification will be provided far each proposed modification, if any We have begun the process of identifying a third party to hold the conservation easement Both The Nature Conservancy(7WC)and the North Carolina Coastal Federation have expressed interest about learning more about the proposed preservation areas. Bob Belcher will be meeting Hervey McIver from TNC on March 2, 2007 to show him the proposed preservation areas. Shortly after this meeting we will confirm TNC's e l ngness to hold the conservation easement. We have reviewed the survey report for the above project and offer the following comments. An archaeological survey was conducted in selected areas of the proposed additional land application expansion area. One site, 31ON628,was revisited and assessed by this project Four additional sites,31ON1573— 31 ON1575 and 31ON1605,were recorded and assessed as a result of this project None of the sites were recommended as eligible for inclusion on the National Register of Historic Places (NRHP). We concur with these recommendations. Please note,a historic cemetery,31 ON1605,is located within the general project area. It has been recommended that any proposed use of 31 ON1605 will require treatment under the provisions of North Carolina.Generil Statute 65-13. We concur with this recommendation. It is our understanding.from discussions with you that the cemetery has been avoided by the proposed design plans and will be clearly marked in the held for avoidance and any future development. We ask that we be notified if any changes in the design plans may impact 31 ON1605. The report meets our offce's guidelines and those of the Secretary of the Interior. There are no specific concerns and/or corrections, which need to be addressed in regards to this report The present version of this document can serve as the final report. You and the staff of the Division of Coastal Management have worked wonderfully with the City of Jacksonville on the Sturgeon City projects. Our current permit expires December 31, 2006 and was extended to allow construction of a boardwalk funded by DCM at the site. We have bid the boardwalk twice without finding a successful resolution. We now hold a contract with a separate engineering firm to assist us in getting the project built. We have great confidence in Stantec Engineering that this will be accomplished very soon. We have been working with Maureen Will who has secured a similar extension to our Coastal Access grant based on our in-place contracts. The selection of Stantec was in part driven by a process that reviewed how others have been dealing with increased local government construction costs and problems with initial design. We are pleased to have our projects supervised now by Larry Hobbs. You are encouraged to contact him directly about our projects and our request to you.
