This permit,issued on April 1,2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marsh Restoration
1) This permit authorizes the restoration of 2.5 acres of coastal marsh as stated in the application and
depicted on the attached workplan drawings.
2) An earthen plug shall be left between the areas to be excavated and/or graded, and the existing bay and a
24 hour period after completion of excavation and/or grading will elapse prior to plug removal to
prevent unnecessary siltation into the adjacent water body.
3) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawings.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
5) All excavated materials will be confined above mean high water and landward of regularly or irregularly
flooded marsh behind adequate retaining structures to prevent spillover of solids into any marsh or
surrounding waters.
6) The spoil disposal area must be designated by the permittee and inspected and approved by a
representative of the Division of Coastal Management prior to the commencement of any excavation
activities. All excavated fill material taken offsite during the construction of the restoration area must be
disposed of on an upland site.
7) An as-built plan will be submitted to the Division of Coastal Management and the U.S. Army Corps of
Engineers upon completion of the site prep work and the planting of the vegetation.
8) The permittee shall maintain the restoration area in its restored condition in perpetuity. Prohibited
activities within the mitigation areas specifically include, but are not limited to, the discharge of dredge
or fill material, excavation, the cutting, damage, or removal of any vegetation, grading, leveling, or any
earth moving activity.
NOTE: If site is to be used for compensatory mitigation, all the conditions set forth in the Memorandum
of Understanding between North Carolina Department of Environment and Natural Resources
and the United States Corps of Engineers, Wilmington District, finalized on November 4, 1998,
must be met. Further, the rules of the N.C. Coastal Resources Commission, as implemented by
the Division of Coastal Management, allow mitigation for impacts to coastal wetlands only for
projects that will have public benefits, as determined by the Division of Coastal Management,
provided that the public benefits clearly outweigh the adverse effects of the project, and further,
that all reasonable means of impact avoidance and minimization have been incorporated into the
project's design.
Culvert Installation
9) Culvert inverts shall be set at least one foot below normal bed elevation.
10) Appropriate bedding material must be placed beneath the culvert to prevent structural subsidence.
11) This permit does not authorize the excavation of existing creek bottom other than that necessary to set
the culverts.
Boardwalks and Pathways
12) Any portion of the boardwalks and pathways constructed within 30 feet of the normal water level shall
be elevated, slatted and constructed of wood.

Upland Development
15) This permit authorizes the upland development expressly and specifically set forth in the permit
application and depicted on the attached workplan drawings.
16) No land disturbing activities are authorized within 30 feet of the normal water level except that which
may be necessary to construct the boardwalks and pathways.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
17) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
18) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
19) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
20) While accomplishing the authorized work, if the permittee discovers any previously unknown Federally
endangered or threatened species, the District Engineer will be immediately notified so that required
coordination can be initiated with the U.S. Fish and Wildlife Service (USFWS).
21) While accomplishing the authorized work, if the permittee discovers any previously unknown cultural
resources, the District Engineer will be immediately notified so that required coordination can be
initiated with the North Carolina Division of Cultural Resources.
22) All fill material will be clean and free of any pollutants except in trace quantities.
23) All fill material will be obtained from a high ground source.
24) The permitted activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside of the area of construction or construction-related discharge. Increases such that the
turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant.

25) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee is advised that this is a mosquito breeding area, and construction plans and
operations should include awareness of this. To arrange for a site visit, or for information to help
prevent the creation of more mosquito breeding habitat, the permittee should contact the Public
Health Pest Management Section at (252) 726-8970 and/or the City of Jacksonville Mosquito
Control Office.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3371 (DWQ Project No. 030153), which was issued on 3/5/03.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you

8. PROJECT SUMMARY: The applicant is the City of Jacksonville, and the project is the Sturgeon City
Park and Marsh Restoration. The City is working in coordination with the NC WRP to restore 2.5 acres
of the 12.9 acre out parcel to coastal marsh, with the remainder converted to park space with picnic
shelters, boardwalks, a parking lot, and an amphitheater.

9.NARRATIVE DESCRIPTION:
The applicant is the City of Jacksonville, and the project is the restoration of wetlands and high
ground area that was previously a municipal waste disposal area adjacent to Wilson Bay, off of
Loyola Drive and Court Street in Onslow County. The project, which is multi phased and has
received several permits, is referred to as the Sturgeon City Park. This property is a 12.9 acre
out parcel of the entire 26+ acre municipal property. The long-range goal involves a sturgeon
hatchery, the cleaning of the waters of Wilson Bay through various water quality measures, and
the construction and operation of an environmental education center for the city. The NC WRP
has been working with the City of Jacksonville on the wetlands restoration portion of the project,
and intends to construct and monitor the functioning and success of this project.
This 12.9 acre out parcel is bound by Wilson Bay to the south and Thomas School Creek to the
east. The only development currently existing on this site is random sewer lines. Some have been
sealed, with the one crossing Thomas School Creek still functional. The average ground elevation
on the property is +6' msl, with some areas reaching +18'. The substrate is sandy, mixed with
varying debris from years of fill activity. Vegetation on the site is mostly grasses and weeds, with
fringes of S_partina cynosoroides underlain with concrete and debris along the shoreline. A buffer
of early succession vines and shrubs line the shoreline. There is a Section 404 Wetland pocket
about mid-way north along the east side of the property. This feature has obviously been
disturbed, and has varying elevations and substrate. The origin of the freshwater wetlands on this
property lies in their history as sewage lagoons. Typically, they are vegetated with Red Maple,
Red Cedar, Black Willow, Wax Myrtle, Titi, and Poison Ivey. A berm was created in the past to
hold tidal waters from the property, and has resulted in the isolation of these pockets. The lowest
area along this shoreline is about midway north along the east side, at the same location of the
freshwater wetland pocket. At this point, the coastal marsh extends into the property about 60' to
an historic gravel road. There is a culvert that appears to be the cause of the reduced elevation
and the intrusion of the marsh. The flow through the culvert has created a ditch into Thomas
School Creek.
The applicant has stated that photography dating to 1938 indicates that this area was tidal marsh
that has been treated as a dump for a range of materials through the years. Field-testing has
confirmed this, with core borings to 6' below the surface revealing the presence of marsh grass
particles and wetland soils. Unfortunately, DCM photography has not extended upriver to
Jacksonville in past years, and only 1995 is available. The City of Jacksonville Land Use Plan
classifies this area as Developed, with all AEC's carrying a classification of Conservation. The
NC Division of Marine Fisheries has designated Wilson Bay as a Primary Nursery Area.
Wilson Bay is Closed to the taking of shellfish for consumption, and carries a water quality
classification of SC, further categorized as High Quality Waters and Nutrient Sensitive Waters.
The normal water level elevation in Wilson Bay is ±2.0', with a tidal range from .5' nlw to 2.2'
nhw. The applicant has received Sedimentation/Erosion Control Plan approval on 12/05/02, and
has submitted a Stormwater Plan on 11/19/02.

Sturgeon City
The proposal is to grade 12.6 acres of the 12.9 acre project area. The defining feature for the
proposed wetlands is a series of 4 small tidal creeks extending inland from the Thomas School
Creek branch of Wilson Bay. The creek closest to the bay will extend inland west and south for
approximately 200', with a 5' to 8' top width. The top of the creek will be +1' msl, while the
bottom will be -2' msl. The second and third creeks are to be connected to the ditch at the
aforementioned culvert. One will extend in a westerly direction, the other west and then south.
They are proposed for 230' and 270' respectively, and will have the same widths and depths as the
first. The creek furthest inland, or north, will be the most prominent, extending approximately
540', branching north and south at the west end. This creek is mostly an enhancement of an
existing roadside ditch. Widths and depths will be the same as the other three creeks. Excavation
of the tidal creeks will require the removal of approximately 10,000 cubic yards of material from
high ground and Section 404 Wetlands, and 30 cubic yards from below the normal water level.
The spoil will be removed to a high ground city owned site.
Because the site will be graded to drain to the newly created tidal creek, control of the sediment
during construction should be easier than if the project was to drain to the marsh of Wilson Bay or
Thomas School Creek. The applicant has committed to use silt fencing and bio-mats along the
creek slopes to prevent sedimentation of the bay. Additionally, the applicant has agreed to leave a
plug at the created creek interfaces with Thomas School Creek until settling occurs within the
newly excavated creek.
The restored wetlands will be created by grading from the creek elevations, leaving the creeks to
feed the wetland system, and the wetlands to drain into the creeks. This will require the grading
of approximately 2.5 acres to varying elevations. The community of coastal wetlands will be
primarily brackish, moving toward the more interactive and saline species at the Bay's edge. At
the location of the existing culvert there are two culverts proposed. The existing will be removed,
and two installed to connect the new creeks on the east side of the roadbed to the new creeks on
the west side of the roadbed. Culverts 1 and 2 will be 50' and 55' respectively, with 36"
diameters. The finished elevation will be lower than the existing at +1.3' nwl. The Section 404
Wetlands on the west side of the roadbed (approx. 9600 sf) will be excavated and converted to
coastal marsh. At the far west end of this wetland area, approximately 2620 sf of Section 404
Wetlands will be filled to acquire elevations necessary for the boardwalk. The installation of the
culverts will cause the excavation of 375 sf of coastal wetlands located at the outfall of the existing
culvert.
On the northwest side of the property there is a parking area proposed, approximately 370' x 70'
in size, with spaces for 61 vehicles. This structure will connect to Loyola Drive across the
proposed enhanced roadside ditch, with the installation of two culverts. Culverts 3 and 4 will be
elliptical in shape, and will be 64' and 50', extending to +2.75' and + 1.6' nwl respectively.
The entrance roads will be 20' wide by 28' long and 24' wide by 190' in length. An asphalt
surface will finish the parking lot and entrances.
The higher 10+ acres of the property will be graded and planted to provide various ecological
communities for educational and environmental health purposes. There will be a 6' wide
boardwalk meandering throughout the park, alternating from drip-thru decking to concrete. Along
the east side of the tract, approximately 100' from the edge of Thomas School Creek, there is a
circular amphitheater proposed, approximately 30' in diameter. Overall impervious area of the

finished park should be approximately 1.1 acre, or 8.5%, with less than 1% within the Estuarine
Shoreline AEC.
All construction methods and equipment will utilize high ground access. This proposal is one in a
series of proposals to clean up Wilson Bay in a manner that attracts the public and serves as a
marketing and educational tool.
ANTICIPATED IMPACTS:
As proposed, this project will require the grading of approximately 12.6 acres, with the Section
404 Wetlands component being 12,220 sf, and the coastal marsh 375 sf. A net gain of 2.5 acres
of coastal marsh will result, as well as the creation of natural areas from what is currently a
landfill. Grading in close proximity to natural water bodies has the potential to result in turbidity
increases in the waters. The relief being to the creeks and away from the existing marsh should
minimize this possibility. A plug at the creek mouth should also minimize turbidity impacts. This
ecosystem is intended to mimic the original habitat, and hopefully restore previous wetland
functions to the Wilson Bay system. The added benefit is the public education aspect of the
project.

Project Purpose and Background
The City of Jacksonville has undertaken a project to redevelop the former Jacksonville Wastewater Treatment Plant
into the Sturgeon City Environmental Education Center. The existing structures will be converted to various
environmental and educational uses including hatcheries and laboratories. The surrounding area will be converted
into a park with interpretive nature trails, an amphitheater, and a nectar garden. Due to funding limitations, the
project must be phased into several parts. This phase of the project will include the development of the park and
surrounding natural areas. This phase will also include a marsh restoration component with involvement by the
NC Wetlands Restoration Program. The park development will include a parking lot, several concrete paths, and
wooden boardwalks.
The Sturgeon City Environmental Education Center is just one part of a larger, multi-agency effort to restore and
enhance the ecosystems and public use of areas in and around Wilson Bay. The full effort will comprise a set of
projects which includes ecosystem restoration and stormaater management throughout the Wilson Bay watershed
as well as direct restoration efforts in the Bay. Redevelopment and restoration projects in the area have been
initiated and funded by a variety of sources including the US Army Corps of Engineers, NC Division of Parks and
Recreation, NC Division of Coastal Management, the City of Jacksonville, NC State University, NC Wetlands
Restoration Program,and have recieved tremendous support by the city and local community groups.
The project area for this phase consists of 12.9 acres. The proposed marsh restoration within that area will be
approximately 2.5 acres with the remaining acreage being utilized as a public park. The park will include picnic
shelters, playgrounds, a parking lot, an open air amphitheater, open recreational fields, native wildflower
meadows,native butterfly gardens,native tree buffers,pathways and boardwalks.The natural areas will be planted
with more than 50 native plant species. Handicap access to much of the area has also been accommodated. The
parking lot has 56 spaces including handicap parking. The boardwalks and pathways within this project will total
approximately 3,300 feet and will tie into the boardwalks being installed at the Phase I Marsh Restoration.
Together, these projects will provide an integrated path network that will allow people, with various levels of
physical ability, access to Wilson Bay and its restored coastal marsh system. Total impervious area of the
amphitheater, paths and parking lot will be approximately 1.1 acres (<101/6). The Sturgeon City Municipal Park
and Marsh Restoration project will provide access to Wilson Bay in a way that will promote a sense of community
which includes the natural environment as a vital part of its existence. The park will provide a place for local
citizens and visitors to attend events at the amphitheater, to walk along boardwalks over restored marsh areas, to
enjoy the beauty of native flowering plants and to participate in many recreational activities in the open fields.
Underlying these activities, the park has also been designed to treat stormwater and reduce sediment loads to
Wilson Bay.
BLUE: Land, Water Infrastructure will oversee all site construction activities. Construction will begin with the
installation of all sediment and erosion control devices. This will include silt fences, sediment booms along the
shoreline, and temporary sediment basins. Once all sediment devices are in place, site grading will commence. A
buffer of undisturbed land will be left along the shoreline until all other site grading is complete and stable. Once
grading is complete, erosion control blanket will be placed along tidal creeks and on all slopes steeper than 3:1
(H:V). Rigorous adherence to these efforts will ensure that Wilson Bay is not further degraded during the
construction process.

Dear Mr. Huggett:
Reference the application of the City of Jacksonville for a Department of the Army permit

space with picnic shelters, boardwalks, a parking lot and an amphitheater located at Sturgeon
Park, adjacent to Wilson Bay, off of Loyola Drive and Court Street, Jacksonville, Onslow
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be done in strict compliance with the permit plans. If
any aspect of the plan is modified, prior to or during construction, the applicant must notify the
District Engineer immediately for further evaluation.
2. Appropriate sedimentation and erosion control measures will be taken to minimize siltation or
turbidity. Disturbed areas will be immediately stabilized to prevent erosion into adjacent waters
or wetlands.
3. No dredged or fill material will be placed in any wetlands or waters outside the permit area at
any time.
4. This Department of the Army permit does not obviate the need to obtain other Federal, State
or local authorizations required by law.
5. While accomplishing the authorized work, if the permittee discovers any previously unknown
Federally endangered or threatened species, the District Engineer will be immediately notified so
that required coordination can be initiated with the U.S. Fish and Wildlife Service (USFWS).
6. While accomplishing the authorized work, if the permittee discovers any previously unknown
cultural resources, the District Engineer will be immediately notified so that required
coordination can be initiated with the North Carolina Division of Cultural Resources.
7. The activity will be conducted in such a manner as to prevent any significant increase in
turbidity outside the area of construction or construction related discharge. Increase such that the
turbidity is 25 NT's or less will not be considered significant.
8. All extracted fill material taken offsite during the construction of the restoration area must be
disposed of on an upland site.
9. An as-built plan will be submitted to our office upon completion of the site prep work and the
planting of the vegetation.
10. The permittee shall maintain the restoration area in their natural condition in perpetuity.
Prohibited activities within the mitigation areas specifically include, but are not limited to, the
discharge of dredge or fill material, excavation, the cutting, damage, or removal of any
vegetation, grading, leveling, or any earth moving activity.
11. If site is to be used for compensatory mitigation, all the conditions set forth in the
Memorandum of Understanding between North Carolina Department of Environment and
Natural Resources and the United States Corps of Engineers, Wilmington District, finalized on
November 4, 1998, must be met.
12. Our office must be contacted prior to construction of a boardwalk/walkway within the
restored wetlands.
13. The permittee understands and agrees that, if future operations by the United States require the
removal,relocation, or other alteration,of the structure or work herein authorized, or if,in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters,the permittee will be
required,upon due notice from the Corps of Engineers,to remove,relocate,or alter the structural
work or obstructions caused thereby, without expense to the United States. No claim shall be made
against the United States on account of any such removal or alteration.

I don't have any significant comments on this project. It looks like they have already calculated the net
wetland acreage they will end up with which was one of my questions. The other was how they planned to
keep the sediment out of the water while they are constructing the project- and that is also addressed (silt
fencing, leaving a berm until the end...). One question I have is when are they planning to do this and will
the site be planted right away to get the marsh vegetation started and the ground covered? Maybe that's
two questions.
In terms of all the success criteria and monitoring that is more or less separate from this project in that the
NCWRP gets reviewed by an interagency group that looks at their reporting and monitoring methods and
comments from that end. Since the site will serve as mitigation for some other permitted project and likely
for coastal wetland impacts,I think that interagency review is the venue for ensuring this site's success.

The applicants' property is located within the City of Jacksonville adjacent to the
northwest side of Wilson Bay. This property is the site of the old Jacksonville
wastewater treatment plant off Loyola Drive. The applicant proposes to restore 2.5 acres
of the 12.9 acre out parcel to coastal marsh,with the remainder of the parcel to be
converted to park space with picnic shelters,boardwalks, a parking lot, and an
amphitheater.
Areas of Environmental Concern (AFC's)impacted by the proposal are Coastal Waters
and Estuarine Shorelines. Waters at the project site are classified as SC HQW NSW and
are not open to the harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1996 City of Jacksonville Land
Use Plan Update and offer the following comments.
The general area of the project is classified as Developed, while the AECs impacted by
the work are classified as Conservation.
In general, the City of Jacksonville Land Use Plan Update allows development in
Conservation classified AECs which is consistent with the State's minimum use
standards. Further,the land use plan states that the City of Jacksonville supports the
state's shoreline access policies as set forth in NCAC Chapter 15A, Subchapter 7M. The
City will conform to CAMA and other state and federal environmental regulations
affecting the development of estuarine access areas.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the 1996 City of Jacksonville Land Use Plan Update.

You have our approval, in accordance with the attached conditions(WQC#3371)to conduct the
following activity at your property located adjacent to the northwest side of Wilson Bay in the City of
Jacksonville,Onslow County. This approval allows you to:
1. Impact 12,220 square feet of 404 wetlands and 375 square feet of coastal wetlands associated
with the City working in coordination with the North Carolina Wetlands Restoration Program
to restore 2.5 acres of the 12.9 acre tract to coastal marsh, with the remainder converted to park
space with picnic shelters,boardwalks, a parking lot, and an amphitheater.
This approval is only valid for the purpose and design that you described in your CAMA application
received by the Division of Water Quality(DWQ)on February 13, 2003. After reviewing your
application,we have determined that General Water Quality Certification Number 3371 covers this
activity. This Certification allows you to use your CAMA Permit when the NC Division of Coastal
Management issues it. Please keep in mind that there may be additional Federal, State or Local
regulations applicable to your project,such as(but not limited to) Sediment and Erosion Control,Non-
Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition,this approval
will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your CAMA Major Permit
application received by the Division of Coastal Management on January 21,2003. If you change or modify
your project,you must notify the Division(DWQ) in writing and you may be required to send us a new
application for a new certification. If the property is sold,the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project(now or in the future)exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506(h). For this approval to be valid,you must follow the
conditions listed in the attached certification and the additional conditions listed below:

2. Turbidity levels must not exceed 25 NTU outside of the project area. Turbidity curtains must be
installed along the shoreline of Wilson Bay where grading work is proposed;
3. Approved erosion and sedimentation control devices and practices which equal or exceed those
outlined in the most recent version of the "North Carolina Sediment and Erosion Control
Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from
the Division of Land Resources in the DEHNR Regional or Central Offices)shall be properly
implemented.
Please notify this Office at the number listed below if any problem arises during the construction of the
project that may affect water quality.
If you do not accept any of the conditions of this certification,you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center,Raleigh,N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Sturgeon City Municipal Park on February 14, 2003. Staff review of the plans
and specifications has determined that the project, as proposed,will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 021124
dated February 17, 2003, for the construction of Sturgeon City Municipal Park.

2. The overall tract built-upon area percentage for the project must be maintained at 30%, as
required by Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and
approved by the Division.
5. No piping is allowed except that minimum amount necessary to direct runoff beneath an
impervious surface such as a road or to provide access.
6. Building roof drains must terminate at least 30' from the Mean High Water line.
7. The runoff from the parking area is to be treated in 3 tiered bio-retention swales sized to
contain 1" of runoff.

II. SCHEDULE OF COMPLIANCE
1. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer
between all impervious areas and surface waters.
2. The permittee is responsible for verifying that the proposed built-upon area does not
exceed the allowable built-upon area.
3. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
4. Alteration of the drainage as shown on the approved plans may not take place without the
concurrence of the Division of Water Quality.
5. Construction of additional impervious areas such that low density requirements are no
longer met must be submitted to DWQ and a permit modification must be issued prior to
construction. An engineered system will be required to collect and treat the runoff from
all built-upon area associated with the project, including that area permitted under the low
density option.
6. A copy of the recorded restrictions must be received by this Office within 30 days of the
date of sale.
7. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with
the permitted development, except for average driveway crossings, is strictly prohibited
by any persons.
8. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a
reduction of the permitted amount of built-upon area due to CAMA jurisdiction within
the AEC.
9. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans , including,but not limited to, those listed below: .
a. Any revision to the approved plans,regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition,or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the approved
plan.
10. Swales and other vegetated conveyances shall be constructed in their entirety,vegetated,
and be operational for their intended use prior to the construction of any built-upon
surface.
11. During construction, erosion shall be kept to a minimum and any eroded areas of the
swales or other vegetated conveyances will be repaired immediately.
12. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.

13. The permittee shall at all times provide the operation and maintenance necessary to
operate the permitted stormwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
14. Within 30 days of completion of the project, the permittee shall certi-y in writing that the
project has been constructed in accordance with the approved plans.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified,revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance, or termination does not
stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying
the permit,revoking and reissuing the permit, or terminating the permit as allowed by the
laws,rules, and regulations contained in Title 15A of the North Carolina Administrative
Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al.
5. This permit is not transferable to any person except after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of the
permit to change the name and incorporate such other requirements as may be necessary.
A formal permit request must be submitted to the Division of Water Quality accompanied
by the appropriate fee,documentation from both parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its
merits, and may or may not be approved. The permittee is responsible for compliance
with all permit conditions until the Division approves the transfer.
6. The permittee grants permission to DENR Staff to enter the property for the purpose of
inspecting all components of the stormwater management facility.
7. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
8. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes,rules,regulations,or ordinances which may be imposed by other government
agencies (local, state and federal)which have jurisdiction.

4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

The following are my comments and recommendations regarding the aforementioned proposal:
The City of Jacksonville has proposed to restore 2.5 acres of coastal marsh within a previously
filled wetland area, and to return the remainder of this 12.9 acre area to natural communities
with public enhancements. One aspect of this proposal which seems inconsistent with the
intended purpose is the fill of the federal wetland area for the boardwalk. It would seem only
logical, and cause less wetland degradation, to construct a pile supported boardwalk over this
area. Because this area is Section 404 Wetlands, I will leave the recommendation to the US
Army Corps of Engineers.
Assuming proper methodology and monitoring, there is only positive to be derived from this
proposal. I recommend the project be authorized contingent upon the following conditions:
1) An earthen plug will be left between the area to be excavated and the existing bay and a 24
hour period after completion of the excavation will elapse prior to plug removal to prevent
unnecessary siltation into the adjacent water body.
2) No excavated or fill material will be placed at any time, in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the workplats.
3) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters.
4) A spoil area must be designated and approved prior to use.

DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on February 10, 2003.
According to said application, the City, in coordination with the North Carolina Wetlands
Restoration Program, proposes to restore 12.9 acres of municipal waste disposal area to wetlands
and natural space, with boardwalks, picnic shelters, and an amphitheater. This proposal is located
adjacent to the retired Jacksonville Wastewater Treatment Facility.
A copy of the entire application may be examined or copied at the office of T. Barrett, NC
Division of Coastal Management, located at 151-B Hwy. 24, Hestron Plaza II, Morehead City, NC,
(252) 808-2808 during normal business hours.
Comments mailed to Donna D. Moffitt, Director, Division of Coastal Management, 1638
Mail Service Center, Raleigh, NC, 27699-1638, prior to March 04, 2003, will be considered in
making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of city property located adjacent to Wilson Bay in Jacksonville, NC. It was
received completed on February 10, 2003, and appears to be adequate for processing at this time. The
projected deadline for making a decision is April 25, 2003. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Unabr
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice
card to a telephone pole or tree along the road right-of-way fronting your property, or at a point along
the road right-of-way where a private road would lead one into your property. Failure to post this notce
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
