Rails to Trails Greenway System
1) This permit authorizes the development of the bicycle and pedestrian path, including paved approaches
and refurbishment of the railroad trestle that is expressly and specifically set forth in the permit
application and depicted on the attached workplan drawings.
2) No fill material will be placed at any time in any vegetated wetlands or surrounding waters outside of
the alignment of the fill area indicated on the workplan drawings.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.

ADDITIONAL CONDITIONS
4) No land disturbing activities are authorized within 30 feet of the normal water level except that which is
necessary to construct the approaches to the trestle/creek crossing and placement of the riprap and rock
gabions.
5) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
NOTE: The permittee is advised to notify the District Engineer with the NC Department of
Transportation should it become necessary to encroach closer to the NC Highway 24 bridge
structure than depicted on the attached workplan drawings.
Shoreline Stabilization
6) The toe of the permitted riprap and rock gabions will not extend waterward more than 5 feet from the
normal water level.
7) The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to
prevent its movement from the site by wave or current action.
8) The riprap material must consist of clean rock or masonry materials such as but r-ot limited to granite or
broken concrete.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sedime-ots in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
11) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Stormwater Management
12) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW8030328 on 7/9/03. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
General
13) The permitted activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside of the area of construction or construction-related discharge. Increases such that the
turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 030384), which was issued on 4/25/03.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
No. 18 (COE Action Id. No. 200300512) which was issued on 4/3/03.

State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if.questions arise concerning permit

8. PROJECT SUMMARY: The City of Jacksonville has several conservation/outdoor entertainment
projects underway. This is the Rails to Trails Program, providing a greenway system through the city
for pedestrian and bicycle use. The interior portion of the project has been completed. This phase of
the proposal is the conversion of the old Seaboard Coast Line Railway to bike path. The abutments
will be improved and protected with riprap and gabions. Approaches are proposed on both sides of the
bridge.

9.NARRATIVE DESCRIPTION:
In recent years, the City of Jacksonville has undertaken several measures to clean the waters
of the area, restore wetlands, while providing public education and outdoor entertainment.
These projects have taken the form of restoring hydrology, creating and restoring wetlands,
oxygenating Wilson Bay through the use of aerators, and providing public walkways with
informative plaques through the Sturgeon City wetlands. The most recent move is to provide
a greenway through the city for pedestrian and bicycle use, a project known as Rails to
Trails. This proposal is for the portion of the greenway that crosses the Northeast Creek.
Currently, there is an abandoned railway previously used by the Seaboard Coast Line that
crosses Northeast Creek immediately south of the Highway 24 Bridge crossing. The Camp
Lejeune Railroad Right of Way extends the length of the railway through Department of the
Navy property. The Department has agreed to convey to the City of Jacksonville an
easement for the use of this 50' R.O.W. for the purpose of the greenway development. This
easement settlement is underway, and a letter of intent to convey is on file.
The property around the Northeast Creek crossing is heavily wooded with pines, bays,
myrtles, and Chinese Privette. The creek is Estuarine Waters, regulated by the NC Division
of Marine Fisheries south of the Highway 24 Bridge, and Inland Waters, regulated by the NC
Wildlife Resources Commission north of the bridge. The Primary Nursery Area designation
extends to the bridge, and therefore encompasses the area under the railway. The waters are
classified SC HQW NSW, and a shellfish closure is in effect for the creek. The Jacksonville
Land Use Plan categorizes the property outside of Camp Lejeune as Developed, with all
AEC's classified as Conservation. The military property carries no Land Use Classification.
The existing timber trestle bridge allows for a 7'4" navigational clearance, with water depths
reaching to 11.5' NWL. The crossing is ±360' and the trestle is 10' in width. The portion of
the greenway that extends inland from the creek has been developed with input from several
agencies. This area received a DCM Consistency Determination, but did not require
permitting. The project in its entirety was reviewed under the SEPA process, and received a
FONSI on Sept 20, 2002.
The proposal is to convert the railway to a bicycle/pedestrian path. This will involve the
addition of stringers to the existing ties, and the placement of deck boards on the new
stringers. The width of the crossing will remain at 10', and the length at 360'.
Approximately every 10' there will be a single board extending the width of the deck plus
5'10" (called a deck extender)to which the handrail will be attached. Handrails will run the
length of the crossing on both sides. On the south side of the structure, there are two
overlook platforms proposed, each approximating 100 square feet in size.
The timber abutments of the existing bridge will require maintenance. This will involve a
disturbance of appr. 300 square feet of high ground, 185 square feet below normal water
level, and 1480 square feet in freshwater wetlands. After securing these structures, the
applicant proposes to place 45' of rock gabion on the south side of both the east and west

ends, and 35' of Class II Riprap on the interior sides. Filter cloth will be placed below the
riprap and a Reno mattress below the gabions. Both of these stabilization methods will
extend to a point approximately 4.5' below the NWL contour.
For a distance of ±85' to the east and ±65' to the west, an approach will be graded and
paved with asphalt. Like the bridge, the approaches will be 10' in width. This will result in
20% of impervious coverage within the Estuarine Shoreline.
10. ANTICIPATED IMPACTS:
As proposed, this project will cause 1770 sf of high ground disturbance, 800 sf of shallow
bottom filling, and 1480 sf of Section 404 Wetland disturbance. The incorporated area of
3800 sf of open water is a present impact, and only retrofitted with this proposal. The
intended use is for the general public. Navigation will not be impacted by this project.

new decking, 2 overlooks and railings. Some excavation and fill will take place for repair
of the endbents and for stream-bank stabilization.

3. Description and planned use of proposed project

operations of proposed project.
Purpose - Generally, this project consists of incidental paving and grading for the retrofit
of an existing timber railroad bridge to connect two sections of multi-use greenway trail.
Use -The completed project will be for use by the public for recreational activities
associated with the multi-use greenway trail.
Methods of construction - Methods of construction will be in compliance with NCDOT's
Standard Specifications for Roads and Structures, and in compliance with the proposed
plans. Generally, for the construction of a 10'-wide paved asphalt trail, to points
approximately 200' from the ends of the existing bridge, minimal clearing, grading and
paving will take place. In the vicinity of the bridge abutments, heavy equipment will be
used for excavation of debris and grading for the re-construction of portions of failed
timber abutments and installation of rock-filled gabion walls for streambank stabilization.
Decking and railing materials will either be stored on-site in disturbed areas as shown on
the plans, or stored off-site (at the contractor's discretion). Decking and railing will be
installed on the bridge according to the plans and specifications.
Daily Operations -When construction is complete and the greenway trail is opened for
use, the bridge and adjacent path will be used as for walking, bicycle and skating
transportation (alternative to gas powered vehicles), recreation and exercise. Users may
stop on the bridge to rest or fish.

STATEMENT OF COMPLIANCE WITH THE NC ENVIRONMENTAL POLICY ACT
(NCGS 113A-1 to 10)
The purposes of Article 113A are to " encourage the wise, productive, and beneficial use
of the natural resources of the State without damage to the environment, maintain a
healthy and pleasant environment, and preserve the natural beauty of the State; to
encourage an educational program which will create a public awareness of our
environment and its related programs; to require agencies of the State to consider and
report upon environmental aspects and consequences of their actions involving the
expenditure of public moneys or use of public land; and to provide means to implement
these purposes." (NCGS 113A)
For projects that make use of public funds or use of public lands that significantly affect
the quality of the environment of this State, the article requires a detailed statement
setting forth the environmental impact of the proposed project; mitigation measures;
alternatives to the proposed project; the relationship between the short-term uses of the
environment involved in the proposed project and the maintenance and enhancement of
long-term productivity; and any irreversible and irretrievable environmental changes
which would be involved in the proposed action should it be implemented.
The statement required by the Article has been addressed in the Environmental
Assessment (EA) and the Finding of No Significant Impacts (FONSI) prepared by the
Department of the Navy and the City of Jacksonville for the proposed project, and an
Environmental Impact Statement (EIS) is not required since "the proposed action will not
significantly impact the quality of the human environment.

In the area surrounding the existing endbents, stream bank failure has occurred. The
endbents will be repaired as part of the project and the streambank cleared of rip rap
and concrete debris (presumably placed in attempts to impede streambank scour and
failure) will be removed and the streambank stabilized with rock-filled, coated gabion
baskets dressed with vegetation.

abandoned railroad corridor, from US 17/Onslow Drive to Holcomb Boulevard, that crosses Sandy Run Branch,
Scales Creek, and an unnamed tributary to Scales Creek,Jacksonville,North Carolina.
Description of Activity: Discharge of fill material,permanently impacting a total of 0.18 acres,of waters of the
United States, including wetlands, 36 feet of streams,and 0.09 acres of excavation in wetlands,associated with for
construction of TIP Project No. E-3407 that consists of a 10-foot wide,asphalt multiuse Greenway trail, Onslow
County,North Carolina as described in HTTPS's letter and attached plans dated January 8,2003 and February 14,
2003. The proposed Greenway trail is generally located on an abandoned railroad bed. The trail will have 3'-5'
graded grass shoulders and includes a trail overpass bridge at NC 24. Undersized and damage storm water pipes will
be removed and replaced with either a new pipe or grass swale as described in the above reference letter. Fencing
for bicycle safety will be installed at select locations.

On April 16, 2002 , the undersigned inspected the Section 404 jurisdictional line as determined by the City of
Jacksonville and/or its representatives for the subject project. A select number of wetland sites were inspected for
the proposed project and all were found to accurately reflect the limits of Corps jurisdiction as shown on the
wetland maps submitted with HNTB letter dated April 25, 2002. The Corps believes that this jurisdictional
delineation can be relied on for planning purposes and impact assessment.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Rails to Trails on June 26, 2003, Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H .1000. We are forwarding
Permit No. SW8 030328 dated July 9, 2003, for the construction of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be
subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-

North Carolina as amended, and other applicable Laws, Rules and Regulations

construction of a public road / bridge in compliance with the provisions of 15A NCAC 2H
1000 (hereafter referred to as the "stormwater rules") and the approved stormwater
management plans and specifications, and other supporting data as attached and on
file with and approved by the Division of Water Quality and considered a part of this
permit.
The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
�. OVSIGN STANDARDS
1 . The runoff from the impervious surfaces of the proposed bike path has been
directed away from surface waters as much as possible.
2. The amount of built-upon area has been minimized as much as possible. The
trail is located on top of an old railroad bed, and the overall amount of impervious
area within the watershed is reduced by 2.5 acres.
3. Best Management Practices are employed which minimize water quality impacts.
4. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
5. Vegetated roadside ditches have 3:1 slopes or flatter. In wetland areas, the
slopes are steeper (up to 2:1) to minimize wetland impacts.
II. SCHEDULE OF COMPLIANCE
1 . The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction for the
following items:
8. Major revisions to the approved plans, such as road realignment, deletion
of any proposed BMP, changes to the drainage area or scope of the
project, etc.
b. Project dame change.
c. Redesign of, addition to, or deletion of the approved amount of built-upon
area, regardless of size.
d_ Alteration of the proposed drainage.

2. The permittee shall at all times provide adequate erosion control measures in
conformance with the approved Erosion Control Plan.
3. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
4, Toe Director may determine that other revisions to the project should require a
modification to the permit.
5. The Director may notify the permittee when the permitted site does not meet one .
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time,schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
Ill. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue to force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The i ssuance of t his p ermit does n of p rohibit the Director f rom reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval
by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. A formal permit request must be submitted
to the Division of Water Quality accompanied by the appropriate fee,
documentation from both parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits, and
may or may not be approved. The permittee is responsible for compliance with
the terms and conditions of this permit until such time as the Director approves
the transfer.
6. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal) which have jurisdiction.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The foIIowing italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions,butparcels and future development prior to the sale of any lot. If lot sizes vary significantly,a table
listing each lot number,size and the allowable built-upon area for each Iot must be provided as an attachment.
I. The fallowing covenants are intended to ensure ongoing compliance with state stormwater management pennit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.

Impervious materials include asphalt,gravel,concrete,brick,stone,slate or similar material but do not inchide wood
decking or the water surface of swimming pools.

old Seaboard Coast Line Railway to a pedestrian/bike path crossing Northeast Creek in

additional time is needed for this office to complete the review and make a decision on your
request. Therefore, it is necessary that the standard review time be extended. An additional 75
days is provided by G.S. 113A-122(c) which would make August 15, 2003 the new deadline for

Dear Mr. Hagan:
The Wilmington Regional Office received a Stormwater Management Permit
Application for Rails to Trails Project on March 31, 2003. A preliminary review of that
information has determined that the application is not complete, The following
information is needed to continue the stormwater review;
1. Please either delineate all wetlands on site, disturbed or undisturbed, or
note on the plans that none exist,
2. The narrative indicates that slopes have been made steeper than 31 in
areas where impacts to existing ditches or wetlands can be avoided.
However, the bike trail details on sheet 2 show only a varying slope for fill
sections, The side slopes for ditches in cut are 2:1, with no variance. The
stormwater rules require swale & ditch slopes to be 3:1. Please revise the
detail to reflect this, where it is possible. When you revise sheets, please
send in two copies of the revised sheets, and I will substitute them Into the
plan sets already submitted.
3. it was not necessary to provide all of that drainage area information. For
low density projects, the drainage area is just the area of the project itself,
i.e,, the right-of'way in this case. If the project had been high density, and
runoff from the offsite areas was entering the system, then the drainage
area information you provided would be pertinent. Please revise the
application form to report just the project area of the trail itself, and the
built-upon area within the project area, and report these numbers in one
column and in square feet on the application.
4. The narrative also indicates that the trail width varies from 10'-14' in
certain substandard curve locations but the typical sections on sheet 2 do
not reflect this. Please add a typical section to show this and list the
stations where the section applies.

The applicants' property is located within the City of Jacksonville crossing the Northeast
Creek with the existing Seaboard Coast Line railway trestle south of the Highway 24
Bridge. This phase of the Rails to Trails program is the conversion of the old Seaboard
Coast Line Railway Bridge to a pedestrian path and a bike path.
Areas of Environmental Concern (AEC's) impacted by the proposal are Public Trust
Areas and Estuarine Waters. Waters at the project site are classified as SC HQW NSW
and are not open to the harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1996 City of Jacksonville Land
Use Plan Update and offer the following comments.
The general area of the project is classified as Developed,while the AECs impacted by
the work are classified as Conservation.
In general, the City of Jacksonville Land Use Plan Update allows development in
Conservation classified AECs which is consistent with the State's minimum use
standards.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the 1996 City of Jacksonville Land Use Plan Update.

The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. A site visit was made on April 28, 2003. Our comments are
provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100
through 113A-128).
Jacksonville proposes to convert an old train trestle into part of a pedestrian/bike trail
following a Greenway through the City. The project requires stabilization of the trestle abutments
at each end using riprap and gabions. Disturbed 404 wetlands occur in the vicinity of the
abutments. Area waters are classified SC HQW NSW and designated Primary Nursery Area.
The project would fill 0.03 acre of disturbed 404 wetlands and involve an even smaller
area(0.02 acre) of shallow bottom filling. Though small in area, the in-water work could elevate
turbidity in very sensitive surface waters. While we wholeheartedly support the project and
appreciate this and the City's other recent conservation initiatives, we must recommend that the
work avoid the April 1 to September 30 period of peak biological activity or be contained within
turbidity curtains.

Dear Mr. Ellzey:
You have our approval, in accordance with the attached conditions(WQC # 3400)to conduct the
following activity at your property located in the City of Jacksonville, Onslow County. This approval
allows you to:
1). Impact 800 square feet of open water and 1480 square feet of wetlands while performing
maintenance to the timber abutments of the existing bridge. The impacts include the installation
of 45' of rock gabion on the south side of both the east and west ends, and 35' of rip rap on the
interior sides.
This approval is only valid for the purpose and design that you described in your CAMA application
received by the Division of Water Quality (DWQ)on March 31, 2003. After reviewing your application,
we have determined that General Water Quality Certification Number 3400 covers this activity. This
Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues
it. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your
project, such as(but not limited to) Sediment and Erosion Control,Non-Discharge and Water Supply
Watershed regulations and Coastal Stormwater. In addition,this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your CAMA Major
Permit application received by the Division of Coastal Management on March 18, 2003. If you change or
modify your project, you must notify the Division(DWQ) in writing and you may be required to send us a
new application for a new certification. If the property is sold,the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project(now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506(h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1). The attached Certificate of Completion (COC)must be submitted to the Division upon final
construction of the site,

outlined in the most recent version of the"North Carolina Sediment and Erosion Control
Planning and Design Manual' or the "North Carolina Surface Mining Manual" (available from
the Division of Land Resources in the DEHNR Regional or Central Offices)shall be properly
implemented.
Please notify this Office at the number listed below if any problem arises during the construction of the
project that may affect water quality.
If you do not accept any of the conditions of this certification,you may ask for an adjudicatory

The following are my comments and recommendations regarding the aforementioned proposal:
The proposal is for the conversion of an existing railway crossing to a bicycle/pedestrian trail. The
impacts from this project are minimal, and most exist currently. This is a positive use of existing
impacts, a "recycling" of impacts. I recommend this project be authorized as proposed, contingent
upon the following conditions:
1) No excavated or fill material will be placed at any time, in any vegetated wetlands/marsh or
surrounding waters, outside of the alignment of the fill area indicated on the work plats.
2) The riprap will not extend waterward more than 5 feet from the normal water level.
3) The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite
or broken concrete.
4) In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
5) The finished grade of the approaches within 30' of the trestle must decline landward such that
stormwater runoff velocity is not increased to the surface waters of the creek.

permit decision. Later comments will be accepted and considered up to the time of permit decision.
Project modification may occur based on review and comment by the public and state and federal
agencies. Notice of the permit decision in this matter will be provided upon written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of City property located adjacent to and over Northeast Creek in the location of
the Seaboard Coast Line Railway. It was received completed on March 18, 2003, and appears to be
adequate for processing at this time. The projected deadline for making a decision is May 31, 2003. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Falure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
