Authorizing development in Dare County inshore Hatteras Inlet, w/i the area known as
Channel North
, as requested in the permittee's application dated
5/21/24 (PA-1416), including the attached workplan drawings (4) as referenced in Condition No. I below.
This permit, issued on July 16, 2024 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1) Unless specifically altered herein, all development shall be carried out in accordance with the
attached narratives and workplan drawings (4);
a. The narrative dated 5/20/24, including workplans Sheet 15 of 28 and Sheet 29 of 29 both
dated "Revised 5/9/24";
b. The addendum dated 6/25/24, including Figure I located within the addendum and Sheet
1 dated 4/3/24. [07J .0202(c)]
2) Unless specifically altered herein, this Minor Modification authorizes the maintenance of the dredge
corridor known as the "Sloop Channel Emergency Route", all as expressly and specifically set
forth in the attached narratives and workplan drawings. Any additional development activities may
require a modification of this permit. [07H .0207(d); 07H .0208(a)(1)]

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 15, 2028
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No excavation shall take place outside of the area indicated on the workplan drawings. [07H
.0208(b)(1)]
4) Excavation shall not exceed -8 feet plus 2 foot over dredge, below the mean lower low water level
(MLLW). In no case shall the depth of excavation exceed the depth of connecting waters. [07H

5) All disposal of excavated materials outside of the previously authorized nearshore disposal areas, shall
take place entirely within the area shown as "Hatteras Inlet Flood Channel Open Water Placement
Area A", as indicated on the attached workplan, Sheet I dated 4/3/24. Any disposal outside the
authorized disposal location shall require a permit modification. [G.S. 113-229(e); 07H .0207(d); 07H

6) The permittee shall conduct post -deployment bathymetric surveys of the "Hatteras Inlet Flood
Channel Open Water Placement Area A" to confirm that work did not result in post -disposal
elevations shallower than -12 feet at MLLW. The surveys shall be provided prior to quarterly progress
meetings. Post -disposal depths shallower than -12 feet at MLLW shall be reported to DCM immediately.

7) No attempt shall be made by the permittee to prevent the fill and free use by the public of all navigable
waters at or adjacent to the authorized work. [07H .0208(a)(2)(G)]
8) The permitted activity shall not cause an unacceptable interference with navigation and shall not exceed
the dimensions shown on the attached permit drawings. [07H .0208(a)(2)(G)]
9) In accordance with commitments made by the permittee, the adjacent waters shall be monitored to
determine if the open water disposal within the "Hatteras Inlet Flood Channel Open Water
Placement Area A" is increasing shoaling rates within those adjacent waters. Any monitoring reports
submitted to the U.S. Army Corps of Engineers shall be provided to the Division of Coastal
Management. [07J .0202(c)]
NOTE: in order to reduce potential for increased turbidity within the estuarine waters of Hatteras Inlet,
the permittee is encouraged, but not required to, dispose of dredge material within the "Hatteras
Inlet Flood Channel Open Water Placement Area A" on outgoing tides.
General
10) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location. [07J
.0209(a); G.S. 113A-120(b)]
11) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation. [07J .0209(a)]

NOTE: This Minor Modification shall be attached to the original PermitNo. 147-23, which was issued
to the permittee on 12/15/23, as well as all subsequent modifications, refinements, and renewals,
and copies of all documents must be readily available on site when Division personnel inspect
the project for compliance.
12) All conditions and stipulations of the active permit remain in force unless specifically altered herein.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID SAW-2023-01122.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2013-1279 v9.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
