considerations in hand paid by the parties of the second part to the parties of the first

BEGINNING at a point marked by an set iron rod situated on the Southern
right of way of Dances Bay Road (formerly known as Oak View Drive 60
foot right of way) at the Northeast corner of Lot 203 of Dances Bay
Colony as shown and delineated on that certain map or plat thereof,
recorded in Map Book 4, Page 45, at the Pasquotank County Registry,
which point is further located South 260 45' 05" East distance of 20.61
feet from a PK nail in the southern margin of the paved portion of Dances
Bay Road; running thence from said point of beginning along the said
Southern right of way of Dances Bay Road North 670 04' 00" East a
distance of 150 feet to an set iron rod, cornering; running thence South
220 56' 00" East a distance of 196.88 feet to a set PK nail, cornering;
running thence South 71 ° 17' 42" West a distance of 2.33 feet to a point
in a wood bulkhead, cornering; running thence South 230 34' 11" East a
distance of 4.40 feet to a point situated in said wood bulkhead on the
Northern shore of a Canal, cornering; running thence along said wood
bulkhead and Northern shore of a Canal South 680 52' 28" West a
distance of 80. 70 feet to a point; continuing thence along said wood
bulkhead and Northern shore of a Canal South 68041' 52" West a distance
of 65.47 feet to a point, cornering; running thence North 200 58' 44" West
a distance of 6.88 feet to a point, cornering; running thence South 780 56'
26" West a distance of 1.89 feet to an existing iron rod (bent), cornering;
running thence along the Eastern boundary line of said Lot 203 North 220
56' 00" West a distance of 189.43 feet to a set iron rod marking the

POINT OF AND PLACE OF BEGINNING together with all water and riparian
rights running with or connected to the title of said land in and to the
Canal adjoining the above described property. Being the same tract or
parcel of land as shown and delineated on that certain survey prepared by
Brant L. Wise, P.L.S., of McKim & Creed, under date of December 12,
2001, entitled in part "Lot Survey For Rex and Connie Sloan", which
survey is incorporated herein by reference and recorded in Deed Book
707, Page 329 of the Pasquotank Registry.
For further description and chain of title, see deed to Charles F. Sawyer
and wife, Trisha B. Sawyer, dated January 20, 2022 and recorded in Deed
Book 1440, Page 80, of the Perquimans County Public Registry.
Pursuant to NCGS §105-317.2, the property herein described does not include
the primary residence of the grantor.
TO HAVE AND TO HOLD the aforesaid lands with all rights and privileges
thereunto belonging or in anywise appertaining unto the said parties of the second part
and their heirs and assigns, in fee simple forever.
And the said parties of the first part for themselves, their heirs and personal
representatives covenant to and with the said parties of the second part and their heirs
and assigns, that they are seized of said lands in fee simple and have a good right to
convey the same in fee simple; that the said lands are free and clear of all
encumbrances, SAVE AND EXCEPTING rights of ways for highways and public utilities
and ad valorem taxes for the current year and subsequent years, and that they will
forever warrant and defend the title to the same against the lawful claims of all persons
whomsoever.
