DECLARATION OF OWNERSHIP

THIS DECLARATION is made this � day of July 2024, by WALTER J.
MOORE, III, TRUSTEE, or his successors in interest, of the WALTER JOSEPH
MOORE, III REVOCABLE TRUST dated November 11, 2019, and any amendments
thereto (hereinafter "Moore"), whose address is 2162 Salmon Road, Corolla, North
Carolina 27927.
WITNESSETH:
WHEREAS, certain real property exists and is located in Carova, Currituck
County, North Carolina and more particularly described as "Carova Beach, Section 5" as
shown on that plat recorded in Plat Book 2, Page 139 of the Currituck County Public
Registry, which plat was recorded in 1968;
AND WHEREAS, the above -referenced plat depicts certain lots and streets/roads
within Section 5 of the Carova Beach subdivision, namely Shark Lane for the purposes of
this Declaration;
AND WHEREAS, Moore is the owner of Lot 29 in Block 4A of Section 5,
Carova Beach subdivision (hereinafter "Moore Lot 29) and Lot 58, Block I of Section 5,
Carova Beach subdivision (hereinafter "Moore Lot 58), which lots are bisected by a small
stub of Shark Lane that extends from the eastern most corners of Moore's lots to a canal
within Carova Beach subdivision;
submitted electronically by "Sharp, Graham, Baker A varnell, LLP"
in compliance with North Carolina statutes governing recordable documents
and the terms of the submitter agreement with the Currituck county Register of Deeds.

AND WHEREAS, said portion of Shark Lane was dedicated to public use as a
road/street on the plat referenced directly above;
AND WHEREAS, said portion of Shark Lane has not been actually opened or
improved in any manner by the developers of Carova Beach, or any public entity, nor
used by the public within fifteen (15) years after the dedication referenced herein;
AND WHEREAS, said portion of Shark Lane is not necessary to afford
convenient ingress or egress to any lot or parcel of land sold and conveyed by Carova and
Ocean Sands;
AND WHEREAS, said portion of Shark Lane is not part of a future street shown
on a street plan adopted pursuant to N.C.G.S. 136-66.2;
AND WHEREAS, as a result, said portion of Shark Lane, which portion runs
from the southeastern corner of Moore Lot 29 and the northeastern corner of Moore Lot
58 in a westerly direction to the 100' Easement for Canal shown on the plat referenced
directly above, is conclusively presumed to have been abandoned by the public for the
purposes for which it was dedicated, meaning no person(s) or entities shall have any right
or cause of action to enforce any public or private easement in the land.
NOW THEREFORE, in order to comply with applicable North Carolina law,
Moore is entering this Declaration in order to give legal effect to the withdrawal of the
portion of Shark Lane, as more particularly described herein, from dedication for public
use.
TERMS:
Moore acknowledges the accuracy of the recitals contained within this
Declaration as set forth directly above.
2. Pursuant to North Carolina law, the portion of Shark Lane running from the
southeastern corner of Moore Lot 29 and the northeastern comer of Moore Lot
58 in a westerly direction, terminating at the 100' Easement for Canal shown
on the plat recorded in Plat Book 2, Page 139 of the Currituck County Public
Registry, is conclusively presumed to have been abandoned by the public for
the purposes for which it was dedicated, meaning no person(s) or entities shall
have any right or cause of action to enforce any public or private easement in
the land.
3. Moore enters this Declaration for the purpose of expressing his intention to
claim and accept ownership of the portion of Shark Lane, which is being
withdrawn from dedication, as said portion is more particularly described
herein.

4. As a result of the recordation of this Declaration, Moore is conclusively
established as the owner of the portion of Shark Lane, which is being
withdrawn from dedication, as said portion is more particularly described
herein.
5. This document shall have the same effect as a quitclaim deed, thereby
conveying title of the portion of Shark Lane, which is being withdrawn from
dedication, as said portion is more particularly described herein, to the
WALTER JOSEPH MOORE, III REVOCABLE TRUST dated November 11,
2019.
