The general permit does not have an application associated with it, you just have to notify
the adjacent property owners and provide us either the signed form that Yvonne
provided, or proof of notification via certified mail as described on the second page.
As far as the northern ARPO, if the property at 303 Queen Elizabeth Ave extends to the
bulkhead, then that owner would be the one to notify.

Also, SAGA is the adjacent owner to the south. Would you determine that NC DOT is the adjacent owner
to the north because of the bridge?

Upon review of the updated drawing, I note that the proposal is for the existing bulkhead to
remain, with a new bulkhead installed.
Installation of a replacement bulkhead up to 2' waterward of the existing wall would require a
general permit. As part of the permitting process, riparian notifications would have to be
completed. I have attached a copy of our Notice Form, Agent Form (in case you use Delucia
or Northeastern Marine to act on your behalf to obtain the permit) and a copy of the
applicable rules regarding a bulkhead permit.

Dear Yvonne,
You will recall that we received an exemption letter for repairs to be made to the Town's boardwalk in
April. We have contracted with Northeastern Marine Construction to replace the boardwalk. When Mr.
Owens demolished the boardwalk, itwas apparent that the existing conditions of the bulkhead were
contributing to the disrepair of the boardwalk. A picture of those existing conditions is attached.
We have temporarily paused the work on the boardwalk so that we can get the Board of
Commissioners to authorize work to repair the bulkhead as a second project.
Mr. Delucia has prepared updated plans that are attached to this email along with the first set of plans
he did so that you have both for comparison.
Would you consider this work to fall under the exemption rule as well?
We hope to have the Board approve this work tomorrow evening.

Dear Ms. Dickerson:
I have reviewed the information submitted on behalf of the Town of Manteo by John DeLucia of
Albemarle & Associates regarding the necessary filing of an application for a general permit
under the Coastal Area Management Act. Based on my site visit conducted on March 26, 2024,
and the documentation submitted, it has been determined that the activities proposed are
exempt from needing a development permit as long as they remain consistent with the
documentation dated received via email on March 19, 2024, and meet the conditions specified
below. If your plans should change and your project will no longer meet these conditions,
please contact me before proceeding.
MAINTENANCE AND REPAIR:
[G.S. 113-103(5)(B)(5) and 15A NCAC 7K.0103(a)] - Maintenance and repairs (excluding
replacement) necessary to repair damage to structures caused by the elements are specifically
excluded from the definition of development under the conditions and in the circumstances set
out in G.S. 113A 103(5)(b)(5).
15A NCAC 07J .0210(2)(a) WATER DEPENDENT STRUCTURES. The proposed work is
considered replacement if it enlarges the existing structure. The proposed work is also
considered replacement if: (a) in the case of fixed docks, piers, platforms, boathouses, boatlifts,
and free standing moorings, more than 50 percent of the framing and structural components
(beams, girders, joists, stringers, or pilings) must be rebuilt in order to restore the structure to its
pre -damage condition. (c) in the case of bulkheads, seawalls, groins, breakwaters, and
revetments, more than 50 percent of the linear footage of the structure must be rebuilt in order
to restore the structure to its pre -damage condition.

The repairs are limited to the following conditions:
1. Repair/replacement of ±150'x12' boardwalk (outboard piles, girders, joists, and
decking)
2. Replace tiebacks along existing vinyl bulkhead landward of the boardwalk to be
repaired.
3. No expansions of footprint are permissible.
4. The proposed repairs shall be consistent with all other applicable local ordinances
and North Carolina Building Code standards.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining
any other State, Federal or Local authorization and NC Building Permits. This exemption
expires 120 days from the date of this letter.
