Permit Class Permit Number NEW 176-03 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Henry & Tina Kirby, 608 Sara Lawrence,Raleigh,NC 27609 Authorizing development in Pender County at adi.manmade canal off Banks Channel/Tovsail Sound, 128 McLeod Ave..Topsail Beach , as requested in the permittee's application dated 9/9/03.including the attached workplan drawing (1), dated 9/8/03. This permit,issued on December 5,2003 , is subject to compliance with the application(where consistent with the permit),all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Jet Ski Lift 1) This permit authorizes only the new jet ski lift at the existing docking facility, creating a third slip, located in or over the water that is expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) The authorized structure and associated activity must not cause an unacceptable interference with navigation. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. Signature of Permittee -------------------- Henry & Tina Kirby Permit#176-03 ' Page 2 of 2 ADDITIONAL CONDITIONS 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized jet ski lift shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor 6) The permittee will maintain the authorized structure in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a 1-slip expansion bringing the total number of slips for the permitted docking facility to 3. At no time shall more than 3 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 031405. Henry and Tina Kirby Page Two 9. PROJECT DESCRIPTION The applicant's property is located at 128 McLeod Avenue,in the Town of Topsail Beach,in Pender County. The property is located adjacent to the man-made canals on the south end of Topsail Island adjacent to Banks Channel/Topsail Sound. To get to the project site,travel to the end of South Anderson Blvd. in Topsail Beach,turn left onto Trout Avenue. At the end of Trout Avenue,turn right onto Ocean Blvd,travel approximately 0.1 mile on Ocean Blvd. and turn right onto McLeod Avenue, 128 McLeod Avenue is on the left. The highground property consists of a single-family-residential lot measuring approximately 90'deep and approximately 60'wide. The elevation of the property is approximately 5 feet above normal high water. The existing highground development on the property includes a single-family dwelling and driveway. The yard consists of sparse lawn grasses and a few ornamental shrubs. In addition,there are several wax myrtles(Myrica cerifera)adjacent to the bulkhead and a red cedar(Juniperus virginiana)under the stairway. The property shoreline(southern side)is stabilized with approximately 60'of vertical bulkhead. The width of canal in front of the applicant's property is approximately 160'. In this area of the southern canals,the bulkhead is also the normal high water line. The applicant has a concrete header across the top of the bulkhead. An existing 8' by 12' platform extends waterward parallel to the bulkhead. A 4' wide walkway adjacent to the platform,to the west, accesses the 8' X 16' float waterward of the platform. On the western side of the float/platform/walkway is a 13' X 13' boatlift. Currently,this structure could provide docking space for up to two vessels. The waters adjacent to the project are classified as SA by the Division of Water Quality. The area is not designated a Primary Nursery Area and is open to the taking of shellfish. The applicant is proposing to add a single pole jet-ski lift on the eastern side and landward of the floating structure. The project as proposed would provide docking space for up to three vessels. The proposed jet- ski lift would have approximately 2.0'of water depth at low tide. 10. ANTICIPATED IMPACTS The proposed jet ski lift would result in the incorporation of an additional 24 square feet of public trust area. This permit authorizes only the addition of the 4 by 6'jet ski lift that is expressly and specifically set forth in the permit application.
