This permit, issued on September 17,2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Residential Development & Retaining Wall
1) This permit authorizes only the filling of 404 wetlands, construction of a single-family residential
structure, a gravel driveway and retaining wall that are expressly and specifically set forth in the permit
application and depicted on the attached workplan drawings.
2) The alignment of the permitted retaining wall must be approved by a representative of the Division of
Coastal Management prior to the start of any construction.
3) The retaining wall must be constructed prior to any backfilling activities.
4) The retaining wall must be structurally tight so as to prevent seepage of backfill materials through the
structure.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the

ADDITIONAL CONDITIONS
5) The retaining wall must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except for that
which may be required for the construction of the retaining wall deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
6) In order to avoid unreasonable danger to life and property, all development shall be designed and placed
so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm.
Cantilevered decks and walkways shall meet this standard or shall be designed to break-away without
structural damage to the main structure.
7) Any building constructed shall comply with the North Carolina Building Code and the local flood
damage prevention ordinance as required by the National Flood Insurance Program.
8) All building in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or
eight inches to a side if square.
9) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under
the structure.
NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive
requirements than the Division's standards for development in areas of environmental concern
(AECs).
10) All fill material will be clean and free of any pollutants except in trace quantities.
11) All fill material will be obtained from a high ground source and confined behind the permitted retaining
wall.
12) All fill materials will be confined above mean high water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters.
13) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill
area indicated on the workplan drawings.
14) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
15) The permitted activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside of the area of construction or construction-related discharge. Increases such that the
turbidity in the waterbody is 25 NTU;s or less in all saltwater classes are not considered significant.
Sedimentation and Erosion Control
16) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.

ADDITIONAL CONDITIONS
17) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Stormwater Management
19) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under StormWater Permit No. SW8030614 on 8/5/03. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
Water Ouality
20) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality
Certification No. 3402 (DWQ Project No. 030614), which was issued on 5/29/03. Any violation of the
water quality certification issued by the DWQ will be considered a violation of this CAMA permit.
General
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 395-3900 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
No. 18 (COE Action Id. No. 200300734) which was issued on 5/13/03.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your pen-nit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit,you will be helping to protect our vitally important coastal resources.

8. PROJECT SUMMARY: The applicant proposes to clear and grade his residential lot for the purpose of
constructing a single-family residence and driveway. The propose fill area
includes a 0.011 ac(460 sq ft)of Section 404 wetlands. The applicant also
proposes to build a retaining wall to keep the fill in place on the wetlands and fill
and even out his lot on the high ground potion.

9. PROJECT DESCRIPTION
The applicant's property is located at 1321 N.New River Drive,in the Town of Surf City,in Pender County. The
property is located adjacent an unnamed tributary to Topsail Sound. The closest intersection to the project site is
NC Highway 210 and Lenoir Avenue,approximately 1.7 miles north of the intersection of NC Highway 50 and
NC Highway 210(Surf City stop light).
The property is a residential lot. The property'survey shows a single-family-residential lot measuring
approximately 200'deep and approximately 50'wide with a small wetland finger encroaching into the high ground
area and that approximately half of the lot is 404 wetland and coastal marsh. The applicant has already received a
401 Certification from the NC Division of Water Quality for the project(DWQ#03-0614)and a Corps of
Engineers Nationwide 18 for the project(ID#200300734). The DWQ Stormwater permit is in review at this time
(SW803614). The survey also shows the elevation of the property to be approximately 5 feet above normal high
water on the upland side. The upland section of the lot is fairly flat and is primarily a cleared lot. The upland
vegetation on site consists of one approximately 15' tall live oak(Quercus virginiana)surrounded by some small
ones on the northeast corner of the lot. Additional vegetation includes beach pea(Strophostyles helvola),catbriar
(Smilax sp.),poison ivy(Toxicodendron radicans),common ragweed(Ambrosia artemisiifolia),virginia creeper
(Parthenocissus quinquefolia), grape vines(Vitis sp.),peppervine(Ampelopsis arborea)and small hills of sea oats
(Uniola paniculata).
The waterward portion of the lot consists of 404 wetlands ranging in width from approximately 5' on the southern
portion of the lot to approximately 15' in width on the northern portion. The vegetation within the 404 wetlands
consists of marsh elder(Iva frutescens),wax myrtle(Myrica cerifera),marsh pennywort(Hydrocotyle umbellata)
and briars(Rubus sp). The remainder of the lot is coastal marsh consisting mostly of black needle rush(Juncus
roemerianus)with a small stand of cattails(Typha sp.). The coastal marsh delineation on the survey plat was not
done by a Division of Coastal Management field representative and therefore is not a valid line. Based on site
investigations,the proposed retaining wall and wetland fill will be located landward of coastal wetlands.
The waters adjacent to the project are classified"SA"by the Division of Water Quality. The area is a designated
Primary Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish as a conditional
shellfish harvesting area.
PROPOSED PROJECT: The applicant is proposing to fill a 0.011 ac of Section 404 wetlands,build a retaining
wall across the back of the lot to retain the fill and construct a single-family residence and driveway. The project is
located within a high hazard flood zone,which is one of the Division of Coastal Management's Areas of
Environmental Concern(AEC), and requires a CAMA major permit due to the filling of 404 type wetlands within
this AEC. All work proposed is outside the 30' buffer and the 75' Estuarine Shoreline AEC
The applicant is proposing to construct a private two-story residence with a footprint of approximately 28' X 36' in
size. He is also proposing covered decks on the western and easternmost sides of the house to be 6' X 28' in size
and an uncovered deck on the southernmost side to be 6' X 48' in size. The proposed driveway for the residence is
to be 28' wide by 32' long(6' X 28"is covered by deck). The proposed retaining wall/bulkhead will have 5'
lengths of 6"X 6"posts with 3' in the ground and 2' above ground. The wall will be built with 2"X 10"boards
parallel to the ground to retain the fill material.
10. ANTICIPATED IMPACTS
The proposed project will result in the filling of 0.011 ac(460 sq f3)of Section 404 wetlands and the entire
disturbed area would be approximately 4475 sq ft that will include the wetland fill,house construction, driveway
and subsequent landscaping. No coastal marsh will be impacted.

Recommendations for State Permit—William J. Knowles,Jr.
The applicant has already received the 401 certification from DWQ and a NW 18 from the Corps of Engineers for
the wetland fill. It is recommended that a permit be issued. The following conditions are recommended:
1. Future development on the permitee's property may require a modification of this permit or a CAMA
Minor permit. Contact a representative of this Division at(910)395-3900 prior to commencement of any
such activity for this determination.
2. In order to protect water quality,runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
3. All disturbed areas shall be vegetatively planted and mulched within fourteen days of construction
completion.
4. The construction of the proposed project shall be in compliance with all local, State and Federal
regulations and associated permit conditions.
5. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third-party.
6. All work is to be done outside the 30-foot CAMA buffer.
7. Applicant must contact DCM at least 30 days prior to bulkhead/retaining wall construction to allow the
alignment for the Bulkhead/retaining wall to be staked.

This will be a frame constructed single family seasonal dwelling
that will be not more than 28 feet by 36 feet two story dwelling.
There will be an uncovered deck on the first floor of 6 feet by 48 feet.
There will be decks of 6 feet by 28 feet on both floors on the sound side
with the deck on the second floor covered with a roof extending from the house
There will be decks of 6 feet by 28 feet on the ocean side, that will
extend over the concrete or rock driveway, on both floors with the deck
on the second floor being covered with a roof extending from the house.
The entire driveway will be 28 feet by 32 feet and 6 feet of that will
be under the decks on the ocean side making the exposed driveway
28 feet by 26 feet.
There will be a retaining wall on the property as shown on the survey
dated 07-24-03 and attached to this project description.
We plan to backfill with fill dirt on the ocean side of the retaining
and up to the retaining wall to level out the yard.

The applicant proposes to clear and grade his lot;construct a retaining wall; and construct a single-family
residence and driveway. This project is consistent with the Town of Surf City 1992 Land Use Plan
Update(LUP)provided all local,state and federal regulations are met.
The proposed development will be located in the Town of Surf City at 1321 N. New River Drive. The
single-family residence will be located within the High Hazard Flood Area-Area of Environmental
Concern (AEC). Approximately 0.11 acres of"404"wetlands will be filled in conjunction with clearing
and grading. All site work will occur outside of the 30-foot estuarine shoreline buffer and the 75-foot
Estuarine Shoreline AEC. Adjacent waters are classified SA,and are conditionally open to shellfishing.
Waters are designated as Primary Nursery Area(PNA).
The LUP land classifications for this site are Developed(uplands)and Conservation(High Hazard Flood
Area AEC and"404"wetlands). The purpose of the Developed land classification is to allow for
residential development where urban services are provided. The purpose of the Conservation classification
is to provide for the effective long-term management and protection of significant,limited or irreplaceable
areas. LUP Policy 13(4)(b)(6)states: Land uses in flood hazard areas shall be those permitted by the
Town Zoning Ordinance, which shall include residential, commercial and institutional;provided,
however, that all new construction shall meet requirements of the Surf City Flood Damage Prevention

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules and Regulations,
PERMISSION IS HEREBY GRANTED TO

construction of a single family residence in compliance with the provisions of 15A NCAC
2H.1000 (hereafter referred to as the "stormwater rules") and the approved stormwater
management plans and specifications, and other supporting data as attached and on file with and
approved by the Division of Water Quality and considered a part of this permit for Knowles
House.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specific conditions and limitations:
I. DESIGN STANDARDS
1. The built-upon area has been minimized as much as possible.
2. The approved Erosion Control plan will be followed.
3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.
4. No new stormwater piping shall be allowed except that minimum amount necessary to
direct runoff beneath an impervious surface such as a road and that minimum amount
needed under driveways to provide access to lots.
5. A 30'vegetated buffer area must be maintained between all impervious areas and surface
waters.
6. Roof drainage is not allowed to be piped directly to the receiving stream. All roof drains
must terminate at least 30'from the mean high water mark.

II. SCHEDULE OF COMPLIANCE
1. The permittee shall at all times provide adequate erosion control measures in
conformance with the approved Erosion Control Plan.
2. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
3. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction for the following items:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign of, addition to or deletion of the approved amount of built-upon area,
regardless of size.
e. Further subdivision of the project area.
f. Alteration of the proposed drainage.
4. The Director may determine that other revisions to the project should require a
modification to the permit.
5. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance, or termination does not
stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying
the permit, revoking and reissuing the permit, or terminating the permit as allowed by the
laws, rules, and regulations contained in Title 15A of the North Carolina Administrative
Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of the
permit to change the name and incorporate such other requirements as may be necessary.
A formal change of ownership request must be submitted to the Division of Water
Quality accompanied by appropriate documentation from both parties involved, and other
supporting materials as may be needed. The approval of this request will be considered
on its merits, and may or may not be approved. The permittee is responsible for
compliance with the permit conditions until such time as the Director approves the
transfer.

6. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state and federal) which have jurisdiction.
7. The permittee grants permission to DENR Staff to enter the property for the purpose of
inspecting the project.
8. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

Dear Mr. Knowles:
You have our approval, in accordance with the attached conditions, to impact 0.001 acres of coastal
wetlands for the purpose of residential construction at Lot# 19, Block B,Del Mar Beach as you
described in your application dated May 5, 2003. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3402, which may be viewed on
our website at http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use Nationwide -
Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a
new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding
Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to
be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
Conditions of Certification:
1. Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached form and
return it to the 401/Wetlands Unit of the Division of Water Quality.
2. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional
wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order
to assure compliance for future wetland and/or water impact. These mechanisms shall be put
in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later). `

if this agency does not render a permit decision within 70 days from the July 29, 2003 date,you may request a

owner, developer, and project designer/consultant.
NCGS I I3A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.
