This permit, issued on September 17,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Residential Development & Retaining Wall 1) This permit authorizes only the filling of 404 wetlands, construction of a single-family residential structure, a gravel driveway and retaining wall that are expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. 2) The alignment of the permitted retaining wall must be approved by a representative of the Division of Coastal Management prior to the start of any construction. 3) The retaining wall must be constructed prior to any backfilling activities. 4) The retaining wall must be structurally tight so as to prevent seepage of backfill materials through the structure. Knowles,Jr. Permit#131-03 Page 2 of 3 ADDITIONAL CONDITIONS 5) The retaining wall must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the retaining wall deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 6) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break-away without structural damage to the main structure. 7) Any building constructed shall comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. 8) All building in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or eight inches to a side if square. 9) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). 10) All fill material will be clean and free of any pollutants except in trace quantities. 11) All fill material will be obtained from a high ground source and confined behind the permitted retaining wall. 12) All fill materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 13) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawings. 14) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 15) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU;s or less in all saltwater classes are not considered significant. Sedimentation and Erosion Control 16) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. AV William J. Knowles,Jr. Permit#131-03 Page 3 of 3 ADDITIONAL CONDITIONS 17) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Management 19) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under StormWater Permit No. SW8030614 on 8/5/03. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. Water Ouality 20) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3402 (DWQ Project No. 030614), which was issued on 5/29/03. Any violation of the water quality certification issued by the DWQ will be considered a violation of this CAMA permit. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit No. 18 (COE Action Id. No. 200300734) which was issued on 5/13/03. PROJECT SUMMARY: The applicant proposes to clear and grade his residential lot for the purpose of constructing a single-family residence and driveway. The propose fill area includes a 0.011 ac(460 sq ft)of Section 404 wetlands. The applicant also proposes to build a retaining wall to keep the fill in place on the wetlands and fill and even out his lot on the high ground potion. William J. Knowles,Jr. August 1,2003 Page Two 9. PROJECT DESCRIPTION The applicant's property is located at 1321 N.New River Drive,in the Town of Surf City,in Pender County. The property is located adjacent an unnamed tributary to Topsail Sound. The closest intersection to the project site is NC Highway 210 and Lenoir Avenue,approximately 1.7 miles north of the intersection of NC Highway 50 and NC Highway 210(Surf City stop light). The property is a residential lot. The property'survey shows a single-family-residential lot measuring approximately 200'deep and approximately 50'wide with a small wetland finger encroaching into the high ground area and that approximately half of the lot is 404 wetland and coastal marsh. The applicant has already received a 401 Certification from the NC Division of Water Quality for the project(DWQ#03-0614)and a Corps of Engineers Nationwide 18 for the project(ID#200300734). The DWQ Stormwater permit is in review at this time (SW803614). The survey also shows the elevation of the property to be approximately 5 feet above normal high water on the upland side. The upland section of the lot is fairly flat and is primarily a cleared lot. The upland vegetation on site consists of one approximately 15' tall live oak(Quercus virginiana)surrounded by some small ones on the northeast corner of the lot. Additional vegetation includes beach pea(Strophostyles helvola),catbriar (Smilax sp.),poison ivy(Toxicodendron radicans),common ragweed(Ambrosia artemisiifolia),virginia creeper (Parthenocissus quinquefolia), grape vines(Vitis sp.),peppervine(Ampelopsis arborea)and small hills of sea oats (Uniola paniculata). The waterward portion of the lot consists of 404 wetlands ranging in width from approximately 5' on the southern portion of the lot to approximately 15' in width on the northern portion. The vegetation within the 404 wetlands consists of marsh elder(Iva frutescens),wax myrtle(Myrica cerifera),marsh pennywort(Hydrocotyle umbellata) and briars(Rubus sp). The remainder of the lot is coastal marsh consisting mostly of black needle rush(Juncus roemerianus)with a small stand of cattails(Typha sp.). The coastal marsh delineation on the survey plat was not done by a Division of Coastal Management field representative and therefore is not a valid line. Based on site investigations,the proposed retaining wall and wetland fill will be located landward of coastal wetlands. The waters adjacent to the project are classified"SA"by the Division of Water Quality. The area is a designated Primary Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish as a conditional shellfish harvesting area. PROPOSED PROJECT: The applicant is proposing to fill a 0.011 ac of Section 404 wetlands,build a retaining wall across the back of the lot to retain the fill and construct a single-family residence and driveway. The project is located within a high hazard flood zone,which is one of the Division of Coastal Management's Areas of Environmental Concern(AEC), and requires a CAMA major permit due to the filling of 404 type wetlands within this AEC. All work proposed is outside the 30' buffer and the 75' Estuarine Shoreline AEC The applicant is proposing to construct a private two-story residence with a footprint of approximately 28' X 36' in size. He is also proposing covered decks on the western and easternmost sides of the house to be 6' X 28' in size and an uncovered deck on the southernmost side to be 6' X 48' in size. The proposed driveway for the residence is to be 28' wide by 32' long(6' X 28"is covered by deck). The proposed retaining wall/bulkhead will have 5' lengths of 6"X 6"posts with 3' in the ground and 2' above ground. The wall will be built with 2"X 10"boards parallel to the ground to retain the fill material. 10. ANTICIPATED IMPACTS The proposed project will result in the filling of 0.011 ac(460 sq f3)of Section 404 wetlands and the entire disturbed area would be approximately 4475 sq ft that will include the wetland fill,house construction, driveway and subsequent landscaping.
