This permit, issued on July 17,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Boatlift 1) This permit authorizes only the new boatlift located in or over the water that is expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any vessels using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) The authorized structure and associated activity must not cause an unacceptable interference with navigation. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Signature of Permittee Karen Kelly Permit#96-03 Page 2 of 2 ADDITIONAL CONDITIONS 4) The new boatlift shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 5) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 9) This permit authorizes a maximum of 3 boat slips. At no time shall more than 3 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: With the exception of the pilings for the boatlift structure, the permittee is cautioned that this permit does not authorize the placement of new tie piles in association with the docking facility. The placement of such tie pilings will require a modification of this permit. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 030750. 4 NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. Karen Kelly Page 2 9. PROJECT DESCRIPTION: The project site is located at 546 S. Lumina Ave., adjacent to Banks Channel located at the southern end of Wrightsville Beach, between the Atlantic Ocean and Greenville Sound. The site is located in the Wrightsville Beach township in New Hanover County. The lot is approximately 1/4 acre with 50' of shoreline frontage. The lot averages 4-5' feet above mean sea level and the shoreline is stabilized by a bulkhead. The applicant maintains a single-family residence on property and vegetation consists of lawn grasses and landscape shrubs. There is an existing private pier(6'x 84% gazebo and floating dock located on the subject property. The gazebo (10' x 20') is located at the end of the pier and extends toward the east. The floating dock (6'x 25') is in alignment with the pier and runs from north to south, perpendicular to the shoreline. The pier and floating dock currently provide docking space for two (2) vessels. Both structures are within the established Wrightsville Beach Pierhead Line. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the AIWW, which are included in the Wrightsville Recreational Area, are classified SB#by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The applicant proposes to construct an addition to his private pier. The addition would consists of single pile supported 6' x 6'personal water-craft lift located on the western side of the existing gazebo. With the addition of the boat lift, the structure would provide dockage/storage space for up to three (3) vessels. The proposed boat lift will be located approximately twenty-five (25) feet east of the western riparian corridor(Jack Coleman) and will be approximately eighteen (18) feet west of the eastern riparian line (property Faye Murray). 10. ANTICIPATED IMPACTS The proposed boat lift would create an additional 36 square feet of partially covered open waters. The total incorporation of estuarine waters and public trust area associated with the proposed boatlift would be 36 square feet. The proposed boat lift would provide docking space for one additional boat,bringing the total number of available slips up to three (3). I have no objections to the proposed project. Any permit issued should include the following conditions: 1. This permit authorizes only the docks,piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. The proposed addition will provide dockage for up to three (3) vessels. The project site is located at 546 S. Lumina Avenue, adjacent to Banks Channel. According to a survey provided by the applicant, both the existing pier and proposed PWC lift are contained within the Town's pierhead line. According to the Division's Field Investigation Report, the Public Trust Area and Estuarine Waters Areas of Environmental Concern (AECs) will be impacted. Waters at the site are classified SB#(Wrightsville Recreational Area), closed to shellfishing, and not designated as a Primary Nursery Area (PNA). This development proposal has been reviewed for consistency with the Town of Wrightsville Beach Land Use Plan (1996). The land classifications for this site are Conservation (AECs) and Developed-Area #4—Waynick Boulevard-South Lumina Area (upland portion of site). The purpose of the Conservation classification is to provide for the effective long-term management and protection of significant, limited or irreplaceable areas. The purpose of the Developed-Area #4 classification is to encourage a continuation of the predominant single-family and duplex residential development. The following LUP policies are applicable to this project: LUP Policy 8.1.2(B)(1)—Estuarine Waters—Appropriate uses within estuarine waters may include simple access channels, structures which prevent erosion, navigational channels and private boat docks, piers and mooring pilings. LUP Policy 8.1.2(C)(3)—Public Trust Areas— CAMA standards designed to limit the length of docks and piers as they project into public trust waters shall be considered the minimum standards, with the Town reserving the right to be more restrictive where public trust waters use and environmental protection issues warrant. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000.
