Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Modification 1) This permit authorizes only the docks, piers, and other structures located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. Signature of Permittee � 1 i Mack Johnson Permit#74-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes a maximum of 4 boat slips. At no time shall more than 4 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: The permittee is cautioned that this permit does not authorize the placement of mooring pilings in association with the docking facility. Furthermore, boats utilizing the docking facility may be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Mack Johnson Page 2 -------------------------------------------------------------------------------------------------------------------------------- PROJECT DESCRIPTION: The applicant, Mr. Johnson, is the owner of a private home in The Landing Subdivision in Southport, Brunswick County. The Landing Subdivision is located off of East Moore Street, north of the downtown area and south of the Southport Ferry Terminal. Mr. Johnson has an existing home situated on a .61 acre lot at 6252 Inlet Watch Drive off of Peeble Shore Lane. The lot borders the Cape Fear River. The shoreline of the lot is 100' wide and natural with federal wetlands separating the high ground from the shoreline of the River. In September of 2001, Mr. Johnson obtained a CAMA General Permit (#28212-D) which authorized construction of a private pier with 2 uncovered boat lifts at the waterward end. The structure was subsequently built in accordance with the General Permit. However, due to the shallow near-shore water depths, Mr. Johnson is able to utilize the boat lifts only near high tide. He is herein requesting to add an 8' by 40' floating dock waterward of the existing boat lifts. The purported water depth at mean low water at the end of the proposed floating dock is 28". The floating dock could be used to moor the boats until the tide rose enough to get the vessels safely back into the existing lifts. The two existing uncovered boat lifts and the proposed 40'long floating dock would provide potential dockage for at least four boats with a possibility for up to six boats, depending upon the size of boats. The proposed overall length of the walkway/pier/dock structure is 306'. The length of the proposed structure would not exceed 1/4 width of the open water body, which is very wide in this location. The proposed structure would be approximately 25'to 30' longer than the adjacent pier. The additional boat slips (more than 2)has required that this project be reviewed through the CAMA Major Permit process. The area where the existing pier and boat lifts are located has been designated as public trust and estuarine waters by the Division of Coastal Management. The waters of the Cape Fear River in this area have been classified as SC by the Division of Water Quality. The waters are closed to shellfishing and are not Primary Nursery Areas. Water depths near the shoreline are shallow but get very deep near the shipping channel. ANTICIPATED IMPACTS: Impacts from this project will include the shading of approximately 405 square feet of estuarine and public trust waters where the proposed ramp and floating dock would be situated. The floating dock would add 320 square feet of dockage and 57' of length to the existing pier structure. The proposed dock will provide opportunity for more boat slips in the water. No high ground or wetlands should be impacted as a result of this project. There could be some temporary shallow bottom impacts and increased turbidity resulting during installation of the proposed float. There should be no impacts to navigation. Janet M. Russell/February 24, 2003 /Wilmington Recommendations for State Permit- MACK JOHNSON The Wilmington Office,Division of Coastal Management,recommends that the permit be issued with the following conditions: NOTE: A ramp and a 8'by 40' floating dock are being authorized by this permit. 1. A total of two (2)boat slips, temporary moorings or temporary tie-ups are being authorized along the proposed 40' floating dock. One slip is authorized on each side of the floating dock. 2. Dredging in any manner, including"kicking"with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3. Floatation units under the floating dock shall be constructed of materials which will not become waterlogged or sink when punctured. 4. No sewage,whether treated or untreated, shall be discharged at any time from boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5. The ramp and floating dock structure shall have a minimum setback distance of 15'between any parts of the structure and the adjacent property lines as extended perpendicular to the channel into the water at the points where they intersect the shoreline. 6. '. ....., ... e.. ... k�.. We are asking to add a floating dock to our existing pier and boatlift. This is due to the miscalculations made when the existing pier and boatlift were constructed. We originally had a permit issued in 1999 for 300 feet of pier. We reapplied in August 2001 for a 200-foot pier. Both were approved. When our dock was constructed we thought that 150 feet would be adequate however upon using the lift we found out that we made a big mistake. Our large boat could not be put on the lift except within an hour of high tide. At low tide there is only 10"of water. Since there is no place to moor the boat at the end of the dock this made the lift unusable. After fishing offshore you cannot time your arrival and departure around the tide. To correct the situation we had 2 choices: 1. Extend the pier and boat lifts another 150 feet to get 48"of water at low tide. The boatlift itself takes up 20" on the bottom. 2. Extend a floating dock so that the boat could be moored temporarily waiting for the tide to rise so that the boat could be put back on the lift. We feel that option number 2 is the best option. We have asked for the minimum length to give us 28"of depth at low tide at the waters end. This is the minimum for the motors at the stern to have enough water to nudge the boat in and tie up until the tide raises enough to put the boat on the lift. A floating dock minimizes the length of dock required and is more aesthetically pleasing due to its low profile rather than 150 of additional pier. Thank you for your consideration. The proposed project site is located within the City of Southport at 6252 Inlet Watch Drive in the Landing subdivision. According to the Division's Field Investigation Report,Public Trust Area and Estuarine Waters Areas of Environmental Concern (AECs)will be impacted. Waters at the site are classified SC, and are closed to shellfishing. Waters are not designated as Primary Nursery Area(PNA). This development proposal has been reviewed for consistency with the City of Southport 1997 Land Use Plan. The land classifications for this are Conservation(above listed AECs)and Urban Transition Residential (upland portion of the site). According to the LUP,the Conservation land classification is designed to provide for effective long-term management of significant,limited or irreplaceable areas which include AECs. Development in the estuarine system should be restricted to such uses which satisfy 15A NCAC 7H use standards and the City of Southport zoning ordinance. The Urban Transition Residential land classification includes areas that are presently being developed for urban residential purposes, and is designed to provide lands to accommodate future urban growth within the planning period. The following LUP policies are applicable to this project: Residential. Commercial and Industrial Development Impacts on Resources: the City of Southport will allow development within:Areas of Environmental Concern. The City will rely on 15A NCAC 7H, and its subdivision and zoning ordinances to regulate development within AECs. Marine Resource Areas: The City of Southport supports responsible usage and development in marine resource areas. The City will rely on 15A NCAC 7H.0207 to regulate use and development within estuarine and public trust areas;for structures that extend into over estuarine and public trust waters, replacement of structures and/or change of use will be allowed so long as the structure is consistent with or allowed by the CRC. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction.
