Upland Development 1) This permit authorizes only the filling of 404 wetlands, construction of a single-family residential structure, installation of the associated septic system and construction of a gravel driveway that is expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. 2) In accordance with T15A:NCAC.07H.0209(d)(2), "Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation." Therefore, any redesign of the permitted development that would increase the impervious surface coverage within the AEC beyond 30 percent will require a modification of this permit. The permittee shall contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity. Isbrecht Permit#62-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) The installation of the septic system shall be done in accordance with the Improvement Permit (71602- 4) issued by Hyde County Health Department on 7/16/02. 4) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawings. 5) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 6) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. NOTE: In order to avoid unreasonable danger to life and property, all development should be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Any building constructed should comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Water Quality 10) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 030304), which was issued on 4/7/03. Any violation of the water quality certification issued by the,DWQ will be considered a violation of this CAMA permit. 11) The N.C. Division of Water Quality has authorized the proposed project under an Approval of Tar- Pamlico River Riparian Buffer Protection Rule Minor Variance (DWQ Project No. 030102), which was issued on 2/5/03. Any violation of the conditions of the approved minor variance, including the mitigation requirements, issued by the DWQ will be considered a violation of this CAMA permit. NOTE: The permitee has agreed to pay $1,036.80 into the Riparian Buffer Restoration Fund administered by the NC Wetland Restoration Program (NCWRP) as compensatory mitigation for impacts to the protected riparian buffers in the Tar-Pamlico River Basin. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Isbrecht Ocracoke Island Hyde County Project Setting The project site is located off SR 1375 (Cuttin Sage Lane) on the east side of Ocracoke Island on a man made canal (locally known as Oyster Creek) off the Pan-lico Sound in Hyde County, North Carolina. The site is an undeveloped 50' wide (along canal) x 100' deep residential lot. The vegetation on the lot consists mainly of live oak and eastern red cedar. The neighboring lot on the north side is developed with a single- family residential structure while the adjacent lot on the south side is undeveloped and similarly vegetated. The project site is ±4' above the normal water level (NWL) with the exception of an area of low elevation with sloping sides, nearly bowl shaped, located 40' landward of the NWL. This area has been delineated as section 404 wetlands by the U.S. Army Corps of Engineers (USACOE). This delineated wooded 404 wetland is 30' wide and runs the entire width of the lot extending across the property line on the south side and across the other undeveloped lot. The wooded 404 wetland area was vegetated predominately with wax myrtle and eastern red cedar but has been recently cleared. The depression appears to have resulted from the removal (borrowing) of fill material possibly to construct the adjacent subdivision road due to its somewhat uniform shape and juxtaposition to the surrounding topography. The grade transitions back to highground before reaching SR 1375. CAMA/Dredge and Fill General Permit No. 32668-B issued on 8 January 2003 authorized the construction of a bulkhead and a 6' wide x 50' long dock at the project site. As of 5 March 2003 only the bulkhead had been constructed. Pamlico Sound on the east side of Ocracoke Island is classified as SA Waters by the Environmental Commission and is open to shell fishing. Project Description The applicant proposes to fill the 404 wetlands, approximately 30' x 50', on the lot to level the grade for the purpose of constructing a pile supported 30'x 34' single- family residence. The residence is to be constructed 30' landward of the normal water level. The applicant has a Minor Variance to the Tar-Pamlico River Riparian Buffer Rules for the construction of the home. A septic system is to be located between home and SR 1375. The applicant has received approval for the system from the Hyde County Health Department. The applicant is proposing to fill an 8'wide x 40' gravel driveway to facilitate parking underneath the proposed residence. Project Impact The project as proposed will result in the filling of ±1,500 ft2 of 404 wooded wetlands within the 75' Estuarine Shoreline. The installation of the gravel driveway and septic system will result in the disturbance of ±1,520 ft'- of uplands. The project as proposed will result in 30.4% impervious surface coverage within the 75' Estuarine Shoreline.
