This permit, issued on May 12,2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) This permit authorizes only the filling of 404 wetlands, construction of a single-family residential structure,
installation of the associated septic system and construction of a gravel driveway that is expressly and specifically
set forth in the permit application and depicted on the attached workplan drawings.
2) In accordance with T15A:NCAC.07H.0209(d)(2), "Impervious surfaces shall not exceed 30 percent of the AEC
area of the lot, unless the applicant can effectively demonstrate, through design, that the protection provided by
the design would be equal to or exceed the protection by the 30 percent limitation." Therefore, any redesign of
the permitted development that would increase the impervious surface coverage within the AEC beyond 30
percent will require a modification of this permit. The permittee shall contact a representative of the Division at

ADDITIONAL CONDITIONS
3) The installation of the septic system shall be done in accordance with the Improvement Permit (71602-
4) issued by Hyde County Health Department on 7/16/02.
4) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill
area indicated on the workplan drawings.
5) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
6) All excavated materials will be confined above mean high water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters.
NOTE: In order to avoid unreasonable danger to life and property, all development should be designed
and placed so as to minimize damage due to fluctuations in ground elevation and wave action in
a 100 year storm. Any building constructed should comply with the North Carolina Building
Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. The building code or flood damage prevention ordinance may impose
additional more restrictive requirements than the Division's standards for development in areas
of environmental concern (AECs).
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
8) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Water Quality
10) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality
Certification No. 3400 (DWQ Project No. 030304), which was issued on 4/7/03. Any violation of the
water quality certification issued by the,DWQ will be considered a violation of this CAMA permit.
11) The N.C. Division of Water Quality has authorized the proposed project under an Approval of Tar-
Pamlico River Riparian Buffer Protection Rule Minor Variance (DWQ Project No. 030102), which was
issued on 2/5/03. Any violation of the conditions of the approved minor variance, including the
mitigation requirements, issued by the DWQ will be considered a violation of this CAMA permit.
NOTE: The permitee has agreed to pay $1,036.80 into the Riparian Buffer Restoration Fund
administered by the NC Wetland Restoration Program (NCWRP) as compensatory mitigation for
impacts to the protected riparian buffers in the Tar-Pamlico River Basin.

NOTE: The permittee is advised that any development or land disturbing activity that is considered non-
water dependent is not authorized within 50 feet of the normal water level unless specifically
exempted by Environmental Management Commission (EMC)Tar-Pamlico River buffer
regulations in place at the time of such development.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

Project Setting
The project site is located off SR 1375 (Cuttin Sage Lane) on the east side of
Ocracoke Island on a man made canal (locally known as Oyster Creek) off the Pan-lico
Sound in Hyde County, North Carolina. The site is an undeveloped 50' wide (along
canal) x 100' deep residential lot. The vegetation on the lot consists mainly of live oak
and eastern red cedar. The neighboring lot on the north side is developed with a single-
family residential structure while the adjacent lot on the south side is undeveloped and
similarly vegetated. The project site is ±4' above the normal water level (NWL) with the
exception of an area of low elevation with sloping sides, nearly bowl shaped, located 40'
landward of the NWL. This area has been delineated as section 404 wetlands by the U.S.
Army Corps of Engineers (USACOE). This delineated wooded 404 wetland is 30' wide
and runs the entire width of the lot extending across the property line on the south side
and across the other undeveloped lot. The wooded 404 wetland area was vegetated
predominately with wax myrtle and eastern red cedar but has been recently cleared. The
depression appears to have resulted from the removal (borrowing) of fill material
possibly to construct the adjacent subdivision road due to its somewhat uniform shape
and juxtaposition to the surrounding topography. The grade transitions back to
highground before reaching SR 1375.
CAMA/Dredge and Fill General Permit No. 32668-B issued on 8 January 2003
authorized the construction of a bulkhead and a 6' wide x 50' long dock at the project
site. As of 5 March 2003 only the bulkhead had been constructed.
Pamlico Sound on the east side of Ocracoke Island is classified as SA Waters by
the Environmental Commission and is open to shell fishing.
Project Description
The applicant proposes to fill the 404 wetlands, approximately 30' x 50', on the
lot to level the grade for the purpose of constructing a pile supported 30'x 34' single-
family residence. The residence is to be constructed 30' landward of the normal water
level. The applicant has a Minor Variance to the Tar-Pamlico River Riparian Buffer
Rules for the construction of the home. A septic system is to be located between home
and SR 1375. The applicant has received approval for the system from the Hyde County
Health Department. The applicant is proposing to fill an 8'wide x 40' gravel driveway to
facilitate parking underneath the proposed residence.
Project Impact
The project as proposed will result in the filling of ±1,500 ft2 of 404 wooded
wetlands within the 75' Estuarine Shoreline. The installation of the gravel driveway and
septic system will result in the disturbance of ±1,520 ft'- of uplands. The project as
proposed will result in 30.4% impervious surface coverage within the 75' Estuarine
Shoreline.

This office received a copy of your CAMA application on March 12, 2003.
Staff review of the plans and specifications has determined that the project, as
proposed, consists of activities that will not pose surface water quality threats
from stormwater runoff. The Director has determined that projects that are
reviewed and approved by the Division as not posing water quality threats from
stormwater runoff should not be subject to the stormwater management permitting
requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way
of this letter that your project will not require a stormwater management permit.
Please keep in mind that this determination does not affect your legal
requirements to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act or any
other Federal, State or Local Government. In addition, any future modifications
to the project will require additional review from this office to assure that
stormwater impacts are not an issue.

APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Ms. Isbrecht:
You have our approval, in accordance with the attached conditions,to place fill in 0.034 acre of vegetated wetlands in order to
construct a single-family residence on your property in Hyde County,as described in your application received by the Division of Water
Quality on March 14,2003. After reviewing your application,we have determined that this fill is covered by General Water Quality
Certification Number 3400,which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows
you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition,you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge,
Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold,the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project(now or in the future)exceed one acre,compensatory mitigation may be required as described in 15A NCAC
2H .0506(h). For this approval to be valid,you must follow the conditions listed in the attached certification and the additional conditions
listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification,you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing,send a written petition conforming to Chapter 150E of the North
Carolina General Statutes to the Office of Administrative Hearings,6714 Mail Service Center, Raleigh, N.C.27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Enclosed is an application received from Ms. Celia E. Isbrecht to develop a residential lot
located off SR 1375 (Cuttin Sage Lane) on the east side of Ocracoke Island on a man made canal
(Oyster Creek)off the Pamlico Sound in Hyde County,North Carolina. The project will require the
filling of±1,500 ft2 of wooded 404 wetlands within the Estuarine Shoreline AEC thus has tripped the
major permit trigger. The USACOE has delineated the site and has indicated tome that the project
will qualify for a nationwide permit. A review of the proposed home construction indicates to me
that she is right at the 30%impervious surface standard. It will be important to condition the permit
not to exceed this standard without permit modification. Ms.Isbrecht has received a Minor Variance
from the Division of Water Quality for the construction of the home in Zone II, the home will
setback off the canal 30'. 1 recommend issuance of the permit.

This project is subject to the 1998 HYDE COUNTY LAND USE PLAN. The Land Use Classification for the project site
Conservation (Areas of Environmental Concern), and Community(uplands) in the Hyde County Land Use Plan.
PROJECT SUMMARY
The applicant proposes to fill and grade an area of 404 wetlands approximately 30, x 50, for the purpose of constructing a pile
supported single family residence. The applicant also will be constructing a 8' x 40' gravel driveway. Areas of Environmental
Concern impacted by the project include Estuarine Waters, Public Trust Waters, and Coastal Shoreline.
APPLICABLE POLICIES
• Hyde County generally supports — but reserves the right to object to amendments and/or changes thereto — the
guidelines of the Coastal Area Management Act and the efforts and programs of the North Carolina Department of
Environment and Natural Resources, Division of Coastal Management and the Coastal Resource Commission to
protect the ocean, coastal wetlands, estuarine waters, estuarine shorelines, and public trust waters of Hyde County.
It also supports the use of best management practices recommendations of the United States Soil Conservation

It is my interpretation that the proposes project appears to be consistent with the 1998 Hyde County Land Use Plan,

The North Carolina Wetlands Restoration Program (NCWRP) has received a check in the
amount of$1,036.80 check number 1013 as payment for the compensatory mitigation
requirements of the 401 Water Quality Certification/Section 404 permit issued for the subject
project. This receipt serves as notification that the compensatory mitigation requirements for
this project have been satisfied. Please note that you must also comply with all other
conditions of this certification and any other state, federal or local government permits or
authorization associated with this activity. Further, it is the understanding of the NCWRP that
the rules of the NC Coastal Resources Commission, as implemented by the Division of Coastal
Management, allow mitigation for impacts to coastal wetlands only for projects that will have
public benefits, as determined by the DCM, provided that the public benefits clearly outweigh
the adverse effects of the project, and further, that all reasonable means of impact avoidance
and minimization have been incorporated into the project's design.
The NCWRP, by acceptance of this payment, acknowledges that the NCWRP is responsible
for the compensatory mitigation requirements associated with the subject permit and agrees to
provide the compensatory mitigation as specified in the permit. The NCWRP will restore .96
square feet of riparian buffer in Cataloging Unit 03020105 of the Tar-Pamilco River Basin.

You have our approval, in accordance with the conditions listed below, to impact approximately 720 ft2 of Zone 2 of the
protected buffers to construct a home at the subject property as described within your variance request dated December

30, 2002. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0259(9)(b). In
addition, you should obtain or otherwise comply with any other required federal, state or local regulations before you
proceed with your project including (but not limited to) local building permits.
This approval is only valid for the purpose and design that you described in your Minor Variance Request. If you change
your project, you must notify us and you may be required to send us a new request for approval. If the property is sold,
the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For tth
approval to be valid, you must follow the conditions listed below. is
Conditions:
1• No impacts (except for"exempt' uses as identified within 15A NCAC 2B .0259) shall occur to Zone
the protected riparian buffers unless otherwise approved by the DWQ. 1 of

The outside Zone 1 buffer boundary approved under this authorization shall be clearly marked by oran e
fabric fencing for the areas that have been approved to infringe within the buffer prior to any land g
disturbing activities to ensure compliance with 15A NCAC 213 .0259.
3. Diffuse Flow
Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers
as identified within 15A NCAC 2B .0259(5). Roof drainage from the new addition shall be directed to
vegetated areas at non-erosive velocities prior to entering the protected riparian buffers. No new direct
discharges of stormwater(i.e., piping, ditching, etc.) through the buffers is allowed.
4. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters
and protective buffers in order to assure compliance for future wetland, water and buffer impact. These
mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for
impact under this Certification Approval and Authorization Certificate.

5. Buffer Mitigation (WRP)
You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation
to compensate for impacts to the protected riparian buffers is 1,080 square feet as required under this
variance approval and 15A NCAC 2B .0260. We understand that you wish to make a payment into the
Riparian Buffer Restoration.Fund administered by the NC Wetlands Restoration Program (WRP)to meet
this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the
mitigation requirement. In accordance with 15A NCAC 2B .0260, this contribution will satisfy our
compensatory mitigation requirements under 15A NCAC 26 .0259(9)(C). Until the WRP receives and
clears your check (made payable to: DENR—Wetlands Restoration Program Office), no impacts specified
in this Authorization Certificate shall occur. Mr. Ron Ferrell should be contacted at [phone] if you
have any questions concerning payment into the WRP. You have one month from the date of this
approval to make this payment. For accounting purposes,this variance approval authorizes
payment into the Riparian Buffer Restoration Fund to compensate for 1,080 ftz of required riparian
buffer mitigation for impacts to 1,080 ftz of protected riparian buffers; 03-03-10, 29-(40.5) river and
subbasin."
Requests for appeals of this decision shall be made to the Office of Administrative Hearings. If you do not accept any of
the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This
approval and its conditions are final and binding unless you ask for a hearing.
Please note that this letter does not authorize the fill of wetlands. Any wetland fill will need to comply with U.S. Army .
Corps of Engineers 404 Permits and Division of Water Quality 401 Certifications as well as Coastal Area Management
(LAMA) permits.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection

The Department of Environment and Natural Resources hereby gives public notice as required by
N.C.G.S. 113A-119(b) that an application for a development permit in an Area of Environmental

The Division of Coastal Management hereby acknowledges receipt of an application for
State approval for development of property located on the northwest side of Ocracoke Island off
SR 1375 on the Oyster Creek canal off the Pamlico Sound in Hyde County, NC. It was
received on 5 March 2003 and appears to be adequate for processing at this time. The projected
deadline for making a decision is 25 May 2003. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will also serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day. Should there be any
questions on this procedural change, do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at a
conspicuous point along the property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone. pole or tree along the road right-of-
way fronting the property, or at a point along the road right-of-way where a private road would
