Please sign both the original (buff- colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. Please retain the original (buff-colored form), as it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be tiled in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-269.8 within twenty (20) days of this decision on'your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. As per our discussion on December 13, 2006, I am requesting an extension the above referenced permit. The reason I have not completely proceeded with the project is lack of adequate finances. Hopefully I will be able to complete this project in the summer of 2007. In reference to the question on the form you showed me: 1.) I still own the property; 2.) I will make every effort to meet all local, state, or federal rules in regards to the bulkhead installation;and 3.) I will contact CAMA 30 days prior to construction. REFERENCE: (a) Letter from Mr. John Head (dated December 14, 2006) requesting an Extension of Major Permit#157-03 (b) 15A NCAC 07J.0404, Development Period Extension The applicant was issued CAMA Major Permit#157-03 on November 4, 2003 to remove an old pier and construct a bulkhead water ward of a small Coastal Wetland fringe on a canal in the Brigands Bay subdivision in Frisco, Dare County. The applicant submitted a letter dated December 14, 2006 (see attached) requesting a renewal of this permit, and subsequently submitted a check for the $100 renewal fee (check number 3462, dated January 4, 2007). I have reviewed the original permit application and conducted a site visit and determined that the applicant has removed the old pier but has not constructed the proposed bulkhead. The applicant meets the conditions outlined in reference (b),therefore I recommended that Major Permit#157-03 be extended for two years,provided all previous permit conditions remain in effect. This receipt serves as notification that the compensatory mitigation requirements for this project have been satisfied. Please note that you must also comply with all other conditions of this certification and any other state,federal or local government permits or authorization associated with this activity. The NC EEP, by acceptance of this payment, acknowledges that the NC EEP is responsible for the compensatory mitigation requirements associated with the project permit and agrees to provide the compensatory mitigation as specified in the permit.
