This permit, issued on October 8,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth:below.Any violation of these terms may be subject to fines,imprisonment or civil action; or may cause the permit to be null and void. Travel Lift Well 1) This permit authorizes the installation of a new travel lift well and associated bulkhead adjacent to the existing travel lift. All work authorized by this permit shall be done as expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. 2) Excavation will not exceed -11 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) A sheet pile coffer dam shall be left between the area to be excavated and the existing basin and a 24 hour period after completion of excavation will elapse prior to coffer dam removal to prevent unnecessary siltation into the adjacent water body. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. PROJECT SUMMARY:The applicant proposes to install a travel lift well and associated bulkhead adjacent to the existing travel lift. Hatteras Yachts Travel Lift Bay Craven County Project Setting The applicant owns a 96.4-acre tract of land adjacent to the Neuse River in New Bern, in Craven County,North Carolina.The property is on the south bank of the Neuse River, and has an elevation of approximately ten feet above the normal water level.Housed on the site is the existing production facility for Hatteras Yachts,manufacturers of 50-100 ft custom sportfishing and motor yachts. Vessels are constructed entirely at the New Bern facility and approximately half of the property is covered by impervious surface. Several existing buildings on the site contain the construction facilities and business offices.There are two large boathouses and two existing basins used to store completed vessels and vessels returned to the plant for repairs. The shorelines in the basins and inside the boathouse are stabilized with bulkhead and riprap material. Asphalt and concrete parking lots and driveways extend between the existing buildings and provide vehicular access to portions of the plant. The parking areas also function as dry dock and work areas for several boats out of the water. There are extensive undeveloped uplands on the northeast half ofthe property vegetated with mixed pines,catbriers,poison ivy,and shrubby species.Areas of freshwater wetlands vegetated with scattered cypress trees,bull tongue,arrow arum and cattails border the shoreline in the undeveloped portion. The property is bordered on the east and west by developed residential properties that are vegetated with pine trees, shrubs, small hardwood trees, mixed grasses and landscape plants. The Neuse River forms the northern property line. The project area is located at the northwest corner of the property, adjacent to an existing 250' by 250' basin and an existing travel lift. The basin is connected to an existing channel contiguous with the Neuse River.The basin is bordered on the east and west sides by large boathouses,and on the south side by an asphalt parking area.The water depth is— 12' NWL in the existing basin. The Neuse River is classified SC SW NSW by the Environmental Management Commission and is not open to shell fishing at this location.The property is located in the Neuse River Basin,and is subject to the Environmental Management Commission's (EMC) Neuse River Basin Nutrient Sensitive Waters Management Strategy. Project Description The applicant proposes to install a travel lift well and associated bulkhead adjacent to the existing travel lift. Hatteras has expanded the size of some of its yachts and the existing structure cannot accommodate the larger vessels. Installation of the travel lift would require excavation of a 27'by 83'basin between the existing travel lift well and an existing boathouse.Approximately 70' by 27' of the basin would be excavated from high ground, and the remaining portion would be constructed below the normal water level in the existing basin. The applicant proposes to install a temporary sheet pile wall between the open water and excavation area,to excavate the basin using a backhoe positioned on high ground. The wall would be removed upon completion of the lift well. Final project depths would be—11' NWL. The spoil material would be transported to an approved high ground site for disposal.The applicant proposes to install 220'of sheet pile bulkhead around the s Hatteras Yachts Craven County Page 2 perimeter of the new basin to provide support for the lift.Tieback rods would extend 12'landward of the proposed bulkhead.The bulkhead on the north side of the lift would extend 20'waterward of the shoreline.The applicant proposes to fill an area of open water 10'wide and an average of 17.5' long for one of the tracks of the travel lift.A 20'by 35'triangle shaped area of the existing boathouse roof would be removed to allow operation of the travel lift. An existing sewer line would be relocated landward of the proposed development. Anticipated Impacts The project as proposed would impact 3,672 ft2. Approximately 1,890 ft2 of highground would be excavated for the lift well construction. An additional 1,256 ft2 of high ground would be disturbed during installation of the tieback rods associated with the proposed sheet pile bulkhead. During construction of the travel lift well, 351 ft2 of shallow water in the adjacent basin would be excavated to create water depths needed for lift operation. Construction of one of the tracks for the travel lift would result in the filling of 175 ft2 of shallow water. Localized short-term turbidity increases will result from construction activities. The applicant proposes to install a travel lift well and associated bulkhead adjacent to the existing travel lift. Areas of Environmental Concern(AEC's) impacted by the proposal include Estuarine Waters, Public Trust Areas and Coastal Shoreline. Waters at the project site are classified as SC SW NSW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Craven County 1998 Land Use Plan Addendum and offer the following comments. The general area of the project is classified as Developed, while the AECs impacted by the work are classified as Conservation. In general, Craven County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Craven County Land Use Plan does contain some local policies which exceed 7H guidelines including those under Miscellaneous Resource Protection—Marina and Floating Home section of the Craven County Land Use Plan. However none of these more restrictive policies appear to be applicable to this project. Provided that all other local, state and federal requirements can be met,this project appears to be consistent with the Craven County 1998 Land Use Plan Addendum.
