This permit, issued on November 7,2003 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines,imprisonment or civil action; or may cause the permit to be null and void.
Boat Basin Enlargement
1) Excavation in the expanded basin will not exceed -4.28 feet below the normal water level. In no case
shall the depth of excavation exceed the depth of connecting waters.
2) In accordance with commitments made by the permittee, a cofferdam shall be left in place at the mouth
of the basin until all excavation is complete, and a 24 hour period after completion of excavation will
elapse prior to removal of the cofferdam to prevent unnecessary siltation into the adjacent water body.
3) No vegetated wetlands will be excavated or filled.

ADDITIONAL CONDITIONS
Vinyl Groin
17) This permit authorizes the replacement and relocation of the groin that is expressly and specifically set
forth in the permit application.
18) The permitted groin shall not extend more than 57 feet waterward of the normal water level.
19) The height of the permitted groin shall not exceed 1 foot above the normal water level.
20) No "L" and/or "T" sections are authorized at the end of the permitted groin.
Retaining Wall .
21) The retaining wall around the basin area shall be constructed as expressly and specifically set forth in
the permit application and depicted on the attached workplan drawings.
Sedimentation and Erosion Control
22) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
23) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,,
diversion swales or berms, sand fence, etc.).
24) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
Water Ouality
25) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality
_-Certification_Certification No..335.1. and.Authorization Certificate per.the_Tar-Pamlico River Buffer.Protection Rules
(DWQ Project No. 031163), which was issued on 10/29/03. Any violation of the water quality
certification issued by the DWQ will be considered a violation of this CAMA permit.
NOTE: Any development or land disturbing activity that is considered non-water dependent is not
authorized within 50 feet of the normal water level unless specifically exempted by
Environmental Management Commission (EMC) Tar-Pamlico River Basin buffer regulations in
place at the time of such development.
General
26) No fill material will be placed at any time in any surrounding waters outside of the alignment of the fill
area indicated on the workplan drawings.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, enviromnental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit,you will be helping to protect our vitally important coastal resources.

8. PROJECT SUMMARY: The applicant proposes to enlarge an existing boat basin for commercial use,
replace the existing bulkhead, retaining wall, and one existing jetty, replace the existing boat ramp
with a larger boat ramp, construct a new dock by the boat ramp and grade and sod the area.

Project setting
The project site is located on lots 9, 10 and 11 on Brookshire Road offNC 92 on Bath Creek
and a manmade basin within the Town of Bath's ETJ in Beaufort County, North Carolina. The
applicant proposes to use the site as a commercial test facility and guesthouse for product
demonstration and testing. The property is developed with an existing house,pier with 2 jet ski lifts
and a wet slip, a two stall boathouse in the terminal end of the basin, bulkhead along the entire
shoreline including the manmade basin area, and two groins that are located at the mouth of the
manmade basin. Other existing development includes retaining walls on both sides of the basin and
a boat ramp at the terminal end of the basin adjacent to the existing boathouse, as well as various
brick, wood and gravel walks on both sides of the basin. The site is vegetated with lawn grass,
various hardwoods and pines, as well as ornamental shrubs and flowers.
The property is bordered on upstream (north) side by a developed and bulkheaded lot that
includes a single-family dwelling and a pier and is similarly vegetated to the applicant's property.
The downstream (south) side of the project site is bordered by an undeveloped site that is
bulkheaded and is heavily wooded with hardwoods and pines.
The connecting water depth at the mouth of the existing basin is f4.28'below the normal
water level (NWL).
Bath Creek at the project location is classified as SB NSW by the Environmental
Management Commission at the project site. Bath Creek is classified as an Inland Nursery Area by
the North Carolina Wildlife Resources commission and is not open to shell fishing.
Project description
The applicant proposes to enlarge the existing manmade basin by excavating an area f32.5'
wide by±85'long to a finished depth of-4.28'below the NWL. The proposed excavation is at the
terminal end of the basin towards the south side. The applicant proposes to install a cofferdam of
vinyl sheet pile across the mouth of the existing basin prior to any new excavation. The newly
excavated area will be bulkheaded and the applicant proposes to replace the existing bulkhead along
the creek with a new vinyl bulkhead 2'waterward of the existing in the same alignment for a total of
±160'. A new retaining wall will be constructed on the south side of the expanded basin replacing
the existing retaining wall. The entire area will be graded and sod will be installed.
The existing f 11.3'wide by f 14'long boat ramp will be replaced with a 16'wide by 20'long
boat ramp in the same location at the terminal end of the existing basin. A new 2'wide by f3 8'long
dock is proposed between the existing boat house and the new boat ramp.

The existing f57'long wooden groin at the mouth of the basin on the south(downstream)
side will be replaced with anew vinyl groin approximately 3'south of the existing alignment. A 5'
wide by f127.5'long wooden walk is proposed along the south side of the enlarged basin.
Anticipated impacts
The project as proposed will result in the excavation of f3,082.5 ft2 of high ground to
enlarge the existing manmade basin as well replacement of the existing boat ramp. Approximately
697 ft2 of creek and basin will be filled associated with the installation of the new and replacement
bulkhead.. The installation of the new dock will result in the shading of±76 ft2 of basin bottom.
The grading of the site will result in the disturbance of±14,331 ft2 of high ground. The project as
proposed will result in localized turbidity as a result of the construction activities.

NARRATIVE
The purpose of this project is to widen and improve the existing boat ramp, construct a
boat basin, replace an existing wood jetty, replace an existing wood bulkhead and to
add a new bulkhead adjacent the boat basin. This project is located on the eastern side
of Brookshire Road and on the west side of Bath Creek, Bath, North Carolina.
DESCRIPTION OF PROPOSED IMPROVEMENTS
1. We plan to widen the existing boat ramp to a width of 16' to allow for loading and
unloading of larger boats while giving needed clearance from the 2' x 38'
proposed finger pier adjacent the existing boat house. The existing boat ramp is

2. A boat basin is proposed to be constructed in the upland area. The depth of the
boat basin will be approximately 4.28' deep. The existing boat basin will be
dewatered and a cofferdam'installed in order to excavate the area of the new
boat basin. The new boat basin will be bulkheaded with a vinyl material. The
bottom elevation of the new basin will be -4.28'.
3. The existing wood jetty on the south side of the boat basin will be replaced with a
vinyl jetty. The new jetty will be approximately 3' south of the existing jetty and
the length from shoreline will be the same.
4. The existing wooded bulkhead along Bath Creek will be replaced with a vinyl
bulkhead. The new bulkhead will be placed 2 feet on the waterward side of the
existing bulkhead. The void area will be filled with select backfill and sodded with
centipede grass.
This project will begin immediately after the proper permits are received and will take
approximately 30 to 45 days to complete.

Dear Mr. Bryan:
You have our approval, in accordance with the attached conditions,to dredge 0.07 acres of waters,.fill 0.01 7 acres of
waters and to impact approximately 0.35 acres of riparian buffers as described in your application received by the Division
of Water Quality(DWQ)Wetlands/401 Unit on September 15, 2003. After•reviewing your application, we have
determined that the water impacts are covered by the Division of Water Quality(DWQ) General Water Quality Certification
Number 3351. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of
Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected
riparian buffers per 15A NCAC 2B .0259. In addition, you should get or otherwise comply with any other federal, state
and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control
regulations and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold,the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below.

September 11, 2003. Staff review of the plans and specifications has determined that the project,
as proposed,will not consist of any significant amount of new impervious surfaces on site. For
this reason, your project should not pose surface water quality threats from stormwater runoff.
The Director has determined that projects that are reviewed and approved by the Division as not
posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing
you by way of this letter that your project will not require a stormwater management permit at
this time.
Please keep in mind that this determination does not affect your legal requirements to
obtain other permits which may be required by the Division of Water Quality, the Division of
Land Resources, Coastal Area Management Act or any other Federal, State or Local

SUBJECT: Grady White, Inc. Permit Application
The applicant proposes to enlarge an existing basin,bulkhead the newly excavated area and
replace ±160' of existing bulkhead along the creek front, enlarge an existing boat ramp, add an
access dock,replace an existing groin,construct a wooden boardwalk landward ofthe newbulkhead
in the basin area,and grade and sod the disturbed area. The project appears to be consistent with the
rules found in Subchapter 7H concerning development in Public Trust Areas. If the project is
permitted, I recommend that in addition to the standard conditions,the following be included;
Conditions
.4. The bulkhead will average 2 feet and will not extend waterward more than 2 feet from the
normal water level (NWL)at any point along its alignment at the time of construction.
✓I. The bulkhead must be constructed prior to any backfilling activities and must be structurally
tight so as to prevent seepage of backfill materials through the structure.
No excavated or fill material will be placed at any time in any wetlands or surrounding
waters outside of the alignment of the fill area indicated on the work plat(s).
4. Excavation of the expanded basin will not exceed 4.28' below the NWL.
The cofferdam will be left in place at the mouth of the existing basin until all excavation
is complete. To prevent sedimentation in adjacent waters, 24 hours will be allowed to
elapse before the cofferdam is removed.
✓6. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
7. The proposed replacement groin into Bath Creek may be constructed of wood or vinyl
and can project a maximum of 57'. The measurement will be taken from the NWL.
8. The proposed groin will project above the NWL a maximum of 1'.

Bath Creek near the Town of Bath in Beaufort County, North Carolina. It was received on 9
September 2003 and appears to be adequate for processing at this time. The projected deadline for
making a decision is 23 November 2003. An additional 75-day review period is provided by law
when such time is necessary to complete the review.If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will also serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Should there be any questions on this
procedural change, do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along the property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of--way fronting the property,
or at a point along the road right-of-way where a private road would lead one into the property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made and if additional information is required, you will be
