Additions to Marina Facility 1) This permit authorizes only the additional platform; finger pier, mooring pilings and wetslips located in or over the water that are expressly and specifically set forth in the permit application. No' other structure, whether floating or stationary, may become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina facility. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NARRATIVE DESCRIPTION: Project Setting 8 1/z marina is located at 1013 East Fort Macon Road adjacent to Bogue Sound within the Town of Atlantic Beach, Carteret County. The site can be accessed by turning east on Fort Macon Road (Hwy 58) and traveling approximately one mile to the entrance on the north side of the highway. The ± 15-acre tract was developed into a 73-unit condominium complex in the early 1970's and received federal and state permits at that time to excavate a canal and access channel to serve the condo project. The site is listed as 6' above mean high water and houses a 73-unit condo complex, wastewater treatment package plant, marina office, tennis courts, pool, and side to as well as perpendicular floating dock adjacent to the existing bulkhead. In 1981, the applicant conducted maintenance excavation of the canal and access channel with the spoils being pumped to nearby Money Island. Later in 1997, similar maintenance was conducted yet these spoils were pumped to Brandt Island. The current shoreline is bulkheaded. The docking facility varies slightly based on the size of boats. Along the south side of the marina the bulkhead runs east west and allows for the dockage of 12 vessels moored side to. The east side of the marina has a bulkhead runinng north to south and allows for 13 vessels mooring parallel to the bulkhead. The north side of the marina has a bulkhead which runs east west with the potential for 36 vessels mooring parallel to the bulkhead while the west end of the same wall has 12 perpendicular slips supported by a series of floating docks. The property in situated alone in what could be described as a peninsula with marsh bordering either side of the property. The channel leaving the marina holds the same classification as the receiving waters (Bogue Sound) and is classified SA-HQW. These waters are not recognized as primary or secondary nursery areas and are closed to shellfish harvesting. The access channel intersecting the federal channel is maintained at a depth of 6' below NLW, which is consistent through the marina basin. Project Description The applicant has applied to expand their existing marina facility by three slips to the west along the north side of the marina. The expansion is proposed with an additional floating platform running along the north bulkhead starting at 6' wide and tapering to 3' as it approaches the end of the bulkhead. The three slips will be supported by a floating finger pier oriented north to south and three additional mooring pilings. Note on the provided work plat drawing there are two pilings missing from sheet 2 of 4. The missing pilings are waterward of the pilings listed as E/P (existing pilings) on sheet 2. The proposed mooring pilings are proposed at the same distance FIELD INVESTIGATION REPORT: 8 1/z Marina / CARTERET COUNTY PAGE #3 --------------------------- offshore as the existing pilings in line with the end of the existing finger pier. The depth at the end of the proposed pier has been maintained at 6' below (NHW) Normal High Water during previous major permits. The proposed addition will be at most 26' from the existing bulkhead which does not exceed the quarter distance across the maintained channel. The proposal would take the total number of slips within the marina from 73 to 76. The closest waterfront neighbor appears to be Anchorage Marina, which is separated by over 200' of marsh. The applicant and Anchorage do share a common channel to the Federally maintained channel intersecting approximately 250' north of the marina entrances. Anticipated Impacts The proposal will further usurp 858 fe of Public Trust Waters and Estuarine Waters beyond the existing pier footprint. The project if approved will add an additional 3 slips to an existing 73-slip marina.There would be short-term turbidity expected from the construction of the project but none expected from the use of watercraft associated with the development due to adequate water depth and sandy substrate. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters and Public Trust Waters. Waters at the project site are classified as SA and are closed to the harvesting of shellfish. The area is not a Primary or Secondary Nursery Area. I have reviewed this proposal for consistency with the 1996 Atlantic Beach Land Use Plan Addendum and offer the following comments. The general area of the project is classified as Developed Resdential, while the AECs impacted by the work are classified as Conservation. In general,Atlantic Beach allows development in Conservation classified ABCs which is consistent with the State's minimum use standards. The Atlantic Beach Land Use Plan contains some local policies which exceed 7H guidelines including those for Marina and Floating Home Development. However,none of these more restrictive local standards appear to be applicable to this project. It is important to note that the Atlantic Beach LUP states that projects in public trust areas shall not directly or indirectly block or impair navigational channels. Provided all local, state and federal requirements can be met,this project appears to be consistent with the 1996 Atlantic Beach Land Use Plan. The marina/docking facility will display a sign showing the location of nearest/on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 2. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina docking facility. .Any sewage discharge at the marina/docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3. The authorized structure should not extend beyond the requested 26' from the existing bulkhead. 4. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application.
