PROJECT SUMMARY: Applicants propose to extend and expand the shared dock between their properties to reach deeper water for a larger vessel. Field Investigation Report: Tom Glasgow and David Horton Page 02 --------------------------- 9.NARRATIVE DESCRIPTION: The project site is a tract comprised of two vacant lots located within the existing Blair Pointe Subdivision of Morehead City, specifically, Lots 10 and 11. The property is adjacent to the Newport River, and has been cleared for development. The total shoreline length of the two lots is +2101. Currently, typical high ground grasses and weeds have vegetated the site. There is an existing pier that was built straddling the property lines. This pier crosses high marsh and low marsh, and extends into the Newport River for a total length of approximately 166'. The waters of the Newport River carry a DWQ classification of SA. The waters are not open to shellfishing at this location, however, they open several hundred feet up the shoreline within the same development. The Division of Marine Fisheries has not designated this area as a PNA. The subdivision lies within the boundaries of Morehead City, and the Town Land Use Plan categorizes the area as Urban Transition, with all AEC's classified as Conservation. The existing pier has a T-head with a floating dock at the waterward end. There are 6 mooring pilings associated that create 4 slips for the two property owners. The total square footage of existing platforms is 298, and the water depth in the location of the mooring facility is ±-4' nlw. The proposal is to remove the end float and relocate it 15' waterward of the existing, connecting to the existing dock with a new 15' x 5' pier extension. The ramp to the float would approximate another 101, creating a 28' float. The most landward pilings will be removed. A new piling will be set on the north side between the new floating L-Head and the remaining finger dock, to create two slips. A new finger dock, 5' x 50' will be constructed on the south side of the pier, 15' landward of the dock end. Two mooring pilings will.be installed 15' waterward of this dock to create a slip, extending to the waterward reach of the relocated float. A new mooring piling will be placed on the landward side of the new finger dock, for a 4th slip. The total square footage of the finished proposal will be 543 sf, for an increase of 245 sf. The total number of slips will remain at 4. The water depth at the end of the new structure will approximate -8.5' nlw. Most critical to this area is the proximity of the structures to the channel of the Newport River. Regulatory control has thus far maintained an informal pierhead line. This shoreline lies on the outside of the river's channel meander, and consequently creates a situation conducive to navigation hazards. The existing length of the subject pier is shorter than that of the adjacent piers. However, the channel is slightly concave at this location, creating a shorter distance between the channel edge and the structure. The applicant's survey shows a line connecting the longest structures up and down the shoreline to create a pierhead line. With the concave character of the channel, this line is actually in the channel at the location of the proposal. The line is 20.8' from the existing dock. It will be 15.8' from the proposed. The applicant has submitted a detailed hydrologic profile of the river in the location of the pier. This survey depicts a channel edge similar to that shown on the aerial photography, Field Investigation Report Tom Glasgow and David Horton Page 03 and has been confirmed on the ground. The Point of Beginning (P.O.B.) of the hydrologic profile represents the end of the existing fixed dock rather than the end of the overall structure. The termination point of the existing dock is approximately 16' beyond the P.O.B., or, as indicated-on the profile, ±-5' nlw, which represents the channel edge plus 11. The proposed termination point would be 31' beyond the P.O.B., to ±-8.5' nlw, or ±16' beyond the channel edge. The 3 authorized piers to the immediate north of the project site appear to be located within this channel anywhere from 5' to 201. The most accurate representation of the channel at the site location is represented by drawing a line between the southwest corner of the pier to the north, and the northeast corner of the pier to the south. This line would be 10' waterward of the dock at the site location, and according to the submitted bottom profile would reach a point ±-6' nlw. The channel width at this location is roughly 220' across, with a depth reaching to -16' nlw. 10. ANTICIPATED EMPACTS: The expansion of the docking system would add 245 sf of decked platform for a total of 543 sf. The area incorporated by tie pilings as proposed is 3320 sf. The number of slips would remain the same. The proximity of the structure to the navigation channel would decrease by 151, placing the structure approximately 16' into the channel. T. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 3. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 4. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee will .not hold the United States liable for any such damage. 16 5. No excavated or fill material will be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 6. The authorized structure and associated activity will not cause an unacceptable interference with navigation. 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 8. This Department of the Army permit does not obviate the need to obtain other Federal, State, or local authorizations required by law. 9. Biologists withAhe North Carolina Wildlife Resources Commission(Commission)reviewed the permit application with regard to impacts of the project on fish and wildlife resources. The project site was visited on April 15, 2003. Commission comments are provided in accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicants are proposing modifying an existing pier and dock structure shared by lots 10 and 11 in the Blair Point Subdivision in Morehead City,North Carolina. The property borders the Newport River,which is classified as Coastal and SA. Consistent with the existing structure,the proposed dock would accommodate four slips, but the proposed pier extension and new mooring piles would increase the structure by 245 square feet and extend it approximately 16 feet into the 220-foot wide navigation channel in this region of the river. The Commission believes that because of the channel configuration the proposed dock extension may pose a hazard to navigation even though it will not exceed the established pier head-line. During the site visit, a strong wind tide had lowered water levels in the Newport River and there was approximately 4 to 4.5 feet of vertical barnacle coverage on and water remaining around the landward pilings of the existing fixed finger piers. We are unfamiliar with the typical tidal amplitude in this area or the lunar tide status during the site visit. Nevertheless,because of these observations and the estimated normal water depth of—8.5 feet for the end of the proposed structure,we recommend that justification for the desired water depths in the slip areas be provided(e.g. boat draft requirements)before issuing a permit for the project as proposed. Because of the potential risk to navigation,the Commission feels that the dock should only be extended far enough to accommodate the necessary boat mooring depths. In addition, regardless of the final design,the opposing ends of the waterward portions of the structure should have visible reflectors or similar warning devices for boaters navigating the channel. As stated,in the field report, the critical characteristic of this,shoreline is the,meander of the river ` toward the project site. The proposal is to extend a dock,which by the applicant's own submitted bottom survey is located 1' within the channel currently, to a point 16' within the channel. The proposal would also add 245 sf to the decked platforms, for a total of 543 sf, with no change in the number of slips. The square footage is consistent with 15A NCAC 07H .0208(b)(6)(D). The number of slips was authorized at time when 4 slips were consistent with the General Permit guidelines governing piers. Under 15A NCAC 07H .0208(b)(6)(J)(iii), piers shall not extend into the channel portion of the water body. The definition of the actual channel is somewhat subjective, but the fact is that utilizing the parameters submitted,which are field accurate,there are three other docks extending into this same channel. It has been Division policy to use the top channel edge to define the channel,while the US Army Corps of Engineers utilizes the near bottom edge. The proposed pier extension' would take the applicant's pier to a point approximately 16' within the 220' chan,n." l-meas Ured from the top edge, whereas the three nearby piers extend anywhere from 5' to 20',frorn.,this,same point. My best estimate of a fair channel edge at the specific site location=-canT!,be`depicted by connecting a line from the southwest point of the:dock to the_north (Lot 9)to the northeast point of the dock to the south (Lot 14). That length would represent a 6' reduction in the applicant's request. I would offer the following conditions: 1) The proposed structure shall be reduced in length by 6', for a maximum distance waterward of no more than 10' further than the existing. The proposed shall extend no further into the Newport River than to a line that shall be established as follows: Beginning at a point on the southwest corner of the dock on Lot 9, and connecting to a point on the northeast corner of the dock on Lot 14. 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor,which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 6) This permit authorizes a maximum opeli*boat slips.
