This permit, issued on October 24, 2003 , is subject to compliance with the application(where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This minor modification authorizes the changing of the method of crossing of one wetland (W71A) from horizontal directional drilling (HDD) to an open cut, and a switch from the use of open cuts to HDD at 5 smaller wetland sites, all as indicated in the referenced permit modification request dated 8/29/03. 2) This minor modification must be attached to the original of Permit No. 51-03, which was issued on 4/11/03, as well as all subsequent modifications, refinements and/or amendments, and copies of all documents must be readily available on site when a Division of Coastal Management representative inspects the project for compliance. All conditions and stipulations of the active permit remain in force under this modification unless altered herein. NOTE; The N.C. Division of Water Quality authorized the proposed project under a modification to General Water Quality Certification No. 3274 (DWQ Project No. 030051), which was originally issued on 2/17/03 and modified on 10/20/03. This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. A written request for permit modifications was received on August 28, 2003. This request involves the replacement of the Horizontal Directional Drill (HDD) of Wetland 71A with open-cut construction. Wetland 71A is located north of Ten Mile Fork immediately west of U.S. Hwy. 17 near the Jones and Craven County line. Several other wetland crossings previously permitted to be open-cut have been identified for HDD (see attached Phase 3A Permit Modification). This modification is requested due to the length of Wetland 71A and the associated construction cost. The modification decreases temporary impacts associated with pipeline construction by 0.018 acres. The permit is hereby modified to include the work as shown on the enclosed plans. Ross Jr.,Secretary MEMORANDUM: TO: DOUG HUGGETT FROM: TRACEY WHEELER, , cLCA-1 SUBJECT: MINOR MODIFICATION—CAMA MAJOR PERMIT # 51-03 DATE: September 5, 2003 Please find enclosed a request from Ms. Shelia Hughes, Environmental Coordinator for Eastern North Carolina Natural Gas (ENCNG) requesting a modification to CAMA Major Permit # 51- 03 to change the horizontal direction drill of Wetland 71-A to an open cut. ENCNG proposes to change the method of construction in several other wetlands from open cut to horizontal directional drill. If permitted, the modification would not increase total wetland impacts. This permit was originally issued on April 11, 2003 and was amended on May 12, 2003. The permit was issued for the installation of 94.5 miles of natural gas and fiber optics line in Beaufort, Craven, Pamlico, Jones, and Onslow counties. The applicant proposes to change one 1.23 HDD crossing to open trench, and to change eleven smaller crossings constituting 1.24 ac, from open trench to HDD. None of the subject crossings are navigable, nor do they contain coastal wetland vegetation. After thorough review of the request I have determined that this proposal is consistent with 15A NCAC Subchapter 07H.0208, and .0209. Therefore, I recommend the Minor Modification be authorized and that all original conditions of the issued permit remain in effect. To balance this request, EastemNC has identified several other wetlands that were previously permitted to be open-cut for HDD construction. The modification request is being submitted due to the length of W71A, which will cause EastemNC to face a tremendous construction cost. The longer the length of a HDD the more costly it is per foot of HDD, which we need to avoid where possible under our budget constraints. EastemNC had previously submitted the Phase IIIA permit application book when this information was discovered, and it was an oversight on our part. EastemNC would like permission to open-cut W71A, and HDD others listed to bring the length of wetlands drilled to the original permitted amount. Therefore, overall wetland impact numbers are not changing. The table attached lists all wetlands requested for open-cut and each corresponding length. Our environmental consultant, Environmental Services, Inc. (ESI), used GPS technology to gather all wetland and/or stream data points and flagged them in November of 2002. Aerial maps showing the exact location and acreage's of both the proposed open-cut of W71A and HDD's for each wetland are attached for your information.
