Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) The project will be carried out in strict compliance with the workplan drawings, submitted as part of the application dated 10/30/02, and received as complete on 11/20/02, by the Division of Coastal Management, and the letter dated 12/13/02, except as altered herein. 2) In accordance with commitments made in the permittee's letters dated 12/13/02 and 2/27/03, the proposed Phase II development is hereby deleted from the authorized project. Phase II development includes the creation of Lots#42-74, development of the roadways (Daisy's Way and Joseph Court) and appurtenances including the wetland crossing at Daisey's Way. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee c Charleston Associates, LLC Permit# 16-03 Page 2 of 6 ADDITIONAL CONDITIONS Shoreline Stabilization 3) The authorized alignments of the permitted bulkheads/retaining walls must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 4) The authorized bulkhead on the common area lot will not extend waterward more than 5 feet from the normal water level at the time of construction. 5) The authorized bulkheads/retaining walls on lots 6-16 will average 40 feet landward of the normal water level at any point along its alignment at the time of construction. 6) The authorized bulkheads/retaining walls must be constructed prior to any backfilling activities. 7) The authorized bulkheads/retaining walls must be structurally tight so as to prevent seepage of backfill materials through the structure. 8) The authorized bulkheads/retaining walls must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 9) The backfill material will be clean and free of any pollutants except in trace quantities. 10) All backfill material will be obtained from a high ground source and confined behind the permitted bulkheads/retaining walls. 11) All back fill material to be placed below normal water level will be confined behind the permitted bulkheads/retaining walls. Excavation 12) This permit authorizes excavation below the normal water level as necessary to construct the authorized concrete boat ramp as depicted on C 1 dated 10/30/02. 13) No vegetated wetlands will be excavated. 14) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. Spoil Disposal 15) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Charleston Associates, LLC Permit# 16-03 Page 3 of 6 ADDITIONAL CONDITIONS 16) The disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 17) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Concrete Boat Ramp 18) The concrete boat ramp must be poured on high ground and pushed or placed into the water once hardened. No live concrete may come into contact with the water. Community Docking Facilitv 19) The designated Common Area along the Pamlico River shall be deeded accordingly and recorded with the Beaufort County Register of Deeds. A copy of the recording shall be provided to the Division of Coastal Management prior to the initiation of construction activities on the docking facility. 20) In accordance with 15A NCAC 711 .0208 (b) (6) (D) which states that "the combined area of all "T"s, finger piers, platforms, and decks must not exceed a combined total area of four square feet per linear foot of shoreline", the proposed project is allocated 960 square feet of platform size. As currently proposed, the total area of platform equals 1,200 square feet. Prior to the initiation of construction of the docking facility, the applicant shall submit a revised plat to the Division of Coastal Management that assures compliance with 15A NCAC 7H .0208 (b) (6) (D). The revised plat shall also accurately depict details of adjacent riparian property lines and the required 15-foot setbacks. 21) In accordance with the 1997 Beaufort County Land Use Plan, prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility will be installed and operable, and maintained for the life of the authorized 10-slip community docking facility. 22) The docking facility will display a sign showing the location of the onsite pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 23) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 24) The authorized structures and associated activity must not cause an unacceptable interference with navigation. 25) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. Charleston Associates, LLC Permit# 16-03 Page 4 of 6 ADDITIONAL CONDITIONS 26) The docking facility and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 27) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 28) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 29) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 30) This permit authorizes a maximum of ten (10) boat slips. At no time shall more than 10 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: Any proposal to add one or more additional boat slips to the authorized 10 slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. NOTE: With the exception of excavation authorized in Condition #12 of this permit, dredging in any manner, including "kicking" with boat propellers, is not authorized. Any future dredging will require a major modification to this permit. Charleston Associates, LLC Permit# 16-03 Page 5 of 6 ADDITIONAL CONDITIONS Community Boardwalk 31) Any portion of the permitted community boardwalk built over wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. Wooden Groin Construction 32) The wooden groins shall not extend more than 25 feet waterward of the normal water level. 33) The wooden groins shall be set back a minimum of 15 feet from the adjoining property lines. 34) The wooden groins shall pose no threat to navigation. 35) The height of wooden groins shall not exceed 1 foot above the normal water level. Sedimentation and Erosion Control 36) The Department of Environment and Natural Resources, Land Quality Section issued the Erosion and Sedimentation Control Plan No.Beauf-2003-007 on 12/5/02. Any violation of the plan approved by the Land Quality Section will be considered a violation of this LAMA permit. 37) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 38) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 39) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Management 40) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7021106 on 1/24/03, which shall replace SW7020405 dated 12/20/02. Any violation of the permits approved by the DWQ will be considered a violation of this CAMA permit. Charleston Associates, LLC Permit# 16-03 Page 6 of 6 ADDITIONAL CONDITIONS General 41) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the State of North Carolina on account of any such removal or alteration. 42) No vegetated wetlands will be filled outside of the authorized areas. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The permittee is advised that any development or land disturbing activity that is considered non- water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar/Pamlico River buffer regulations in place at the time of such development. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3371 (DWQ Project No. 021841), which was issued on 2/24/03. PROJECT SUMMARY: The applicant proposes to construct a bulkheaded 80 lot Subdivision with an access lot and 10-slip pier at Whitehurst Shores Subdivision at Core Point. Whitehurst Shores Subdivision Beaufort County Project Setting Whitehurst Shores subdivision is being developed by Charleston Associates, LLC and is located at the end of SR 1167 (Whitehurst Road) adjacent the Pamlico River near the Blount's Creek Community in Beaufort County, North Carolina. This is a new 80-lot subdivision covering ±147 acres with ±1,600' of shoreline frontage. The majority of the property is existing agriculture fields vegetated with various upland grasses. Several hardwoods are present adjacent the shoreline of Pamlico River. The shoreline is an approximately 40' wide sandy beach that ends at a 3-5' erosion escarpment adjacent the agriculture fields. A large portion of the tract has been delineated as Section 404 wetlands by the U.S. Army Corps of Engineers and predominately is a wetland slough on the upstream (west) end of the property. The wetland area is vegetated with various hardwoods and some pines with an undergrowth of vines and shrubs in the transition area between wetlands and uplands. The project area is bordered on the upstream (west) side by wooded wetlands. The downstream (east) side is bordered by a developed and bulkheaded lot vegetated with lawn grass and several hardwoods. The property along the waterfront is not contiguous and is made up of four distinct sections segmented by private inholdings. The upstream section is made up of lots 15 and 16. The next section going downstream comprises lots 3 through 14, and the third section will make up lots 1 and 2. Lots 1 through 5 are bulkheaded at the erosion scarp with a sand beach ±30' wide. The downstream section will comprise the common access lot and this area is ±240' wide by ±50' deep. These four sections are separated by developed residential lots that are bulkheaded or have riprap. The existing properties will all have access from a proposed road that will run parallel to the river. The project site is ±4' above the normal water level (NWL). A portion of the proposed project is within the Tar-Pamlico River buffer basin jurisdiction. The Pamlico River is classified as SA-NSW by the Environmental Management Commission. The Pamlico River is not open to shell fishing in this area. Project description The applicant proposes to construct a pier, boat ramp and bulkhead on the common lot. The pier will be ±6' wide by ±304' long and have a ±6' wide by ±150' long T-head. Ten(10) slips are proposed on the waterward side (seaward) of the T-head and will be defined by five- 3' by 20' finger piers and 23 tie pilings. The total length of the pier complex will be ±340' and the existing water depth at the proposed slips is-3' below NWL. Approximately 240' of bulkhead is proposed on the common lot with the ±60' center section projecting ±5' waterward of the NWL and the sides will be winged back into the highground to preserve the beach on both ends. The proposed boat ramp is located in the center of the 60' bulkhead section and will be 15' wide and 30' into the water. The existing water depth at the end of proposed boat ramp is -1' below the NWL and the applicant proposes to excavate the slope to a-3' below the NWL. A ±82' long paved approach from the existing SR road to the proposed ramp will be constructed. A gravel parking area is proposed for the boat ramp and it will be located on the landward side of SR 1167. Whitehurst Shores Subdivision Beaufort County Page Two Approximately 1,360' of bulkhead/retaining wall is proposed for lots 6 through 16. The wall will average 40' landward of the NWL at the erosion scarp leaving the existing sandy beach natural. Six (6) 25' long wooden groins are proposed along the waterfront and they will project 25' into the river with a maximum height of 1' above the NWL. A t6' wide by f 2,600' long boardwalk is proposed in the 404 delineated wetlands providing a nature trail and a pedestrian access within the Subdivision. A recreation area with a covered shelter and a secured boat storage area are proposed on portions of the property that are well inland. Anticipated impacts The project as proposed will result in filling of±950 ft2 of river bottom associated with the placement of the boat ramp and bulkhead. The construction of the pier will result in the shading of t3,024 ft2 of river bottom and the construction of the boardwalk will result in the shading of f 15,600 ft2 of 404 wetlands. The construction of the roads will result in the filling of f 14,374.8 ft2 of 404 wetlands. The project as proposed will result in localized turbidity as a result of the construction activities.
