This permit, issued on May_51 200- , is subject to compliance with the application(where consistent
with the permit),all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) Unless specifically altered herein, this minor modification authorizes the following activities all as
depicted on the attached workplan drawings:
a. an increase in the size of the 3 end platforrns'from 3' by 46' to 8' by 46' and the addition of
bumper pilings to the outside of the new platforms,
b. and the addition of 3' X 3' triangle sections where the finger piers meet the main piers.
2) The minor modification authorizes the installation of a permanent pumpout facility at the T-head
platform located in the center of the docking facility. The pumpout location originally proposed by the
permittee is not authorized.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) This minor modification shall be attached to the original of Permit No. 16-03, which was issued on
2/27/03, the minor modification issued on 10/14/03, and the major modification issued on 12/21/05 and
copies of all documents shall be readily available on site when Division personnel inspect the project for
compliance.
4) All conditions and stipulations of the active permit remain in force under this minor modification unless
specifically altered herein.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form)and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this pen-nit within twenty(20)days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

SUBJECT: Modification of CAMA Major Permit No. 16-0Wp&V10MakktJoWMciates,
LLC
CAMA Major Permit No. 16-03 was issued to Charleston Associates, LLC, C/O Charles
Smith for the construction of a 80 lot subdivision (Whitehurst Shores Subdivision)at the end of
SR 1167 at Core Point on the Pamlico River near the Blount's Creek Community in Beaufort
County, North Carolina. The permit authorized the construction of a bulkhead along the
waterfront, a boardwalk over wooded wetlands and a 10 slip pier with a boat ramp on the
common lot at the west end of the project site. A major modification was issued on 21
December 2005 to develop a marina by adding 42 slips for a total of 52 and changed the
name on the permit from Whitehurst Shores to Eagle Trace. All work authorized by the
original permit and several subsequent modifications has been completed. Presently, the work
authorized by the Major Modification for the additional slips is underway.
The East Group, acting as agent, has requested the following modifications to the
permit:
1) Increase the size of the 3 end platforms from 3' by 46' to 8' by 46' and add bumper
pilings to the outside of the new platforms for day docking.
2) Add 3' by 3' triangle sections to the areas where the finger piers meet the main
piers to make access to the finger piers easier.
3) Install a permanent pump-out on a 4' by 12' platform with a collection system
outside the 75' Coastal Shoreline AEC.
The proposed changes will increase the total square footage impact from the permitted
±23,580 ft2 to ±24,228 ft2. This value is still well below the 41,904 ft2 allowed by the 27 square
foot rule with a 1,552' shoreline. The proposed bumper pilings do not create permanent slips
so the overall slip number of 52 will remain the same.
I suggest that we modify the permit to allow the requested changes 1 and 2, and allow
the existing conditions to remain including the 31 December 2008 expiration date. In regard to
the third request, due to the shallow depth of the water at the proposed location, I recommend
that we condition the permit to move the pump-out to the waterward end of one of the
platforms and deny the additional 4' by 12' platform. The $100 check covering the cost of the
modification has been deposited in the Department's account.

Re: EAGLE TRACE MARINA
Dear Mr. Moye,
We are currently constructing the Proposed Dock Expansion for the EAGLE
TRACE MARINA as per the approved CAMA Major Permit No. 16-03, as approved on
12/21/05.
As per the approved permit,portable pump-out tanks were to be used to pump
sewage out of boats and for storing sewage until they could be pumped out from a
licensed contractor. After consulting with the owner and NCDENR, the owner has
elected to install a central pump-out station on the dock and force main to a proposed
1200 gallon holding tank as detailed on the attached drawings. This would increase the
total area of the Marina by 48 SF.
The owner is also requesting to increase the end platforms from 3' in width to 8'
in width. This would increase the total area of the Marina by 600 SF. We would also
like to install some tie-down mooring post to provide temporary docking spots for
visitors.
Also, we're proposing to add a triangular platform to each finger pier at the
intersection of the finger pier and main walkway. This is shown in detail on the attached
plan. No overall dock area is affected by the change.
The total proposed area increase is 648 SF,bring the Marina total to 24,228 SF
total. This would require a water frontage of 898 LF. The owner currently has reserved ENGINEERING
1,552 LF of water frontage for the purpose of constructing a central Marina to serve the
Eagle Trace Subdivision. ARCHITECTURE

Attached is a plan depicting these proposed changes in the Marina design
including the proposed location on the pump-out tank.
This pump-out plan has been reviewed in the field with Ted Lyons of NCDENR-
Division of Waste Management—Solid Waste Section and has been submitted to his
office for approval.
We are requesting a minor modification to the existing Cama Major Permit (No.
16-03) for approval of construction. If you have any further questions or comments,
