Upland Development 1) This permit authorizes the filling of 404 wetlands, construction of a single-family residential structure, installation of the associated septic system and construction of a gravel driveway that is expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. 2) The alignment of the authorized gravel driveway access must be staked prior to the start of construction. This staked alignment shall be approved by a representative of the Division of Coastal Management prior to the commencement of any construction of the driveway access. 3) No portion of the single-family residential structure shall be located within 30 feet of the normal high water line. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee 1 George & Sandra Evans Permit#129-03 Page 2 of 5 ADDITIONAL CONDITIONS 4) No coastal wetlands will be excavated or filled. 5) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawings. 6) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 7) All fill materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate retaining structures to prevent spillover of solids into any marsh or surrounding waters. 8) The Town of Topsail Beach approved this project under Zoning Permit No. 03-24-01C. All upland development authorized by this permit shall be done in accordance with the approve Zoning Permit. NOTE: The permittee is advised to contact the local health department regarding requirements for septic tank installations (as required under 15A NCAC 18A.1900 et. seq.). For information concerning septic tank and other on-site waste disposal methods, contact the Pender County Health Department. NOTE: In order to avoid unreasonable danger to life and property, all development should be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Any building constructed should comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Wooden Access Bridge 9) The wooden bridge shall be built as depicted on the attached workplan drawings 10) The alignment of the authorized bridge crossing over coastal wetlands must be staked prior to the start of construction. This staked alignment shall be approved by a representative of the Division of Coastal Management prior to the commencement of any construction of the bridge crossing. 11) The permitted bridge must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 12) The permittee shall take all necessary precautions to minimize damage to any coastal wetland areas during the construction of the permitted bridge. Construction mats shall be used when crossing any wetland area. Any spoil material resulting from the installation of the bridge structure shall be removed from the wetland area to an approved high ground location. 13) All construction mats must be removed immediately upon completion of the construction of the permitted bridge George & Sandra Evans Permit#129-03 Page 3 of 5 ADDITIONAL CONDITIONS 14) At no time shall building materials or construction debris be stored, stockpiled or left in coastal wetlands. 15) The permittee shall monitor all temporary impact areas for the re-establishment of coastal wetland vegetation. Should the impacted areas fail to re-establish to the satisfaction of the Division of Coastal Management, the permittee may be required to undertake additional remedial actions. Docking Facility 16) This permit authorizes the private docking facility located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 17) The private docking facility shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 18) Any portion of the permitted access pier built over coastal wetlands must not exceed six feet in width -and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 19) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 20) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 21) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 22) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of-this requirement if he abandons the permitted activity without having it transferred to a third party. 23) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. 7 Coast Guard, through regulation or otherwise, on the authorized facilities. 24) This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the private docking facility. 7 Flnorder ns Permit#129-03 Page 4 of 5 ADDITIONAL CONDITIONS Sedimentation and Erosion Control tect water quality, runoff from construction must not visibly increase the amount of supments in adjacent waters. 26) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 27) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Management 28) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8030430 on 6/30/03. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. Water Ouality 29) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 030852), which was issued on 8/1/03. Any violation of the water quality certification issued by the DWQ will be considered a violation of this CAMA permit. 30) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. General 31) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: No development or land disturbing activity that is considered non-water dependent is authorized within 30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time of such development. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit No. 18 and General Permit No. 197800056 (COE Action Id. No. 200200787) which were issued on 9/5/03. PROJECT SUMMARY: The applicant proposes to bridge coastal wetlands and fill 404 type wetlands for a driveway access to high ground for his proposed single family residence. He also is proposing to build a pier and dock. George and Sandra Evans Page Two July 1,2003 9. PROJECT DESCRIPTION The applicant's property is a 1.57-acre tract of land located at 1133 and 1134 N. Anderson Blvd., consisting of two lots,Lot 18& 19 which runs from the ocean to the sound,in the Town of Topsail Beach, in Pender County. The site is located just to the south side of Queens Grant Condominiums approximately 5.0 miles south of the intersection of NC Highway 50 and NC Highway 210(Surf City stop light). The tract encompasses property from the oceanfront(1133 N. Anderson)to the estuarine shoreline(1134 N. Anderson)on Topsail Sound. The property on the oceanside of N.Anderson Blvd. is approximately 100 feet wide by 133 feet in length. The ocean side property is vegetated with sea oats(Uniola sp.), American Beach Grass(Ammophila breviligulata),catbrier(Smilax sp.),bear grass(Yucca filamentosa) and Indian Blanket flower(Gaillardia pulchella). The Area of Environmental Concern(AEC)on the ocean side consists of a 255' ocean erodible area and is therefore a Coastal Management Area of Environmental Concern(AEC)which extends across N. Anderson Blvd. to the portion of the tract where the proposed driveway access and some filling of 404 type wetlands is being proposed. The parcel of land on the oceanfront is not being proposed for development at this time. The portion of Lots 18& 19 on the sound side of the tract consists single-family-residential lots each measuring approximately 50' wide and approximately 685 to 690'deep. The elevation of the property is approximately 5 feet above normal high water. There are no man-made features located on this property at present. The vegetation on the tract varies from the side bounded by N. Anderson Blvd to the Topsail sound side of the property. The high ground vegetation on the N. Anderson Blvd side of the tract includes: Sweet Bay(Magnolia virginiana),Yaupon(Ilex vomitoria)Catbrier(Smilax sp.),Ragweed(Ambrosia sp.) and Virginia Creeper(Parthenocissus quinquefolia). The lot goes into a wetland area covered with Common Reed(Phragmites communis)that grades into a coastal wetland with Salt Grass(Distichlis spicata),interspersed with Sea Lavender(Limoium carolinanum), Sea Ox-eye(Borrichia frutescens)and monospecific stands of Black-needle Rush(Juncus roemerianus). Small hummocks vegetated with Red Cedar(Juniper virginiana),Marsh Elder(Iva fmtescens),Wax myrtle(Myrica cerifera)and poison Ivy (Rhus radicans)are also scattered within this coastal wetland area. The tract grades back up into high ground vegetated with Yaupon(Ilex vomitoria), Sweet Bay(Magnolia virginiana),Live Oaks(Quercus sp.),Wax Myrtles(Myrica cerifera),Grape vines(Vitis sp.),and Poison Ivy(Rhus radicans). The sound side portion of the tract is vegetated with an approximate 40-foot fringe of coastal marsh containing Smooth Cordgrass(Spartina alterniora),Glasswort(Salicornia sp.), Salt Meadow Hay(Spartina patens), and some Sea Oxeye(Borrichia frutescens). The waters adjacent to the project are classified"SA"by the Division of Water Quality. The area is not designated a Primary Nursery Area and is open to the taking of shellfish. The applicant is proposing to fill approximately 143'by 25' of 404 type wetlands for a driveway access to the high ground portion of the tract located on the sound. The applicant is also proposing to bridge 170' by 12' of coastal wetlands to complete the access road to the high ground. The bridge would start at the 404/coastal wetland border and continueY to 4' above the marsh substrate across to the coastal/404 wetland boundary on the western(or sound)side of the property. The proposed bridge is proposed to be constructed of pressure treated piles, structural lumber and decking. An additional 268.31' of uplands would also need to be graded and/or filled to complete the driveway to the proposed residence. The applicant is proposing to build an approximate 3000 sq ft residence on the upland portion of the tract along the sound side of the property. The residence is proposed to be constructed outside the 30' buffer area,but with a portion of the house and decks within the 75' estuarine shoreline AEC. The house is proposed to be built on the center of the two lots on the high ground portion of the parcel located adjacent to the sound. In George and Sandra Evans Page Three July 1,2003 addition the applicant is proposing a 4-slip dock and pier also to straddle the two lot lines on the sound side. The pier is proposed to be 5' X 60' long(measured from normal water level,from high ground it will be approximately 70' long)that will terminate into a 10' X 25' T-head dock. The project as proposed would provide docking space for up to four vessels. The proposed dock would have approximately 6' of water depth at low tide. 10. ANTICIPATED IMPACTS The proposed 404-type wetland fill for the driveway access to the high ground would result in a 3575 sq ft of impacts. The proposed bridge would result in a 2040 sq ft of coastal wetland shading and temporary impacts from the bridge construction. The construction of the residence with associated landscaping and driveway on uplands would disturb approximately 9177 sq ft and would result in a 27.6%impervious area within the 75' Area of Environmental Concern(AEC). The pier,dock,and 4 boat slips would result in the incorporation of 1030 square feet of public trust area. This permit authorizes only the 143' by 25' 404 type wetland fill for the driveway access to high ground. 2. This permit authorizes the temporary impact of 170' by 12' of coastal marsh for a bridge crossing(which is to be 3' above the marsh substrate) 3. This permit authorizes the construction of an approximately 3000 sq ft residence with driveway within the AEC resulting in 27.6%impervious surfaces. 4. All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. In order to protect water quality,runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 5. This permit authorizes only dock,T-head and 4 boat slips located in or over the water that are expressly and specifically set forth in the permit application. No other structures,whether floating or stationary,may become a permanent part of the structure without a permit modification. TOPSAIL BEACH, NC This project includes the construction of a private residence,pier and driveway on the property located at 1132 and 1134 North Anderson Blvd., Topsail Beach,NC. The residence will be of stick built construction as per the NCSBC 2002 edition—Residential covering approximately 3000 square feet. A pier shall be constructed of pressure treated piles and lumber extending approximately sixty feet from the mean high water level and terminating into a platform twenty five feet in length. Access to the residence will be provided by the construction of a 581-foot driveway, including a 170-foot single lane bridge. 143-feet of the driveway will require the placement of fill materials in wetlands. 85.31-feet of fill may be required in the uplands adjacent to North Anderson Blvd. leading to the bridge. This fill will be placed in six to nine-inch lifts such that a nine-foot wide roadway with minimum three to one side slopes are constructed. Screened topsoil and vegetative cover shall be placed immediately upon completion of the fill sections. An additional 183-feet of upland disturbance will result from grading and placement of gravel to complete the driveway. Bridge sections shall be constructed of pressure treated piles, structural lumber and decking. Load spreading mats will be used to support Equipment required for construction. Very minor disturbance to the delineated marsh areas is expected. Any disturbance to the marsh shall be remediated in a timely manner. Anderson Blvd., Topsail Beach, Pender County,North Carolina. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. A site visit was made on August 7, 2003. We regret that time constraints delayed our response. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The applicant is seeking authorization to bridge coastal wetlands and fill 404 (freshwater) wetlands to access a high ground mid-section of 2 lots adjacent to Topsail Sound on which a house is to be constructed. A 4-slip boat dock is also proposed that would have 6 ft. of water depth at low tide. The 2 lots have beachfront on the ocean side of Anderson Blvd. that comprises a relatively small portion of the total project tract and these areas are not to be developed at this time. Alternating or intermingling coastal and 404 wetlands with scattered hummocks and uplands provide exceptionally good fish and wildlife habitat on the sound side of the road. Coastal wetlands are integral components of estuarine productivity and 404 wetlands provide protective stormwater retention and treatment functions in addition to increasingly rare amphibian habitat. Area waters are classified SA and open to shellfish harvest. The access bridge would shade 2,040 sq. ft. of productive coastal wetlands and filling associated with the access road would destroy 3,575 sq. ft. of 404 wetlands. Bridge construction will disturb wetland vegetation and may compact wetland soils. We anticipate the dock pier will also shade coastal wetlands. Based on these concerns, we strongly recommend permit issuance only under the following conditions. Development will occur on the sounside portion of the lots—located west of North Anderson Blvd. Development will impact Estuarine System Areas of Environmental Concern(AECs), which include: Public Trust Area,Estuarine Waters and Estuarine Shorelines. The lots are located within the Ocean Hazard Area(OHA)AEC;however,development will not impact the OHA AEC. Waters are classified SA,and are open to shellfishing. The Primary Nursery Area(PNA) designation does not apply. The permit application was reviewed for consistency with the Town of Topsail Beach Land Use Plan (LUP) Update. The Developed—Constrained Low-Density ResidentiaUSupporting Services land classification applies to the upland portion of site and OHA AEC. The Conservation—Marshlands land classification applies to the Estuarine System AECs. The Developed classification provides for continued development and redevelopment. The Conservation classification provides for the effective long-term management and protection of significant, limited or irreplaceable areas. This project is consistent with the LUP provided all local, state and federal regulations are met. The following LUP policies are applicable: Estuarine Waters--Appropriate uses may include simple access channels, structures which prevent erosion, navigational channels, boat docks, marinas,piers and mooring pilings. Public Trust Area— Uses that may be allowed in public trust areas shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Examples of such uses include the development of navigational channels or drainage ditches, the use of bulkheads and groins to prevent erosion, the building of piers, docks or marinas. Estuarine Shorelines—Suitable land uses within the estuarine shoreline AECs are those compatible with both the dynamic nature of estuarine shorelines and the values of the estuarine system. The permittee shall at all times provide adequate erosion control measures in conformance with the approved Erosion Control Plan. 2. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 3. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction for the following items: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign of, addition to or deletion of the approved amount of built-upon area, regardless of size. e. Further subdivision of the project area. f. Alteration of the proposed drainage. 4. The Director may determine that other revisions to the project should require a modification to the permit. 5. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to*143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws,rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal change of ownership request must be submitted to the Division of Water Quality accompanied by appropriate documentation from both parties involved, and other supporting materials as may be needed. The approval of this request will be considered on its merits, and may or may not be approved.
