This permit, issued on July 11,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Maintenance Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation associated with Phase H of the maintenance excavation will be permitted between April land September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 2) Phase I of the maintenance excavation may be conducted at any time. 3) Excavation will not exceed -4 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 4) No vegetated wetlands will be excavated or filled. Signature of Permittee '1► Town of Emerald Isle Permit#91-03 Page 2 of 3 ADDITIONAL CONDITIONS 5) All excavation shall remain at least 10 feet from the edge of any coastal wetlands. 6) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 7) The permttee shall comply with the attached list of U.S. coast Guard Regulations. Spoil Disposal 8) The spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 9) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) No spoil material is to be placed within 30 feet of the normal high water line. 11) The disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of erosion of excavated material into surrounding wetlands or waters. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 15) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity iri the waterbody is 25 1,UU's or less in all saltwater classes are not considered significant. 16) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 030415), which was issued on 5/9/03. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 200300640. 1 COAST GUARD REGULATIONS APPLICABLE TO DREDGE OPERATIONS Below is a list of regulations which are applicable to dredge operations in the COTP Wilmington zone. This list is not all inclusive. We encourage dredge companies to schedule a meeting with members of the USCG staff, in order to be provided amplifying information or answers to any questions that may exist. We also strongly encourage all Uninspected Towing Vessels (UTV) associated with each dredging operation to participate in the USCG's Voluntary Commercial Dockside Examination program. PROJECT SUMMARY: The Town of Emerald Isle proposes to conduct maintenance excavation within an existing canal and access channel serving the residents of Bogue Sound Drive, and individual boaters of Bogue Sound. r Field Investigation Report: Town of Emerald Isle, c/o Mr. Tom Hoover Page 02 --------------------------- 9.NARRATIVE DESCRIPTION: The applicant is the Town of Emerald Isle. The property is a developed residential area on Bogue Sound Drive, on the north side of the island fronting a canal parallel to Bogue Sound. A marsh island lies between the canal and the sound, the canal having been excavated prior to 1978. The community is heavily built-out, with most residences and vacant lots having docks within the canal. The access channel to the west was excavated at the time of the original canal dredging, and connects to the deeper waters of the sound. The east end has never been opened. There is very little marsh along the mainland shoreline at this location, most properties being stabilized with bulkheads. The waters of Bogue Sound and the subject canal are classified SA-ORW by the DWQ, and are open to the taking of shellfish. The Division of Marine Fisheries does not categorize the sound or canal as Primary Nursery Area. The Land Use Classification for all AEC's is Conservation, and this proposal lies entirely within the Public Trust Area of Environmental Concern. The 1978 photography clearly shows a canal and channel along this shoreline, with a continued use until present. Though the photos from 1978 until 1995 clearly show the canal and channel as distinct features, the applicant maintains that it has never required maintenance until now. The 2000 photo shows that the access channel has shoaled significantly in the 5 years between flight lines. The bottom in the canal area is silty sand, and does not appear to support a significant shellfish population. The substrate of Bogue Sound is sand. No submerged vegetation appears within the project area. The applicants are proposing to excavate the length of the channel and canal over two phases. The first phase would be the excavation of the entrance channel for a length of 400', to include the first 90' of canal, with an average width of 50', and a maximum width of 60 . The current water depth within this area averages -2' nlw, with a connecting water depth of 4' nlw, which shallows to -2' before reaching the consistent water depth of 4'. The total cubic yardage to be removed from this area is approximately 1300 to reach the requested depth of-4' nlw. Phase 2 of the proposal is to excavate the shore parallel canal for the total length minus the first 90', or 2922', with an average width of 30'. This area currently has a water depth of- 2' nlw, shallowing to-1' at the eastern end. Approximately 7400 cubic yards of material will have to be removed to reach the desired depth of-4' nlw. No marsh is proposed for excavation with this project, and the plats show a minimum distance of 5' between the excavation and the marsh edge. The excavation is to be conducted by clam bucket to barge, with spoils being offloaded to truck at the Kelly Lane street end. Spoil will be carried offsite and deposited on a site as of yet.unknown. The spoil area will have to be approved before any excavation can occur, but because of the excavation method, there are many options. The intended use is to continue allowing ease of water access to the community, but the actual use will be by any boaters desiring ingress into the canal. ANTICIPATED IMPACTS: As proposed, the project will disturb approximately 2.5 acres of shallow bottom habitat that has been previously disturbed, removing approximately 8000 cubic yards of material from the area. Turbidity impacts can be expected during excavation. Because of the unusually large amount of spoil to be removed by this excavation method, the length of project time will be greater than usual. T. This lies within Bouge Sound along the northern shore of Emerald Isle. Areas of Environmental Concern (AEC's)impacted by the proposal include Estuarine Waters and Public Trust Waters. Waters at the project site are classified as SA ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1996 Emerald Isle Land Use Plan Update and offer the following comments. The general area of the project is classified as Developed Residential, while the AECs impacted by the work are classified as Conservation. In general,the Town of Emerald Isle allows development in Conservation classified AECs which are consistent with the State's minimum use standards. The Emerald Isle Land Use Plan contains some local policies which exceed 7H guidelines. However, none of these more restrictive local standards appear to be applicable to this project. Provided all local, state and federal requirements can be met, this project appears to be consistent with the 1996 Emerald Isle Land Use Plan. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 11. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 12. The permittee shall comply with the attached list of United States Coast Guard Regulations. 13.
