Lumina Avenue, Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at AIWW, at 1207 Airlie Rd., Wilmington , as requested in the permittee's application domed letter dated 7/28/03. including the attached workplan drawing (1), dated 7/18/03 This permit, issued on October 20,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This minor modification authorizes the extension of the fixed pier and floating dock in order to eliminate the previously authorized dredging as well as the relocation of the boatlift that is expressly and specifically stated in the application and as depicted on the attached workplan drawing. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The previously authorized dredging is hereby deleted as a permitted activity. 3) The pier extension and relocated boatlift shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. (See attached sheet for Additional Conditions) i This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Dooley Permit#90-03 Page 2 of 2 ADDITIONAL CONDITIONS 4) The authorized structures and associated activity must not cause an unacceptable interference with navigation, and shall not exceed the established Wrightsville Beach pierhead line. 5) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) This minor modification does not authorize the interference with any existing or proposed Federal project, and the pennittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 11) This minor modification must be attached to the original of Permit No. 90-03, which was issued on 7/2/03, and all documents must be readily available on site when a Division representative inspects the project for compliance. 12) All conditions and stipulations of the active permit remain in force under this modification unless altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. The requested modification (enclosed) consists of extending the existing fixed pier, dock and boatlift 40 feet waterward in order to eliminate the previously authorized dredging. The modification requested by the permittee is a 40'extension to the existing fixed pier and floating dock,located at 1207 Airlee Road,adjacent to the Atlantic Intracoastal Waterway, in Wilmington, New Hanover County. The original permit was issued on July 2, 2003 for excavation around the docking facility at the above referenced location. The applicant was permitted to dredge an area approximately 60'x 31'x -5'around the floating dock and boatlift.The modification request would allow the permittee to construct/extend the existing fixed pier and floating dock another 40' waterward to eliminate the need for dredging. The applicant is also proposing to relocate the existing boatlift 30' waterward. The relocation of the boatlift will not create any additional slips. The applicant currently has adequate shoreline frontage to incorporate the additional square footage. Additionally,the extension of the fixed pier and floating dock will be within the Wrightsville Beach pier head line and outside of the CORP setback. No navigational impairments are expected with respect to the proposed alterations. At this time, the Wilmington Regional Office has no objection to this modification request. The existing permit conditions will have to be changed to reflect the changes in the nature of the project. Check#12189,in the amount of$100.00, has been enclosed for processing.
