9. PROJECT DESCRIPTION
The applicant's property is located at 1207 Airlie Road, in Wilmington, in New Hanover County. The
property is located on the western side of the Atlantic Intracoastal Waterway just south of the Gray
Gables community docks. The subject property is split along the eastern edge by Airlie road. The pier
and docking facilities are located to the east of Airlie road and the residence is located on the western
side. The Existing structures on the property include a private residence, pier, floating dock and boatlift.
The high-ground property is approximately one acre in size and has an average elevation that ranges
from three to twenty feet above normal high water. The highground property is vegetated primarily with
Live Oaks, shrubbery, and lawn grasses. The applicant's property has approximately 80' of frontage on
the Atlantic Intracoastal Waterway. The entire shoreline is stabilized by a vertical wooden bulkhead.
Waterward of the bulkhead is a border of coastal marsh composed primarily of Smooth Cordgrass
(Spartina alterniflora), averaging 50'-55' in width. The Smooth Cordgrass (Spartina alterniflora), is
intermixed with Black Needlerush (Juncus roemerianus) in the upper section of the coastal marsh. High-
ground shrub vegetation is primarily dominated by Wax Myrtle (Myrica cerifera) and Grounsel-bush
(Baccharus halimifolia). The pier on the property extends into the Atlantic Intracoastal Waterway
approximately 200', including the 8' wide x 24' long floating docks (which receives ramp access from the
fixed pier walkway). The pier(4'wide x 135' long) also includes a gazebo (12' long x 16'wide),
approximately 60' from the waterward end of the structure.
The waters of the Atlantic Intracoastal Waterway in the vicinity of the project site are Classified"SB#"
by the Division of Water Quality. The Division of Marine Fisheries have no designated Primary Nursery
Areas within 4000' of the project location. The waters surrounding the subject property are closed to the
harvesting of shellfish.
The applicant is proposing to dredge a basin to access the existing floating dock and boatlift. The basin
would consist of an 60'x 30' area, extending approximately 8' north, 15' south and 27' east of the existing
floating dock. Existing water depths in proposed excavation area range between -1.0' and -2.5' MLW.
The applicant proposes to excavate to -5.0'Normal Low Water(NLW). Based on inspection of aerial
photography, the current location of the applicants floating dock outside of the 80'US Army Corp of
Engineers setback. The applicant states that when the first pier was constructed there was ample water
depth at low tide, and that shoaling in recent years has limited the use of the south side of his docking
facility. The applicant is proposing to excavate the material using a barge mounted excavator. The
material would be loaded directly onto a barge and transported to the disposal site, which is an upland
diked disposal island located outside of the US Army Corps of Engineer's Right of Way, on the east side
of the AIWW, 800' east of the subject property. The applicant has obtained letters of permission from
the owners of the island for this activity. The applicant estimates that approximately 275 cubic yards of
material would be removed from the proposed project site.
10. ANTICIPATED IMPACTS
The proposed dredging would result in the excavation of approximately 930 sq. ft. of shallow bottom.
Approximately 11,925 sq. ft. of highground disturbance would occur during placement of dredged
material at the disposal site. Minor increases in turbidity can be expected during excavation.

resources while also protecting the rights of the property owner. Water-dependent uses, including(but not
limited to)dredging, are allowed within this classification. L UP Policy 4.9 states, allow uses of estuarine

CHECKLIST OF ADDITIONAL INFORMATION AND RECOMMENDATIONS FOR
PROCESSING APPLICATION
1. All drawings must have the north arrow and be accurately drawn to scale, using a standard engineers
scale (no smaller than V to 200'). A title block on each sheet should contain the name of the project
and/or applicant, date the drawing was prepared, name of the one who prepared it, number of the sheet
(Example: 2 of 4), and address of the project site, including the county. Prints must be neat, clear and of
standard size to permit photographic reproduction. If blue prints or sheets larger than 11 X 17 are used,
26 copies must be submitted. If the drawings consist of more than 2 pages per set (example: Page 1 of 2,
etc.), they should be stapled together in sets. For additional information, refer to North Carolina
Administrative Code Section 710200 -Application Process.
2. The Division of Coastal Management is now requesting water depth measurements for all major permits.
Please include these measurements on the site plan drawing illustrating the water depths from the marsh
bank out to the channel.
3. Please provide a letter from the applicant authorizing you to act as his agent in the filing of the permit
application.
4. Copies of the notification letters mailed to the adjacent riparian property owners. These letters must
indicate that a copy of the permit application was included, and the Division of Coastal Management's
address, at the Wilmington Regional Office where they may send comments or objections to the

Stormwater Project No. SW8 030303
William G. Dooley Maintenance for Dock Access
New Hanover County
Dear Mr. Dooley`.
The Wilmington Regional Office received a copy of the CAMA Major Permit
Application for maintenance for dock access on March 3, 2002. Staff review of the plans and
specifications has determined that the development activities proposed at this time will not pose
a threat to surface water quality from stormwater runoff. The Director has determined that
projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements
of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not
require a stormwater management permit.
If the subject project disturbs five acres or more and has a point source discharge of
stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System
(NPDES) stormwater discharge requirements. You are required to have an NPDES permit for
stormwater discharge from projects meeting these criteria. The stormwater rules require the
Division to permit the common plan of development, therefore, any future development on the
property, regardless of whether a CAMA Major permit is also required, will require a Stormwater
Management Permit application and permit issuance from the Division of Water Quality prior to
any construction.
If you have any questions or need additional information concerning this matter please
contact Ms. Linda Lewis at (910) 395-3900.

RE: CAMA Major permit application
Dooley property, Airlie Road
Dear Ed:
Please find enclosed a CAMA Major permit application for property at 1207 Airlie Road
in Wilmington, NC. The applicant requests dredging to restore navigable depths within
an existing boat lift and dock area. Existing depths within the proposed dredging area
average—1' MLW and final project depth would be—5' MLW. Approximately 275 cy of
material would be removed with a barge mounted excavator. The material would be
placed on an existing spoil disposal island located directly across the AIWW from the
project site. The material would be placed inside an existing dike on the island, outside
the Corps' right of way, and a letter of permission from the island's owner is enclosed. It
is noted that an exemption from a NC Stormwater Permit is requested since no upland
work is proposed and no new water dependent structures are proposed. The adjacent
landowner notifications have been sent and the green card receipts will be forwarded to
your office as soon as they are received. Please contact me at Land Management Group
if I may be of assistance during your review of this application.

Dear Mr. Dooley:
The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for the proposed development at your property located at 1207 Airlie Road, adjacent to the Atlantic
Intracoastal Waterway, in New Hanover County. It was received as complete on April 10, 2003, and appears to
be adequate for processing at this time. The projected deadline for making a decision is June 24, 2003. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property
of your proposed development. You should post this notice at a conspicuous point along your property where it
can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or
tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review, the agencies
may contact you directly.
Sincerely,
J on Dai
