This permit,issued on July 2,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) This permit authorizes the excavation of the 60 ft. by 30 ft. basin area around an existing pier that is expressly and specifically stated in the application and as depicted on the attached workplan drawings. 2) Excavation will not exceed -5 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters. 4) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Spoil Disposal 6) The spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. It is recommended that the permittee contact the appropriate Division field representative a minimum of two weeks prior to the expected start date 7) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 11) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 13) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. r William G. Dooley Permit#90-03 Page 3 of 3 ADDITIONAL CONDITIONS 14) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 030497. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 200300731. COAST GUARD REGULATIONS APPLICABLE TO DREDGE OPERATIONS Below is a list of regulations which are applicable to dredge operations in the COTP Wilmington zone. This list is not all inclusive. We encourage dredge companies to schedule a meeting with members of the USCG staff, in order to be provided amplifying information or answers to any questions that may exist. We also strongly encourage all Uninspected Towing Vessels (UTV) associated with each dredging operation to participate in the USCG's UTV Voluntary Commercial Dockside Examination program. PROJECT SUMMARY: The applicant proposes excavate a basin area around an existing private dock and boatlift. William G. Dooley Page 2 9. PROJECT DESCRIPTION The applicant's property is located at 1207 Airlie Road, in Wilmington, in New Hanover County. The property is located on the western side of the Atlantic Intracoastal Waterway just south of the Gray Gables community docks. The subject property is split along the eastern edge by Airlie road. The pier and docking facilities are located to the east of Airlie road and the residence is located on the western side. The Existing structures on the property include a private residence,pier, floating dock and boatlift. The high-ground property is approximately one acre in size and has an average elevation that ranges from three to twenty feet above normal high water. The highground property is vegetated primarily with Live Oaks, shrubbery, and lawn grasses. The applicant's property has approximately 80' of frontage on the Atlantic Intracoastal Waterway. The entire shoreline is stabilized by a vertical wooden bulkhead. Waterward of the bulkhead is a border of coastal marsh composed primarily of Smooth Cordgrass (Spartina alterniflora), averaging 50'-55' in width. The Smooth Cordgrass (Spartina alterniflora), is intermixed with Black Needlerush (Juncus roemerianus) in the upper section of the coastal marsh. High- ground shrub vegetation is primarily dominated by Wax Myrtle (Myrica cerifera) and Grounsel-bush (Baccharus halimifolia). The pier on the property extends into the Atlantic Intracoastal Waterway approximately 200', including the 8' wide x 24' long floating docks (which receives ramp access from the fixed pier walkway). The pier(4'wide x 135' long) also includes a gazebo (12' long x 16'wide), approximately 60' from the waterward end of the structure. The waters of the Atlantic Intracoastal Waterway in the vicinity of the project site are Classified"SB#" by the Division of Water Quality. The Division of Marine Fisheries have no designated Primary Nursery Areas within 4000' of the project location. The waters surrounding the subject property are closed to the harvesting of shellfish. The applicant is proposing to dredge a basin to access the existing floating dock and boatlift. The basin would consist of an 60'x 30' area, extending approximately 8' north, 15' south and 27' east of the existing floating dock. Existing water depths in proposed excavation area range between -1.0' and -2.5' MLW. The applicant proposes to excavate to -5.0'Normal Low Water(NLW). Based on inspection of aerial photography, the current location of the applicants floating dock outside of the 80'US Army Corp of Engineers setback. The applicant states that when the first pier was constructed there was ample water depth at low tide, and that shoaling in recent years has limited the use of the south side of his docking facility. The applicant is proposing to excavate the material using a barge mounted excavator. The material would be loaded directly onto a barge and transported to the disposal site, which is an upland diked disposal island located outside of the US Army Corps of Engineer's Right of Way, on the east side of the AIWW, 800' east of the subject property. The applicant has obtained letters of permission from the owners of the island for this activity. The applicant estimates that approximately 275 cubic yards of material would be removed from the proposed project site. 10. ANTICIPATED IMPACTS The proposed dredging would result in the excavation of approximately 930 sq. ft. of shallow bottom. Approximately 11,925 sq. ft. of highground disturbance would occur during placement of dredged material at the disposal site. Minor increases in turbidity can be expected during excavation. Dooley 4/16/2003 With respect to the proposed dredging I recommend the following conditions: If Federal authorization and State 401 Certification approval are obtained, this Office would have no objection to the issuance of a permit with the following conditions: 1. In order to protect juvenile shrimp, finfish, and crabs populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 3. No marsh grass will be excavated and/or filled. 4. The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5. All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spill-over of solids into any marsh or surrounding waters. 6. The spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within thirty(30) working days of project completion. 7. The proposed basin will impact approximately 930 square feet of shallow bottom. Dredged spoil material will be deposited at an approved disposal site. The project site is located in the unincorporated portion of New Hanover County on the western side of the Atlantic Intracoastal Waterway(AIWW),just south of the Gray Gables community docks. According to the Division's Field Investigation Report,the Public Trust Area and Estuarine Waters Areas of Environmental Concern(AEC)will be impacted. Waters at the site are classified SB#, and are closed to shellfishing. Waters at the site are not designated as a Primary Nursery Area(PNA). This development proposal has been reviewed for consistency with the Wilmington—New Hanover County CAMA Land Use Plan(LUP)Update and Comprehensive Plan(1997-2010),as amended. The land classification for this site is Conservation. The purpose of the Conservation classification is to provide for effective long-term management and protection of significant,limited or irreplaceable natural resources while also protecting the rights of the property owner. Water-dependent uses,including(but not limited to)dredging, are allowed within this classification. L UP Policy 4.9 states, allow uses of estuarine and public trust waters that provide benefits to the public and satisfy the riparian access needs of property owners. In tidal waters, docks shall be limited to the minimum necessary to provide riparian access to waterfrontproperty owners. The Wilmington Regional Office received a copy of the CAMA Major Permit Application for maintenance for dock access on March 3, 2002. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements.
