Docking Facility 1) This permit authorizes only the addition of a new, uncovered boat lift and finger pier to the existing docking facility located in or over the water that are expressly and specifically set forth in the permit application except as modified by Condition 2 of this permit. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) In accordance with the attached workplan drawings dated 12/1/02, the 30 foot finger pier shall not be greater than 2 feet wide. Signature of Permittee Joann Dewar Permit#17-03 Page 2 of 3 1 ADDITIONAL CONDITIONS 3) In accordance with commitments made by the permittee, the authorized structure shall not extend more than 30 feet waterward of the existing bulkhead. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) Should the adjacent property to the north be sold.prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from, the new property owner prior to the placement of any structures within the 15-foot riparian corridor. 6) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 8) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) This permit authorizes the addition of 1 new slip to the existing 5-slip facility for a total of 6 slips. At no time shall more than 6 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. General 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. NARRATIVE DESCRIPTION: Project Setting Mrs. Joann Dewar owns property located at 235 Bayview Blvd. within Atlantic Beach, Carteret County adjacent to a manmade canal,which is a tributary to Bogue Sound. The site can be accessed by turning left or east onto East Fort Macon Road off the Atlantic Beach Causeway and turning left again or north onto the fourth street. Once on Bayview, Mrs. Dewar's property is located near the end of the road at 235 Bayview located on the west side of Bayview Blvd. The site is a typical Atlantic Beach canal front residence measuring 100' wide along the water and 175' deep or east toward Bayview Blvd. The elevation of the lot is approximately 3' above MHW and currently contains a single-family residence, driveway, and docking facility. The tract is vegetated with lawn grass and is bordered on the north by the Fletcher property and to the south by the Degnan property. There is only one record of permit activity on this lot and this was the installation of a new vinyl bulkhead in 2001 authorized under general permit# 26932 out of the Morehead Field Office. As previously stated the 100' of shoreline is bulkheaded with a vinyl seawall and the riparian area houses a multiple slip docking facility. Currently in the riparian area there are two boatlifts, one jet ski lift, and two wetslips all supported by three finger piers. The large wetslip on the south side of the property delineates the largest offshore structure at 44' from the Normal High Water Level or in this case the bulkhead. The adjacent water is a manmade canal, which is a tributary to Bogue Sound and holds the same water classification as the receiving waters SA HQW. The water is closed to shellfish harvesting and does not serve as either a primary or secondary nursery area. The depths at the location of the proposed boatlift are -3' MLW and—T MHW and the substrate is coarse sandy bottom. Project Description The applicant has proposed to add an additional slip to the current docking facility bringing the total number of slips to six. This slip addition is proposed by installing a new boatlift in the north side of her riparian area flanked to its south by a finger pier. The new finger pier will measure 30" wide while measuring 30' offshore. The proposed uncovered boatlift would measure 10' X 12' and be positioned in an area, which has 3' of water at low water with 4' of tidal amplitude. The distance across the canal in this area is approximately 180' therefore the '/a limitation across the canal will not be exceeded. The proposed lift and finger pier offshore distance will be shorter than the wetslips, within the same docking facility, to the south. This proposed sixth slip necessitated and has received a waiver from the Fletcher property to encroach up to the riparian line. FIELD INVESTIGATION REPORT: DEWAR / CARTERET COUNTY PAGE #3 --------------------------- Anticipated Impacts The proposal will usurp an additional 330 ft2 of open waters over the existing configuration. Short-term turbidity would be expected through the installation of the new pilings to support the lift and finger pier yet long-term turbidity would not be expected. Improved boating dockage would occur as a result of the proposal. Finally, impact on the navigation of the manmade canal and to the boating public should be negligible. Brad E. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction. Based upon my review I have no objection to the issuance of this permit but offer the following conditions: 1. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the marina/docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 2. The authorized structure should not extend beyond the requested 30' from the existing bulkhead. 3. The applicant proposes to install a new 10' x 12' boatlift supported by a new 30' x 30"finger pier on the south side of the proposed boatlift. Areas of Environmental Concern(AEC's) impacted by the proposal are Estuarine Waters, Public Trust Areas. Waters at the project site are classified as SA HQW and are closed to the harvesting of shellfish. The area is not a Primary or Secondary Nursery Area. I have reviewed this proposal for consistency with the 1996 Atlantic Beach Land Use Plan Addendum and offer the following comments. The general area of the project is classified as Developed Residential,while the AECs impacted by the work are classified as Conservation. In general, Atlantic Beach allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Atlantic Beach Land Use Plan contains some local policies which exceed 7H guidelines including those for Marina and Floating Home Development. However,none of these more restrictive local standards appear to be applicable to this project. It is important to note that the Atlantic Beach LUP states that projects in public trust areas shall not directly or indirectly block or impair navigational channels. Provided all local, state and federal requirements can be met, this project appears to be consistent with the 1996 Atlantic Beach Land Use Plan Addendum.
