This permit, issued on October 27,2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina Facility
1) This permit authorizes only the docks, piers, and other structures located in or over the water that are expressly
and specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this marina facility without permit modification. No non-water dependent uses of
structures may be conducted on, in or over public trust waters without permit modification.
2) Prior to the occupancy of any new or reconfigured slips authorized under this permit, the permittee shall ensure
that the existing marine pumpout sewage disposal facility is operable, and will maintain the pumpout facility for
the life of the marina.
3) The marina facility will display a sign showing the location of the on-site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main piers.

ADDITIONAL CONDITIONS
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
5) The permittee shall adhere to the previously approved marina operation plan dated 6/l/95 and approved
on 8/16/95.
6) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United States.
7) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
8) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities.
11) This permit authorizes a maximum of 222 boat slips. At no time shall more than 222 vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
General
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3400 (DWQ Project No. 031059), which was issued on 10/6/03.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit
No. 28 (COE Action Id. No. 200310922) which was issued on 9/22/03.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh,NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty(20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas,you may contact Department personnel at any time for assistance. By

Project Setting
The project site is located off SR 1123 at the Cypress Landing Development on
Chocowinity Bay near Chocowinity, in Beaufort County, North Carolina. Weyerhaeuser Real
Estate developed the Cypress Landing Subdivision that included an 18-hole golf course and a
marina on Chocowinity Bay under CAMA Major permit No. 181-89 issued on 11 September
1989. The marina was permitted by CAMA Major Permit No. 181-89 and it allowed for the
construction of 302 slips using a floating dock construction. The marina was constructed as a 224
slip facility incorporating ±330,600 ft2 of open water with 5 finger pier complexes attached to
land by one access point. The permit was modified by letter of Refinement on 14 March 2000 to
add 4 slips bringing the total number of slips to 228. It is.important to note that when the original
permit was issued, Weyerhaeuser through restrictive covenants attached to each deed,relinquished
any and all riparian rights of the homeowners with waterfront property.
Upstream(west)of the marina is a portion of Cypress Landing with cluster homes know as
Cypress Ridge (with an established Home Owners Association) and the shoreline in this area has
been left undisturbed. Downstream (east) of the marina are developed properties in the Cypress
Landing Subdivision with retaining walls landward of the wetlands. The marina property is
dominated by lawn grass with mixed hardwoods, pines, and ornamental shrubs. Structures on the
site include .a community building with a marina office, a swimming pool, and a paved parking
area.
Chocowinity Bay is classified as SB by the Environmental Management Commission.
Chocowinity Bay at the project site is a Public Trust Area and is not open to shell fishing.
Project description
The applicant proposes to replace the existing 228-slip marina with a 222-slip marina in the same
footprint. The reduction in slips is a result of redesigning the existing slips on each of the 5 finger
pier complexes. The only enlargement from the existing structure is a proposal to widen the
gangway-landing platform which is currently 8' wide to a width of ±19.5' for a distance of
±108' in an effort to reduce congestion at the single point of access from the land. The applicant
proposes to work on no more than 3 of the 5 finger pier complexes at any one time so that at least
2 of the slip structures are always open for use. As was the case when the marina was originally
built, Whichard's Beach will be used as the staging area for removal of the existing docks and the
construction of the new floating docks. The existing pilings, hardware and electrical service will
be reconditioned and reused.
Anticipated impacts
The project as proposed will result in localized turbidity as a result of the construction
activities. No additional usurpation of the Public Trust Area is proposed beyond the ±330,600 ft2
of Chocowinity Bay that is currently within the marina complex footprint.

project proceeds and disposal plans become more lucid.

Attachment to: CAMA Major Permit Application for
Cypress Landing Marina Dock Replacement
Applicant: Weyerhaeuser Real Estate Company
As per DCM instructions, enclosed is application form DCM-MP-1 with some information
that pertains to the entire Cypress Landing Development. Much of this information is not
applicable to this permit request to conduct work specifically at the marina (including
replacement of floating docks and associated utilities only). The following provide
clarification on some of this information and are keyed to the related items on the
application form. _
3.d. This project involves the replacement of an existing floating dock system at the
Cypress Landing development in Chocowinity, Beaufort County, NC. The existing
floating dock system is composed of a western red cedar, glue laminated structural deck
and plastic, foam insert filled flotation units. The floating docks are anchored in place
with steel pipe piles. The existing floating docks are in an advanced state of
deterioration due to moisture intrusion. It has been determined that the degradation of
the structural components of the docks from this collection of moisture dictates full
replacement of the system, in order to ensure personal and vessel safety, as well as
dock longevity.
The Applicant proposes to remove the existing floating dock system, dispose of it off-
site, salvage all functional utility elements (existing power pedestals,, wiring,
transformers, marine sewage pumpout, etc.), replace the docks with a new floating dock
system, and reinstall the utilities. Existing steel pipe piles will be re-used in conjunction
with additional steel anchor piles as necessary. It is envisioned at this time that the
replacement dock system will be a standard, treated timber frame and deck product, with
galvanized steel hardware and stainless steel fasteners. Decking will be IPE hardwood.
Flotation will be industry-standard high-density polyethylene 6-sided tubs, completely
filled with expanded polystyrene foam.
Specifically, physical construction is anticipated to proceed in the following manner:
Three of the five existing dock trees are expected to remain in service (without utilities)
at any time during the replacement process. Boats will be relocated to alternate marinas,
trailered, or moved to open slips on other docks within the marina as necessary. The
utilities (water lines, electric lines, power pedestals, and transformers) will be
disconnected, removed from the docks, and moved off-site to be reconditioned for use in
the new facility. The existing piles will be vibrated out and moved off site to be
reconditioned for reuse. The existing floating docks will be disassembled and disposed
of off-site. Concurrently, the contractor will assemble the new docks and float them over
from Whichards Beach or other suitable staging location. Replacement piles will be
driven and/or vibrated to minimize the potential disturbance of bottom sediments.
Finally, new/reconditioned utilities will be installed on the docks.
No additional slips will be added and the footprint of the marina will remain substantially
the same. The proposed (replacement) dock system will lie entirely within the existing
submerged lands easement for the current marina. The total number of existing slips
shall be two hundred twenty two (222), which is six (6) less than what currently exists at
the facility. Further, the marine sewage pumpout will be refurbished and reinstalled in its
present location.
The marina will remain a private facility and will allow water access for boater and non-
boater Cypress Landing residents. No fueling facilities are existing or proposed for the
marina.
4.d. Since this project does not impact any upland soils, soil boring logs for the marina
basin, sampled in June 2003, are provided as an attachment. These logs show soil
information from four separate underwater locations within the limits of the proposed
work area (the marina basin). Soils shown in these logs generally range from silty clays
to clayey sands.
4.h. With regard to zoning, officials at the Mid-East Commission have stated that that
the entire tract at Cypress Landing is zoned either R1-ETJ or B1. It is our understanding
that the B1 designation applies to a small commercial development within the
community.
Please note that there is to be no such commercial activity at the marina. There will be
no fuel or fuel sales, no transient dock space available for lease, and no ships store.
The marina is and will remain for the use of Cypress Landing residents and their guests
only.
4.k. Regarding National Register listed or eligible properties, please find attached
documentation from the North Carolina Department of Cultural Resources regarding a
shipwreck adjacent to the existing marina facility. Correspondence related to Permit
#89-191 indicates that the shipwreck, UAU #0017PMR, is mentioned to be potentially
eligible for inclusion on the National Register of Historic Places. Additional protection
measures were outlined in Permit #89-191 and related permit modifications.
The wreck sits just off the southeast corner of Dock "E" and is currently marked by
several 4"x4" vertical timber posts. Access to the site is depth limited and there are no
existing or proposed boat slips in the area of the wreck. Further, this area will be off-
limits to contractors during dock replacement activities.
The proposed marina replacement will not affect the shipwreck in any fashion.
Construction drawings will indicate that the contractor shall avoid the wreck area.
4.1. This item deals with wetlands at the project site. While there are wetlands on the
Cypress Landing tract, the replacement of the marina will not involve disturbance or
alteration of any wetlands. We have included a reference map and detail drawing from
the original CAMA permit application for the entire tract that shows the absence of
wetland impacts for the marina area.
Note that the scope of work for the proposed marina replacement project does not
include replacement of the fixed timber access pier that connects to the upland or the
gangway that leads from the access pier to the floating docks. These items will be
reused in the proposed facility, with only minor structural improvements as necessary.
Existing Dock Removal
With regards to the removal of the existing docks at the facility, we are examining a few
options. The Owner, Weyerhaeuser Real Estate Company, has no plans to re-use the
docks. We will likely have the marine contractor who performs dock removal and
replacement to either dispose of the docks off-site at a proper waste collection facility or
we will allow that contractor to submit a deduct alternate in their work bid to take
ownership of th-e old docks. In either of these scenarios, the contractor will be advised to
follow all applicable federal, state, and focal regulations in the future use or disposal of
these docks.
For reference we have also included a copy of the following:

1994
• Documentation of the existing submerged lands easement for the marina

Cypress Landing Marina Replacement
The following provide clarification on some of the items on form DCM MP 4 and are
keyed to the related items on the application form.
a.6.ii. & a.6.1ii Length and Width of proposed dock platforms
There are platforms of varying lengths and widths on the proposed replacement dock
system at Cypress Landing.
On each proposed main dock tree there is a small platfoTM to support electrical
transformers. This is a similar arrangement to what is currently in place at the marina.
Dimensions for the transformer platforms are as follows:

Also, we have shown an increase to the dimensions of the gangway-landing platform in

a.8. Proximity of structure to P ro riparian e P property lines
Per our conversation on August 4, 2003, we have discovered that the existing dock
structure actually overlaps the riparian line between the marina facility and the Cypress
Ridge HOA. This overlap is approximately 36.5' and impacts only four slips at the end
of existing Dock "A".
As per your request, we have included an agreement letter between Weyerhaeuser and the
Cypress Ridge HOA stating that this condition is acceptable as it relates to dock
replacement. We have also enclosed a copy of the deed for the Cypress Ridge property.
This condition came about as Weyerhaeuser conveyed the property adjacent to the marina
to the Cypress Ridge HOA after the existing marina was permitted and the existing
submerged lands easement was granted.
You will irecall that the proposed docks shall be positioned entirely within the existin
submerged land lease easement. g

Dear Mr. Doughty:
You have our approval, in accordance with the attached conditions,to incorporate7.6 acre of non-vegetated wetlands in order to
replace an existing 228-slip marina with a 222-slip marina in the same footprint at the Cypress Landing Subdivision in Beaufort County,as
described in your application received by the Division of Water Quality on August 25,2003. After reviewing your application,we have
determined that this fill is covered by General Water Quality Certification Number 3400,which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal
Management. In addition,you should get any other federal,state or local permits before you go ahead with your project including (but not
limited to)Sediment and Erosion Control, Non-Discharge,Water Supply Watershed and U.S.Coast Guard regulations. Also this approval
will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project(now or in the future)exceed one acre,compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:

The proposed project appears to be consistent with the rules found in Subchapter 7H
concerning development in Public Trust Areas. It is important to note that this project is the
replacement of an existing 228-slip marina with a 222-slip marina in the same footprint. The
existing marina was permitted under CAMA Major permit No. 181-89. It is important to note
that when the original permit was issued, Weyerhaeuser through restrictive covenants attached to each
deed, relinquished any and all riparian rights of the homeowners with waterfront property.
If the permit is issued, the standard conditions relating to marina installation and
operation should be included as well as a condition requiring the facility to adhere to the
previously approved marina operation plan submitted by Weyerhaeuser during the original
permit process.

The Department of Environment and Natural Resources hereby gives public notice as required by
N.C.G.S. 113A-119(b)that an application for a development permit in an Area of Environmental
Concern as designated under the CAMA was received on 15 August 2003. According to the said
application, Cypress Landing Marina, proposes to replace an existing 228-slip marina with a 222-
slip marina in the same footprint, at Beaufort County off SR 1123 at the Cypress Landing
Subdivision on Chocowinity Bay near the Town of Chocowinity, North Carolina. A copy of the
entire application maybe examined or copied at the office of Terry Moore, 943 Washington Square
Mall, Washington, NC during normal business hours.
Comments mailed to DONNA MOFFITT, DIRECTOR, COASTAL MANAGEMENT,

The Division of Coastal Management hereby acknowledges receipt of an application for State
approval for development of property located in Beaufort County off SR 1123 at the Cypress
Landing Subdivision on Chocowinity Bay near the Town of Chocowinity,North Carolina. It was
received on 15 August 2003 and appears to be adequate for processing at this time. The projected
deadline for making a decision is 29 October 2003. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will also serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Should there be any questions on this
procedural change, do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your,proposed development. You should post this notice at a conspicuous
point along the property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of-way fronting the property,
or at a point along the road right-of-way where a private road would lead one into the property.
Failure to post this notice could result in an incomplete application.
